HomeMy WebLinkAbout20173412.tiffRESOLUTION RE: AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST THE CORPORATION OF THE PRESIDING BISHOP OF THE CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County needs to acquire additional Property for the expansion of Weld County Road 47, in a portion of Section 1, Township 5 North, and Sections 25 and 36, Township 6 North, all in Range 65 West of the 6th P.M., Weld County, Colorado, as more fully described and depicted in the attached Exhibits, and WHEREAS, the value of the Property to be acquired is estimated to be $42,478.00, and WHEREAS, said Property is owned by the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter -Day Saints (the "Property Owner"), and WHEREAS, beginning no later than March 3, 2017, negotiations with the Property Owner have included numerous phone calls, letters, emails, in -person meetings, and site visits between and including: Weld County Right -of -Way Agent Tiffane Johnson, Weld County Engineer Don Dunker, Weld County Senior Engineer Cameron Parrott, Weld County Public Works Deputy Director Elizabeth Relford; and Nate Worthen, Judd Tidwell, and Eric Angus, all of the firm Newmark, Knight, and Frank on behalf of the Property Owner; and Eric Schenk and Terry Bradshaw, all of the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter - Day Saints, and WHEREAS, Weld County has made a final offer to purchase the Property on September 28, 2017, for the compensation amount of $42,478.00, and WHEREAS, the County and the Property Owner have attempted to negotiate compensation, but have been unable to agree on the terms of purchase and sale, and WHEREAS, to date, the parties have been unable to reach an agreement for the purchase of said Property, and WHEREAS, the expansion of County Road 47, between County Road 60.5 and Highway 392, as it proceeds past the Property Owner's property, is necessary for the public good to provide safety for the traveling public due to historic and projected increased traffic on said roadway, and WHEREAS, the Property Owner was notified through counsel by email dated October 2, 2017, of the place and time of the hearing at which the Board approved this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to file a proceeding in eminent domain, pursuant to Section 38-1-101 et. seq., C.R.S., against the Corporation of the Presiding Bishop of the Church of Jesus Christ of Latter -Day Saints, in the Weld District Court to acquire the Property described and depicted in the attached Map Exhibit, and Exhibits RW2, TE2, RW8, TE8, RW11, TE11, RW14, and TE14. c.a : ca.c gc) EG0074 10(5/17 2017-3412 RE: AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST THE CORPORATION OF THE PRESIDING BISHOP OF THE CHURCH OF JESUS CHRIST OF LATTER-DAY SAINTS PAGE 2 BE IT FURTHER RESOLVED by the Board that the acquisition of such Property is deemed necessary for the health, safety and welfare of the citizens of Weld County, Colorado. BE IT FURTHER RESOLVED by the Board that the Controller shall cause to be paid $42,478.00 into the Registry of the Court, being the amount that Weld County estimates is the appropriate value of the property including all damages, for the purpose of acquiring the aforementioned property upon the filing of a motion for possession of the property, or if in conjunction with a joint and stipulated motion for immediate possession or a stipulated Rule and Order, payment may be made to the Property Owner as an alternative to depositing such sums into the Registry of the Court.
