HomeMy WebLinkAbout20170749.tiffRESOLUTION RE: APPROVE MEMORANDUM OF AGREEMENT AND AUTHORIZE CHAIR TO SIGN - UPPER FRONT RANGE REGIONAL PLANNING COMMISSION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Department of Public Works, and the Upper Front Range Regional Planning Commission, commencing upon full execution of signatures, with further terms and conditions being as stated in said memorandum of agreement, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Upper Front Range Regional Planning Commission be and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum of agreement. Conway reeman arbara Kirkmeyer C 2017-0749 EG0074 MEMORANDUM J/ TO: Board of County Commissioners DATE: March 3, 2017 FROM: Jim Flesher, Transportation Planner SUBJECT: Memorandum of Agreement between Weld County and the Upper Front Range Regional Planning Commission The attached Memorandum of Agreement (MOA) between the County and the Upper Front Range Regional Planning Commission (UFRRPC) was requested by the Colorado Department of Transportation in order to have a formal agreement stating the County will act as support staff to the UFRRPC (for example, sending out agendas and taking minutes for quarterly meetings) and act as grantee (for example, for Congestion Mitigation and Air Quality (CMAQ) grants), which the County has done for many years. The County Attorney's Office has reviewed the MOA, which was provided to the BOCC in a pass -around in December. The UFRRPC approved the MOA at its March 2, 2017 meeting. BOX 758 GREELEY, COLORADO 80632 MEMORANDUM OF AGREEMENT BETWEEN THE Upper Front Range Regional Planning Commission AND Weld County WHEREAS, the Upper Front Range Regional Planning Commission has been formed by intergovernmental agreement between governmental entities charged with public improvements in the Upper Front Range Transportation Planning Region of Colorado for the primary purpose of developing and maintaining a Regional Transportation Plan; and, WHEREAS, according to Title 43 CRS Part 11, the Upper Front Range Regional Planning Commission is responsible, in cooperation with the state and other governmental agencies, for carrying out necessary continuing, cooperative, and comprehensive transportation planning for the Upper Front Range Transportation Planning Region; and, WHEREAS, the Upper Front Range Regional Planning Commission has the power to appoint or contract qualified staff, services, facilities and consultants as are necessary to do the work of the commission; and, WHEREAS, the Upper Front Range Regional Planning Commission is specifically empowered to receive and expend all grants, gifts, and bequests, specifically including state and federal funds available for the purpose of regional transportation planning; and, WHEREAS, Weld County and the Upper Front Range Regional Planning Commission share a common interest in making the most of their related authorities to the mutual benefit of the Region; and, WHEREAS, Weld County has the technical and clerical capacity to provide planning and community/economic development services to the geographic area within the Upper Front Range Transportation Planning Region; and, WHEREAS, the members of the Upper Front Range Regional Planning Commission desire to enter into an agreement with Weld County to provide professional and administrative support to the Upper Front Range Regional Planning Commission in the development of the Upper Front Range Regional Transportation Plan and its work and responsibilities in facilitating the transportation planning process. NOW THEREFORE, the parties to this agreement mutually agree to the following: 1. Weld County will provide professional and administrative support to the Upper Front Range Regional Planning Commission in the execution of its responsibilities as the transportation planning organization of the Upper Front Range Transportation Planning Region. The professional and administrative support includes, but is not limited to, contract administration, preparing and submitting invoices, maintaining records, developing and maintaining an appropriate mailing and contact list for all parties interested in transportation planning, arrangement of meetings and travel, preparation of meeting agendas and minutes, public correspondence and notifications. 2. Weld County does hereby agree to act as the grantee for the Upper Front Range Regional Planning Commission, when necessary. As grantee, Weld County assumes all responsibility as required under the laws, rules and regulations governing federal or state grants in general. Weld County shall also comply with all the conditions of any grant contract and the applicable laws, rules, and regulations governing transportation planning programs. 3. In the event that a party to this Agreement, other than Weld County, does not comply with all laws, rules, regulations, including all grant requirements, that party shall be liable for any unreimbursed grant funds or penalties. Weld County does not assume liability for legal and regulatory compliance of other parties by acting as the grantee. 4. Either party may terminate its participation in this Agreement six months after providing written notice of such, unless a grant contract is in effect with the Colorado Department of Transportation. In this case, the Colorado Department of Transportation must approve such termination and arrangements for completing the project that is the subject of the grant.
