RE: APPROVAL OF RECORDED EXEMPTION NO. 351 - GARY AMMON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 27th day of November, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 326 , being the property of
Gary Ammon, described as part of the Southeast Quarter of
Section 7 , Township 1 North, Range 68 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows:
That part of the Southeast one-quarter of Section 7,
Township 1 North, Range 68 West of the 6th Principal
Meridian, Weld County, Colorado described as:
Beginning at the Southeast corner of said Section 7;
Thence N 00°00'00" E on an assumed hearing along the
East line of said Southeast one-quarter a distance of
425.00 feet to the true point of beginning;
Thence N 86°03'00" W parallel with the South line of
said Southeast one-quarter a distance of 990.39 feet
to a point on the Easterly R.O.W. line of the Union
Pacific Railroad, said point being a point on a curve
to the right, the delta of said curve is 59°08'48", the
radius of said curve is 1232.66 feet, the chord of said
curve bears N 54°17'46" E, 1216.73 feet;
Thence along the arc of said curve a distance of
1272.48 feet to a point on the East line said Southeast
one-quarter; thence S 00°00'00" W along said East
line a distance of 778.30 feet to the true point of
beginning.
Contains 11.858 Acres, more or less.
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land, " pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its

and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Gary Ammon be, and hereby is , exempt from
the definition of the terms "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
November, A.D. , 1978.

RE: Recorded Exemption #351
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by Gary Ammon for a recorded exemption. The parcel of land
under consideration is described as Pt . SE* Section 7, T1N, R68W of the
6th P. M. , Weld County, Colorado. This property is located approximately
1/2 mile northeast of the Town of Erie. The property contains approxi-
mately 11. 858 acres of Class III and VI nonirrigated soils. The re-
quest is to split the property into two 5. 929 acre parcels.
It is the intent of Mr. Ammon to use the property for two residential
building sites. There is currently no improvements located on this pro-
perty.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1. The request comforms with the recorded exemption intent clause and
the Weld County Comprehensive Plan. The request is consistent with
the Town of Erie Comprehensive Plan. The proposed uses of the pro-
perty will be compatible with surrounding land uses.
2. The Town of Erie has set forth no objections to this request .
3. The property under consideration has a low utility for agricultural
use due to the acreage and the type of soils underlying the property.
The property is not considered to be prime agricultural land accord-
ing to the Soil Conservation ' Services' agricultural capability
classification system.

4. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

Dear Mr. Honn,
The following will outline our justification for the requested recorded
exemption and the proposed water use thereofi
A. Available Water and Sewer Service: This area is subject to in-
stallation of well and septic systems. Wells are for household use only
and will not serve any areas outside the immediate structure. This
area is part of the laramie-Foxhills Aquifer.
B. Preservation of Agricultural Lend: Due to the present size of the
site and the lack of water, this property has not been used previously
for agricultural purposes. Presently covered with natural grass, the
property does not provide enough feed for livestock grazing and does
not economically justify any crop production. Therefore, to divide the
tract into two parcels of approximately 6 acres would not adversly
effect the use of the property. However, the division would allow a
more manageable lot size for housing and still provide sufficient land
size to retain the present agricultural character.
C. Compatability with Future Land Use Plan: The City of Erie Future
Land Use Plan has designated this area for industrial development. How-
ever, the low demand for such use in this area and the fact that there
has been residential development under the present agricultural zoning,
the likelyhood of future industrial development here is very slight.
Also, this area adjoins a tract designated for low density residential,
10,000 square foot lots per living unit, under the present Future Land
Use Plan.
