HomeMy WebLinkAbout750436.tiff RESOLUTION WHEREAS, a public hearing was held on March 10, 1975, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of JosephJ. Tenneson, President of Colorado R. G. Inc., 1025 9th Street, Greeley, Colorado 80631, requesting approval of site for the construction of a radio communication tower on the following described property,to wit: Part of the West Half (WI) of the Southeast Quarter (SE '-I) of Section 19, Township 8 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows: Beginning at the Southeast Corner (SE Cor) of said Section 19, and considering the South line of the Southeast Quarter (SE4) of said Section 19 as bearing South 90°00'00" West, with all other bearings contained herein being relative thereto; Thence South 90°00'00" West along the South line of the Southeast Quarter of said Section 19, 1846. 72 feet; Thence North 00°00'00" East, 30. 00 feet to the True Point of Beginning; Thence continuing North 00°00'00" East, 421. 97 feet; Thence North 90 00'00" East, 514. 69 feet; Thence North 00°00'00" East, 740. 00 feet; Thence South 90°00'00" West, 851. 38 feet; Thence South 00°00'00" West, 740. 00 feet; Thence North 90°00'00" East, 415. 69 feet; Thence South 00°00'00" West, 421. 97 feet; Thence North 90°00'00" East, 20. 00 feet to the True Point of Beginning. Said described tract of land contains 14. 657 acres more or less, and WHEREAS, the petitioner was present and represented by Joseph J. Tenneson, President of Colorado R. G. Inc. , Greeley, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the location of a radio communication tower, and WHEREAS, the said request location for the radio communication tower is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for the radio communication tower may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed, NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Joseph J. Tenneson, President, Colorado R.G., Inc. , 1025 9th Street, Greeley, Colorado, to locate a radio communication tower on the premised indicated above be, and it is hereby granted under the PL. II II 750436 conditions following: 1. That petitioner complies with Weld County comprehensive plan (page 48, paragraph 2, September 1973) in that it is any expansion of agri- business or agriculturally related industry. 2. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 3. That petitioner shall proceed with due diligence to effect said construction of the communication tower and that it shall have up to one year from date hereof to begin the constm ction of any and all facilities therefor; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 4. That petitioner shall restrict development to the plans submitted for approval by the Board of County Commissioners. 5. That final access location shall be approved by the County Engineer's office prior to construction of the said tower. 6. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Dated this 12th day of March, A. Weld County Planning staff recommends this be approved for the following reasons : (1 ) Complies with the Weld County Comprehensive Play„ page 43 paragraph 2 (September 1973 printing) which reads , "Expansion of agri-business or agriculturally related industry"; (2) Complies with iio-' .d County Zoning Resolution, 3. 3. Mr. Olson stated that the access has been approved , the County has agreed to install the tube in the right place and the applicant will purchase the needed tubing . After careful consideration and engineering evaluation of the radiation pattern of the proposed FM antenna systems this orientation, we feel , will provide the optimum coverage of the northern Colorado area and still maintain a low radiated field in the direction of the Bureau of Standards ' Table Mesa facilities (north of Boulder CO) . Unfortunately we were not able to make this determination at an earlier date due to the unavailable information on the horizontal pattern of the FM antenna. As additional antennas are mounted on the tower, a complete study will be conducted based on mutual effects of antenna orientation to determine optimum area coverage and main- taining protection requirements toward the Table Mesa facility. Enclosed please find also a copy of the radiation pattern that will be emitted. We have adjusted the tower orientation such that the null shown at the 260° mark will be directed toward Table Mesa. Because KFKA-AM is required to use a directional radiation pattern during the early morning hours, reception in these areas is difficult, if not impossible. All programming will be originated from our existing studios audio and in monitoring downtown e oley. The FAA aeronautical study disclosed that the proposed structure would not require an increase in any instrument approach minimum flight altitude nor would it require the raising of any minimum flight alti- tude associated with overlying Federal airways. The study further disclosed that the proposed structure would have no substantial adverse effect on visual flight rule (VFR) operations or any other aeronautical operation or procedure, provided the structure is obstruction-marked and lighted.
