WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of land,
being the property of Theo J. Rademacher and Elizabeth H. Rademacher,
Longmont, Colorado, and more particularly described as follows, to-wit:
Part of the Northwest Quarter (NW4) of Section
26, Township 3 North, Range 68 West of the 6th
P.M., Weld County, Colorado, being more
particularly described as follows:
Beginning at the Northwest Corner (NW Cor) of
said Section 26, and considering the West line
of said Section 26, as bearing South 00°25'30"
West, with all other bearings contained herein
relative thereto;
Thence South 00°25'30" West, along the West
line of the Northwest Quarter (NW-1) of said
Section 26, 1319. 87 feet;
Thence North 89°25'10" East, 50. 00 feet to the
True Point of Beginning;
Thence continuing North 89°25'10" East, 2596. 40
feet;
Thence South 00°13'00" West, 1348. 90 feet;
Thence South 89°39'54" West, 2601.07 feet to
a point on the East R-O-W line of Colorado Inter-
state No. 25, of Section 26;
Thence North 00°25'30" East, along the East
R-O-W line of Colorado, Interstate No. 25 of
said Section 26, 1337. 93 feet to the True Point
of Beginning;
Said described parcel of land contains 80. 137
Acres, more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division of
land upon the recommendation of the Weld County Planning Director for
the reasons as stated and pursuant to its authority under CRS 106-2-33
(d), 1963, as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Theo J. Rademacher and Elizabeth H.
Rademacher, Longmont, Colorado, be exempt from the terms "subidivison"
and "subdivided land" as provided for in the new Weld County Subdivision
Regulations at Section 2-1A. , (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 11th day of February,

The attached plat, application, and other items are in reference to a
request, by Theo J. and Elizabeth H. Rademacher, for a recorded exemption.
The parcel in question contains approximately 80.137 acres of irrigated

Based on the information submitted and Weld County Regulations, the
Planning staff recommends approval for the following reasons.
1 . The proposed split complies with the Weld County Comprehensive Plan
in-so-far as it promotes agricultural use.
2. The proposed split conforms to the intent clause, Section 9-2, of
