RE: APPROVE ACCEPTANCE OF DEED OF DEDICATION FOR COUNTY ROAD 44 AND
AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS - JOSE CERVANTES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Deed of Dedication to Complete
Certain Improvements to County Road 44 between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Public Works, and Jose Cervantes, 16474 County Road 44, La Salle, Colorado 80645, with further
terms and conditions being as stated in said acceptance of deed; said property being located in
the NW1/4 of Section 23, Township 4 North, Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, after review, the Board deems it advisable to approve and accept said deed
of dedication, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Deed of Dedication to Complete Certain Improvements to County
Road 44 between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Jose
Cervantes, be, and hereby is, approved and accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign all related documents.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 6th day of November, A.D., 2017.

RE: CR 44 RIGHT OF WAY DEDICATION
Accept Deed of Dedication for additional right of way for Weld County Road 44 between Jose
Cervantes and Weld County.
This Deed of Dedication is presented to satisfy a condition of approval required with the
approval of MINFI2-0001 Weld County Industrial Park Subdivision (previously Hickman
Subdivision MINF 12-0001).

DEED OF DEDICATION
KNOW ALL MEN BY THESE PRESENTS THAT:
JOSE CERVANTES ("Grantor") whose address is 16474 Weld County Road 44,
LaSalle, CO 80646, for and in consideration of the sum of Ten Dollars ($10) in hand paid and
other good and valuable consideration the receipt and adequacy of which are hereby confessed
and acknowledged does hereby grant, bargain, sell, convey, dedicate and transfer to WELD
COUNTY, COLORADO, a body corporate and politic of the State of Colorado ("Grantee"), the
address of which is 1150 "0" Street, Greeley, CO 80631, all of the real property legally
described on Exhibit "A" attached hereto and incorporated herein by reference (the "Property");
AND WARRANTS TITLE to the Property free and clear of all liens and encumbrances.

A tract of land being a portion of that tract of land described at Weld County Reception
No. 3413201, located in the Northwest Quarter of Section 23, Township 4 North, Range
66 West of the 6th P.M., County of Weld, State of Colorado, and being more particularly
described as follows:
Considering the North line of the Northwest Quarter of Section 23 as bearing North 89°
56' 16" East, being monumented at the North Quarter corner of Section 23 by a #6 rebar
with an illegible 2 W' aluminum cap and the Northwest corner of Section 23 by a #6
rebar with a 2 W' aluminum cap, PLS 34176 and with all bearings contained herein
relative thereto:
COMMENCING at the North Quarter corner of Section 23, thence along the North line
of the Northwest Quarter, South 89° 56' 16" West, 204.00 feet; thence, South 00° 01' 20"
East, 30.00 feet to the South right-of-way line of Weld County Road #44, said point
being the POINT OF BEGINNING; thence along said South right-of-way line, North
89° 56' 16" East, 25.61 feet; thence along a curve concave to the southeast having a
central angle of 47° 02' 04" with a radius of 35.00 feet, an arc length of 28.73 feet and the
chord of which bears South 66° 25' 14" West, 27.93 feet; thence, North 00° 04' 05" West,
11.15 feet to the POINT OF BEGINNING.
The above described tract of land contains 88 square feet or 0.002 acres, more or less and
is subject to all easements and rights -of -way now on record or existing.
