Policy 7.2 reads: "Conversion of agricultural land to urban residential, commercial and industrial uses should be accommodated when the subject site is in an area that can support such development and should attempt to be compatible with the region." Part of this land is already in use for oil and gas. Agricultural land in this parcel will not be sacrificed for the trailer. The trailer is on a piece of property that is contiguous to an oil and gas tank battery, in a remote corner of the parcel, and be easily accommodated as an alternate use. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Per Section 23.3.40 The following BUILDINGS, STRUCTURES and USES may be constructed, occupied, operated and maintained in the A (Agricultural) Zone District upon approval of a permit in accordance with the requirements and procedures set forth in Article II, Division 4 of this Chapter. A. Mineral resource development facilities including: 2. OIL AND GAS SUPPORT SERVICES. The proposed manufactured structure to be used as office space will support mineral resource development. Also Section 23.3.40 5: "Any use permitted as a Use by Right, an ACCESSORY USE, or a Use by Special Review in the COMMERCIAL or industrial zone districts, provided that the property is not a Lot in an approved or recorded subdivision plat or lots part of a map or plan filed prior to adoption of any regulations controlling subdivisions. Encana is engaging in a commercial, site -specific, development that will be placed in an agricultural zone and is completing the USR in order to make it a permanent use. 4. Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. Surrounding land is oil and gas production and agricultural This use is consistent as support for oil and gas operations and will not interfere with any of the current uses. 5. Where the water originates if it flows onto the property from an offsite source The Fulton Extension Ditch is about 330' to the east of the proposed structure. Any water coming from the east side of the ditch would go into the ditch, so water coming onto the property would be rain that hits the ground between the property and the ditch. Any rain falling to the north, south and west of the property will flow downhill to the west. 3. Where it flows to as it leaves the property. Water will flow to the west as it leaves the property. 4. The direction of flow across the property. The direction of flow is west to east. 5. If there have been previous drainage problems with the property, There have been no previous drainage problems with this property. B. A drainage report summarizing the detention pond design with construction drawings and maintenance plan shall be completed by a Colorado Licensed Professional Engineer and adhere to the drainage related sections of the Weld County Code. 2. The submitted materials are in compliance with the application requirements of Section 23-4-130 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-4-190 of the Weld County Code as follows: a. A building permit will be required, for any new construction or set up manufactured structure, per Section 29-3-10 of the Weld County Code. A building permit application must be completed and submitted. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2006 International Energy Code; 2014 National Electrical Code; the ICC/ANSI A117-1-2009 Standards for Accessibility and Chapter 29 of the Weld County Code.. A plan review shall be approved and a permit must be issued prior to the start of construction. RESOLUTION #35 Factory Built Nonresidential Structured CRS 24-32-3305 Every Factory -Built Nonresidential Structure manufactured after the effective date of these regulations that is manufactured, sold, or offered for sale in this state must display an insignia issued by the Division of Housing certifying that the unit is constructed in compliance with the standards adopted in schedule "B" which is incorporated herein and made a part of these Rules and Regulations by reference, and all other requirements set forth by this resolution. 2. The manufactured structure is necessary for the effective and economic operation of the principal use. 3. The manufactured structure will not be used for residential purposes. 4. Adequate water and sewage disposal facilities can be made available to the mobile home or manufactured structure. 5. No reasonable alternative is available to the applicant for an office use. 6. The applicant must obtain a building permit for the manufactured structure and comply with all installation standards of Chapter 29 of the Weld County Code. 7. The six-month limitation for this temporary use may be extended in six-month increments at the discretion of the Director of Planning Services up to two (2) times, and thereafter by the Board of County Commissioners 8. All manufactured structures as accessory office uses are temporary. The manufactured structure shall be removed from the property upon the cessation of the use of the manufactured structure as an accessory office use. 9. The applicant shall submit a statement of an exit plan acknowledging that the temporary permit shall cease to exist at any such time as the mobile home is used for other than the permitted use. Such statement shall include detailed plan for removal of the mobile home upon expiration of the permit, or at such time the permit is not renewed by either the Department of Planning or Board of County Commissioners, the applicant will have 30 days to put the exit plan into place. 10. All temporary permits shall not be transferable by the applicant and/or owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. The structure home shall be removed from the property, or a new zoning permit shall be applied for and approved. 11. All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. 12. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As this is a temporary office use, portable toilets and bottled water are acceptable for adequate facilities. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. • No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall be constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any wellhead or within a twenty- five -foot radius of any plugged or abandoned oil and gas well. Any construction within a two - hundred -foot radius of any tank battery or one -hundred -fifty -foot radius of any wellhead shall require a variance from the terms of this Chapter in accordance with Subsection 23-6-10.C of this Code. 13. Any future structures or uses on site must obtain the appropriate zoning and building permits. 14.
