BOX 557, KERSEY, COLORADO 80644 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home ° Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and -'0 WHEREAS, a public hearing was held on the 29th day of Novem- tn ber, 1978 at 3: 00 o 'clock p.m. for the purpose of hearing the L? petition of James Klein, P. Box 557 , Kersey, Colorado 80644, requesting a change of zone from A-Agricultural District to C- v0 Commercial District for the following described parcel of land, to-wit: A parcel of land located in the Northwest Quarter of Section 19, Township 5 North, Range 64 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: Beginning at the Northwest Corner of said Section 19, and considering the North line of said North- west Quarter Section 19 as bearing South 89°45'16" Fast, with all other bearings contained herein relative thereto; Thence South 89°45'16" East, 2050.64 feet; Thence South 52°07'54" West, 469.83 feet; Thence North 89°45'16" West, 1682.96 feet; Thence North 00°38'10" East, 290.01 feet to the Point of Beginning. Said described parcel of land contains 12.428 acres, more or less, including a strip of ground 30 feet in width along the North and West line of said described parcel of land reserved for County Road Right-of-Way purposes and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. WHEREAS, Section 8 . 2 and 8. 3 of the Weld County Zoning Resolution authorizes the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the request for re-zoning complies with the Weld County Comprehensive Plan and the conditions set out in Section 8. 2 and oo'& B86 /S 0CT 2 6 1979f Recorded at o'clock . Charles Dickson, Attorney for Mr. Klein, presented information to document the request for a change of zone. There was no one in opposition to the granting of the request present in the audience. After discussion, Commission Jacobucci made a motion to grant the change of zone from agricultural to commercial district with the Planning Commission's recommendations. Commissioner Carlson seconded the motion and it carried unanimously. Klein Z-308 :78 : 12 P. C. RECOMMENDATION October 17, 1978 The applicant has addressed the problem that the Kersey area has not had a farm service center and a need for such a facility has developed. The applicant further identified that the proposed use of the property will serve the needs of this immediate farming community and be conveniently located so as to be accessible to its clients . 2 . The rezoning request complies with the policies contained in the Weld County Comprehensive Plan relating to commercial development. The policy utilized to guide commercial development of this nature states on Page 61 of the Plan : "Commercial development designed to serve the agri- cultural base of the county should be located wherever practical within a municipality; however, whenever distance from a municipality makes this an impractical or unprofitable establishment of such commercial service, facilities within easy access to each agricultural area will be encouraged. " It is the opinion of the Planning Commission that the applicant has demonstrated that it is impractical to locate the proposed agri-business center catering to the needs of the area farmers within an existing municipality. In addition, the referral from the Town of Kersey identified that : "The Town of Kersey is not in opposition to the present location of Centennial Ag Supply and is in fact , supportive of the rezoning efforts of Mr. Klein so that his business can continue to operate. This business does provide a needed service in the Kersey area to our farming community and the Town of Kersey recognizes the fact that it would be impractical if not impossible for Mr. Klein to relocate his business within the presently commercially zoned areas within the Town of Kersey. " 3. The Platte Valley Fire Protection District has indicated they have no objection to the rezoning. 4. The Weld County Health Department has indicated that there is no apparent conflict with health regulations. 5 . The West Greeley Soil Conservation District indicated they could see no reason why the zoning should not be granted and suggest a berm or dike should be constructed around chemical storage areas so as to prevent contamination of the adjacent irrigation ditch in the event of a tank rupture. The Colorado Geologic Survey has no objection to the approval , however, they recommend a soils and foundation investigation be conducted for proper foundation design if any buildings are constructed. The recommendation of the Planning Commission is subject to: 1. The applicant submit a rezoning application if and when an appropriate "agri-business" District is adopted pursuant to the Weld County Zoning Resolution. The rezoning will be for the purpose of establishing an appropriate zone district for such agricultural service businesses as considered herein. This condition has been agreed upon by the applicant and Planning Commission. The concern expressed by both parties is that the Zoning Resolution does not provide a proper district for "Agri-business" uses. The current district utilized is the C-Commercial District . The Comprehensive Plan does indicate that "Agri-business" uses can be acceptable in outlying areas . The matter of concern, how- ever, is the uses permitted in the C-Commercial District include both "agri-business" uses which may be acceptable as well as urban oriented commercial uses which may not be acceptable uses in the rural areas as set forth in the Comprehensive Plan. Comments : To date , our office has received two letters of objection to the request from George and Lydia Hettinger and Louis and Josephine Klein. While not impossible, it is certainly undesirable and impractical if one intends to continue the business of Centennial. Ag Supply. It should be understood that the business known as Centennial Ag Supply was originally conceived by Petitioner as a secondary and incidental part of his normal farming operation. Because of the demand for the seed , feed, liquid fertilizers and limited pesticides Mr. Klein could provide, other farmers began using his service and thus in the short span of two years the business has grown to the point where Petitioner has been advised by the County Department of Planning Services the need to have a portion of his property rezoned if he wishes to continue in business. Finally, it should be explained that the nature of the business being carried on under the firm name of Centennial Ag Supply, directly services the immediate farming areas it is adjacent to and it is for that reason that Petitioner contends that the land is being utilized in it's most desirable and practicable capacity. Q. Would the proposed rezoning benefit the entire County by allowing a typical development which is needed and cannot locate in other parts of the County? A. Yes, inasmuch as with the exception of the Kersey area, virtually all other farming areas within Weld County are serviced by regional farm service centers which provide to some measure, the same services that Centennial Ag Supply does. However, it is believed by Petitioner that his operation is the first complete liquid fertilizer plant in Weld County. Basically, the operation being conducted at Centennial Ag Supply consists of the hatching of dried potash into liquid fertilizer for