HomeMy WebLinkAbout20171224.tiffRESOLUTION RE: ACCEPT REQUEST OF MARK VILLEREAL AND ALMA GARCIA TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0007, FOR A USE PERMITTED AS USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (COMMERCIAL TRUCK PARKING - FOUR (4) TRACTORS) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 12, 2017, the Board moved to continue the application of Mark Villereal and Alma Garcia, 26659 CR 62.5, Greeley, Colorado 80631, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0007, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (commercial truck parking — four (4) tractors) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, to allow the applicant adequate time to meet with the surrounding property owners to discuss potential mitigation solutions, on the following described real estate, being more particularly described as follows: Lot B of Recorded Exemption, RECX12-0114; being part of the E1/2 W1/2 N1/4 of Section 33, Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, on August 9, 2017, the Board was presented with an electronic letter, dated July 14, 2017, from the applicant requesting the withdrawal of the application, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to grant the applicant's request and thereby accept the withdrawal of the application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Mark Villereal and Alma Garcia, to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR17-0007, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (commercial truck parking — four (4) tractors) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, on the parcel of land described above be, and hereby is, accepted. cc. = (Oa,/ Mm),C-rBCTJJ, G.PPL 1373o/ 2017-1224 PL2470 ACCEPT WITHDRAW REQUEST - (USR17-0007) MARK VILLAREAL AND ALMA GARCIA PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 9th day of August, A.D., 2017.
