WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that two parcels of land, being
the property of Chester Ellis and Laurene Ellis, husband and wife,
Berthoud, Colorado, and more particularly described as follows, to-wit:
PARCEL A
That portion of the SW4 of Section 18, Township 4 North,
Range 68 West of the 6th P. M., in the County of Weld,
State of Colorado described as follows:
Considering the West line of the SW4 of said Section 18 as
bearing North and South and with all bearings contained
herein relative thereto.
Beginning at the West 4 corner of said Section 18 marked
by a lf" iron pipe; thence along the West line of said SWI
South 13. 77 feet to the TRUE POINT OF BEGINNING;
thence continuing South 345. 00 feet; thence North 89°17'14"
East 1260. 66 feet to an existing North-South fence line;

does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division of land
pursuant to its authority under CRS 106-2-33 (d), 1963, as amended.

NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described two parcels of land owned by Chester Ellis and Laurene Ellis
husband and wife, be exempt from the definition of the terms "subdivision"
and "subdivided lands" as provided for in the new Weld County Subdivision
- Regulations at Section 2-1A. , (3) adopted August 30, 1972, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of January,

Dear Sirs:
The attached plat, application, and other items are in reference to a request
for a recorded exemption by Chester and Laurene Ellis. The parcel in question
is approxima e y f irrigated agricultural land.
Based upon the information submitted and Weld County Resolutions, the
planning staff recommends denial of this request for a recorded exemption for
the following reasons:
1 . The proposed split is not in conformance with the intent of recorded
exemption, Section 9-2, of the Weld County Subdivision Regulations
which is defined as I'a means whereby non-productive agricultural lands
may be developed for higher or more productive uses, in-so-far as such
uses are compatible with surrounding agricultural uses in areas where
such land divisions are proposed?.
2. The evidence and investigation show that the property in question is
composed of Land Class II and III irrigated agricultural lands.
3. The proposed division does not conform to the Weld County Comprehensive
P1 n in that it promotes non-agricultural use of agricultural land.
