RE: RECORDED EXEMPTION NO. 277 - LARRY LIND.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 19th day of September, 1977, in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Larry Lind, located on a
parcel of land described as the SWQ of Section 12 , Township 7
North, Range 67 West of the 6th P.M. , Weld County, Colorado, more
particularly described as follows , to-wit:
The Southwest Quarter of Section 12, Township 7 North,
Range 67 West of the 6th P.M. , Weld County, Colorado;
EXCEPT the parcel of land as conveyed by Deed recorded
in Book 1484, Page 603, Weld County Records,and except
the right-of-way as conveyed by instrument recorded in
Book 1315, Page 76, Weld County records and except the
easement as granted by instrument recorded in Book 1311,
Page 460 and re-recorded in Book 1311, Page 524, Weld
County Records; and except all minerals and mineral
rights heretofore reserved of record; and together with
all water and ditch rights appurtenant to said premises;
and including 2 shares of the capital stock of water
supply and storage company, and 2 shares of the capital
stock of Pierce Lateral Ditch.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Larry Lind, be exempt from
the definition of the terms, "subdivision" and "subdivided land"

RE : Recorded Exemption #277
Dear Commissioners:
The attached application, plat , and related items are in reference to a
request by Larry Lind for a Recorded Exemption. The parcel of land in
question is described as the SW* of Section 12, T7N, R67W of the 6th
P.M. , Weld County, Colorado . Said property is located 4 miles north of
Severence. The subject property contains 161 .43 acres of Class I , II ,
and III irrigated soils. The request is to split the property into
parcels of 10. 17 acres and 150.26 acres. As indicated in letters sub-
mitted from Mr. Larry Lind and Mr. J. Moody the quarter section in
question was purchased jointly by Mr. Moody and Mr. Lind. The property
was deeded to Mr. Larry Lind. The intent was for Mr . Lind to farm the
unimproved agricultural land in conjunction with other farms in the
immediate area on which he has his farm improvements and for Mr. Moody
to utilize the 10. 17 acre parcel with the existing improvements to house
a farm employee.
Based upon the information submitted and the adopted policies in the
County, the Planning Commission Staff recommends the request be approved
for the following reasons :
1 . The proposed split conforms with the intent clause of the Recorded
Exemption Procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District (Section
3. 3a of the Weld County Zoning Resolution) , and the Weld County
Comprehensive Plan since the use would be compatible with the
surrounding agricultural uses.
2. The request complies with the provisions of Section 9-4(a) of the
Weld County Subdivision Regulations.

Gentlemen
In December of 1976 Mr. Moody and myself, Larry Lind purchased the
SW; of Sec 12 (property in question) . The property was deeded to myself
and I contracted. back to Mr. Moody the ten acre*, Lot B as per Platt.
I have farms in the immediate area with ample improvements. Mr. Moody
also has a section adjacent to this quarter, but wanted some more living
quarters for his employees. I have put a sprinkler on the quarter to
improve its production. fir. Moody has started repair of the improvements
and we are both anxious to finish the exemption.

Gentlemen
Larry Lind and myself contracted to purchase the SW:, in Section 12
whereby he would end up with the farm ground and I would keep the 10 acres
and improvements. The property was deeded to Mr. Lind and he gave me
a contract to deed me the ten acres as soon as the exemption is completed.
I paid for my part of the farm and have spent an additional $2,500 for a new
heating system in the home. I talked with various people in the planning
office and they indicated it was not an unreasonable request for the
exemption. t'r. Lind , an area farmer, wanted additional farm ground and
I needed more living quarters for my employees. I have been caring for the
improvements au-,) using them (an employee of mine presently lives there) , but
we need to do additional work and would like to get the property in my name.
I run livestock and farm a Section of irrigated ground immediately West
of this Lot B.
