Hi Bob,
This is a follow-up to my last email. I talked with the land owner for the above -referenced project, Larry
Bebo. He has met with LTWD about their raw water requirements, and they will accept Handy Ditch Company
shares among other acceptable water shares. Mr. Bebo already has an adequate number of Handy Ditch shares
that he will turn over to LTWD to meet the RWR. I don't know all the specifics of this transaction, so I can't
address your question re. change of use.
Hopefully this is enough to give you what you and Chris are looking for. If you need me to track down more
info, I can contact LTWD.

Kent,
I hope you are doing well today. The Planning Department generally sends me a request for referral related to
the water sufficiency of subdivisions, including subdivisions accomplished via the PUD process (in this case, as
required by Weld County Code 27-6-50.B.9). Although the Little Thompson Water District's May 31, 2016
letter commits to providing service to eight additional residential lots (with some restrictions), I am most
concerned about the statement: "Little Thompson Water District does not currently accept cash in lieu payments
for water rights for developments. You will be required to provide water rights to meet the projected needs of
the proposed development.
Does the developer have water rights available? If so, are they immediately available for residential use, or will
they require a change of use or other court authorization first? Has the developer dedicated those water rights to
the development? Feel free to call or email if you want to discuss.

Hi Bob,
I've been working with Chris Gathman on a 9 -lot PUD subdivision off CR3 and 1/2 mile south of Hwy 56, east
of Berthoud. The project came through the Sketch Plan process as "Estates at Coyote Run", but we changed the
name due to the existence of other Coyote Run projects.
We are ready to submit for Change of Zone. I've attached the Change of Zone plat for reference, and the
commitment -to -serve letter from LTWD.
Chris wanted me to forward the LTWD letter to you for acceptance at this stage of the process. Please let me
know if you have any questions.

Dear Mr. Bebo:
This letter is in response to your request for a water service commitment for up to 8 additional
residential services for the proposed PUD, in the location described as follows:
PORTIONS OF N SEC.19, T4N, R68W -- WELD COUNTY, CO
Parcels 106119000039, and 106119400081.
The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property and
the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations, however
this letter does not change any provisions of the Rules and Regulations. The Board of the District may
alter and amend the Rules and Regulations at any time, and the provisions of this letter are subject to
alteration and amendment based on changes in the Rules and Regulations of the District.
We currently serve the property at 20441 WCR 3, though tap # 6720 with an 8" diameter water
line located along WCR 3 with additional capacity available. We can commit to provide service to the
above property, subject to the limitations in this letter, for one additional residential 5/8" tap per lot;
and the following additional limitations on the provision of water service are:
1. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
All improvements must conform to District Specifications.
2. Little Thompson Water District does not currently accept cash in lieu payments
for water rights for developments. You will be required to provide water rights to
meet the projected needs of the proposed development
3. Prior to initiating water service, you will need to provide evidence that the property is
included in the Little Thompson Water District and the Municipal Sub District of the
Northern Colorado Water Conservancy District. You can find information on having
your property included in the Municipal Sub District at the offices of the Northern
Colorado Water Conservancy.
4. In order to supply domestic service to this site you would be required to install a
minimum 6" diameter water line from the existing 8" line at WCR 3, looping through
the project and connecting to the existing 3" line along WCR L The design, installation
and total cost of the project will be the responsibility of the developer.
5. The District currently does not have any funds budgeted to assist in the cost of
construction of the required waterline looping to WCR 1. It is possible that the District
could in the future have funds available to participate it the construction of the line.
That would be a future budget item and would be subject to the approval of the District
Board of directors.
6. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that
needs to be paid prior to installation of the fire hydrant. Provision of fire flows to this
location could require the construction of additional looped water line to supply even
minimum fire flows. You will be responsible for any improvements or upgrades needed
to meet the required fire flows in your development.
This commitment letter will expire two years from the date of this letter if the taps have not
been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8""
tap is $30,700. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS AND
TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND
THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT
MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE TO THE
ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE TO YOU OR ANY PERSON.