application to neighboring farms. Petitioner has received national recognition for new methods of nitrogen application on a commercial basis. Foliar fertilization and wheat chemical fallow programs are in initial stages after many years of study. By the use of flotation applicators Petitioner is able to offer fertilizer, herbicides and feed applications at one time. The liquid nature of the product results in a very uniform distribution of fertilizer using prescription formulation in preparing the right nutrients in the right ratios according to soil analysis for any given crop area. Therefore, it is believed that while the operationdoes indeed benefit the Kersey area in a typical manner, it is not typical in the potential service it would provide to the entire county of Weld. When these factors are coupled with the realization that the operation is located on a major U.S. HIghway presently budgeted for expansion to a four lane facility, the location would appear ideal for providing services , not only to residents but other farmers in neighboring locales within Weld County. While Centennial. Ag Supply is in the initial stages of development and growth, the costs associated with the move in relocation at this time would be devastating. Q. Would the proposed rezoning benefit lands adjoining the area requesting the change? A. Yes, inasmuch as virtually all adjacent lands are ongoing farming operations which find it very convenient to utilize the Petitioners services from both a time and cost perspective. Petitioner is currently located within the Kersey area and able to service his clients in an efficient and businesslike manner. As the business is agriculturally based, it only makes sense that it should be located in an agricultural area. Q. What features apply to the property requesting rezoning which make it logical to rezone this tract and not to rezone in a similar manner surrounding properties which may have like land use characteristics? A. The primary reason why the land in question is extremely suitable for rezoning i.s the fact that it is located on Highway 34 and as the same is scheduled to be expanded to a four lane highway in the very near future, it would only enhance the accessability of the Petitioners business to the public. While it is true that surrounding properties could likewige be rezoned and there is nothing inheriently different in the character of the land hereunder request , it must still be recognized that the business is presently ongoing and located on the parcel of land under consideration. The business itself enhances the nature of the zoning of the r , . h r r.J.t^- lands around it since it provides a service which is incidental to farming. Kersey previously had no agricultural based business that performed the functions Centennial Ag Supply does and therefore while other tracts of land could be rezoned so as to allow similar business eicj:ivity, it is questioned whether the Kersey area could sustain a multitude of such enterprises. Q. Why are other areas in the County already zoned according to the requested classification, unsuitable for the development which is proposed? A. This question has been basically answered above, inasmuch as Petitioner has pointed out that other areas in Weld County do have farm service centers. But such is simply not true (prior to the development of Centennial Ag Supply) in the Kersey area. The purpose Petitioner developed this business in the first place for, was because he saw a need for such a center in his own farm activities which ate located in . the Kersey area. The growth of the business has been a direct result of the fact that other farmers in the same area have experienced the same needs and therefore, the nature of an agri—based business requires that it have accessability to its clients , the farmers. It is not practical to assume that were Petitioner to locate elsewhere in Weld County already suitably zoned for such a purpose that his business would in fact service the Kersey area or even be utilized by a clientele. Additionally, it should go without saying that relocation at this time would be extremely costly and detrimental to Petitioners business success in light of the fact that the business is in its growing and development stages when cash reserves quite frankly are not available for relocation. Q. What proof of evidence is available that the original rezoning is faulty or that changing conditions in the area justify rezoning at this time? A. There is no proof whatsoever available that the original zoning is faulty , in fact it is the contention of the Petitioner that the original zoning is correct in that the area under consideration is a typical agricultural farm—ranch operation. However, conditions have changed, not only in farming practices but utilization of present crop areas when compared to crop yields that justify rezoning this area. Mr. Klein as previously stated, services his business area by being located within the midst of his clients. If this business cannot continue, a needed service will go without utilization. Q. Please submit Economic or other evidence that the area covered by the petition needs additional Commerical or Business in the area. A. See attached Exhibit A Q. Give some evidence of the proposed business or commercial enterprises that are to locate in the requested area and a tentative time schedule for construction. A. As previously stated, the business is already ongoing and operating in the proposed area and it is only because of the growth of the Petitioners acutal business enterprise which was originally incidental to his farming-cattle raising operation, but the need for this petition was expressed by the Planning Department. The growth of the Petitioners business was as much accidental as by design and it is certainly obvious at the present time that the commercial activity being carried on by Centennial Ag Supply is a viable ongoing entity. Klein application for a change of zone from Agricultural District to Commercial District, and we have the following comments. 1 . If this zone change is granted, there may be an increase in traffic due to expansion of Centennial Ag Supply. The potential for accidents will also increase due to left-turn and deceleration movements into this business. The existing 60 feet of right of way does not provide adequate room for highway improvements such as deceleration or left-turn lanes which would be desirable to help alleviate these potential problems. It would be desirable to consolidate existing access points to this site into one common point of access. This would at least reduce the number of points at which traffic could present accident hazards. 2. The petitioner's answers to questions regarding this rezoning indicate that State Highway 34 is " . . . presently budgeted for expansion to a four-lane facility . " and " . . . is scheduled to be expanded to a four-lane highway in the very near future . . . A study was done in 1970 for Project F 034-2(1 ) , Greeley Bypass East, which includes the portion of highway adja- cent to this property. However, there are no funds currently allocated for construction of this project in the Five-Year State Highway Program. Con- struction of a four-lane highway facility in this area should not be assumed as a condition affecting this application.
