That the said )ipe lines shall be installed under the supervision and direction of the County Engineer, and shall be subject to his approval , and that the decision of said engineer with respect to the installing or maintaining of • said pipe lines across or along any of said highways, including bridges, shall be final and conlusive. . • 2. That the party of the second part will install and maintain said pipe lines at its own expense. • 3. That the party of the second part hereby agrees to imdemnify and save harmless the County of Weld from any damages to said county arising by reason of the laying or maintainence of said pipe lines; said damages , if not mutually agreed upon, to be ascertained and determined by three disinterested persons, one thereof to be appointed by the party of the first part, one by the party of the second part, its successors or assig}s, and the third to be appointed by the two so appointed as aforesaid, and the award of said three persons or any two of them{ shall be final and conelusive. 4. It is further agreed that the party of the second part shall no be requ red to bury said pipe lines where they cross over or fun in or along any bridge or large or deep canals, irrigating ditches , draws , ravines, streams, or rivers , where it is impracticable to bury said pipe lines , and in such case , the party of the second part agrees to construct such bridges, supports or structure for the carrying of said pipe lines as may be necessary, at its own expense , to the approval of said County Engineer. 5. If any county highway, affected or burdened by said 'pipe lines, shall be hereafter re-established and constructed, re-located, widened or the grade thereof changed, and it shall be necessary to move or re-construct said pipe lines , then and in that event , party of the second part agrees to re-lay and re-construct said pipe lines in such manner as shall meet with the approval of the County Engineers. b. Where practicable , said pipe lines shall be buried to a depth of at least Twenty-four inches below the surface of the ground. 7. That this grant is in nature of a permanent license and grant as long as party of the second part has any operations or need for said pipe lines along, across , in or over the highways, including bridges, situate in the Townships above specifically described, and may be assigned by the party of the second part. Party of the second part agrees to remove all pipe lines and structures installed or built by it along, across , in or over said highways, including bridges, when its need thereof shall have terminated. Clark NAYES : RIGHT OF WAY AGR1 ENT THIS INDENTURE AND AGREEAENT , Made this 21st day of September, A.D. , 1931, by and between the BORAD 'OF COUNTY COMMISSIONERS OF WELD COUNTY, Colorado , Party of the First Part, and THE SULTAN CORPORATION, a corporation existing under the Laws of the State of Colorado, ' its successors and assigns , Party of the Second Part, W I T N E S S E T H WHEREAS , The party of the second part desires to lay a pipe line or pipe lines and telephone lines, in connection therewith, in, over, along and across various certain public highways and bridges in Weld County , Colorado , for the purpose of carrying on its operations in said County , and, WHEREAS , Party of the first part is willing to permit the use of said highways and bridges in the Townships and Ranges hereinafter specified for said pipe line or ipe lines , and or telephone lines , subject to the terms and conditions hereinafter set forth; NOW, TFE L FORE, in consideration of the permises and the covenants and agreements hereinafter set forth, the party of the fist part does hereby grant unto the party of the second part the right to lay , construct , maintain, operate, repair, alter and remove pipe lines for the transportation of oil, gas, water or other substances, and telephone lines , to used in conjunction therewith, across , through, under and along the public highways and bridges of Weld County , Colorado , situate in the following Townships , North; Townships four (4) , Five ( 5) , six ( 6) , and seven ( 7 ) , all in Ranges Sixty-one ( 61) and silty-two ( 62) , West of the Sixth P.M. In consideation of said grant, the party of the second part agrees: 1: That the said pipe lines shall be installed under the supervision and directions of the County Engineer and shall Le subject to his approval , and that the decision of said Engineer, with respect to the installing or maintenance of said pipe lines and or telephone lines across or along any of said highway, including bridges , shall be final and conclusive. 2: That the party of the second part will install and maintain said pipe lines and or telephone lines at its own expense. 3: That the party of the second part hereby agrees to indemnify and save harmless the County of Weld from any damages to said County arising by reaspon of the laying or maintenance of said pipe lines and/or telephone lines ; said damages, if not mutually agreed upon, to be asscertained and determined by three disinterested persons, one thereof to be appointed by the 377 / r party of the first part , one by the party of the second part , its sueoessors or assigns, and the third to be appointed by the two so appointed as aforesaid, and the award of said three persons , or any two of them, shall be final and conclusive. 4: It is further agreed that the party of the second part shall not be required to bury said pipe lines where they cross over or fan in or along any bridge or large or deep canals, irrigating ditches, draws, ravines , streams or rivers, where it is impracticable to bury said pipe lines, and in such case, the party of the second part agrees to construct such bridges, supports or structure for the carrying of said pipe lines, as may be necessary, at its own expense, to the approval of said County Engineer. 5: If anY. county highwa„ , affected or burdened by said pipe lines, shall be hereafter re-established and constructed, re-located, widened or the grade thereof changed, and it shall be necessary to more or re-construct said pipe lines , then and in that event , party of the second part agrees to re-lay and re-construct said pipe lines in such manner as shall meet with the approval of the County Engineer. 6: Where practicable said pipe line shall be buried to a depth of at least three feet below the surface of the ground; and said telephone lines shall, at highway crossing, be constructed at least sixteen ( lt,) feet above the surface of the ground, or may be buried with the pipe line. 7: That this grant is in the nature of a permanent license and grant as long as party of the second part has any operations or need for said pipe lines and/or telephone lines, along, across , in or over the highway, including bridges, situate in the Townships above specifically described, and may be assigned by the party of the second part. Party of the second part agrees to remove all pipe lines and structures, and/or telephone lines, installed or built by it along, across, in or over said highways, including bridges when its need thereof shall have terminated. EN THE UNION �J PACIFIC RAILROAD COMPANY AND COUNTY OF /170 WELD. ) 1/6 THIS AGREEMENT, made and entered into this Nineteenth day of October, 1931, by and between UNION PACIFIC RAILROAD COMPANY, a corporation of the State of Utah(hereinafter called "Lessor" ) party of the first pant, and the COUNTY OF WELD, STATE OF COLORADO(hereinafter called "Lessee" ) , party of the second part, WITNi;SSETH: 1. The Lessor hereby leases to the Lessee for a period commencing on the first day of September, 1931 , and terminating on the twelfth day of January, 193b, unless sooner terminated in accordance with the terms hereof, the following described strip or parcel of land situate in the County of Weld, State of Colorado, to be used for highway purposes only: A strip , piece or parcel of land situate in the Southwest ,uarter of the Southwest Quarter (SW* of SW ) of Section Twenty (20) , Township Six ( b) North, Range Sixty- five (b5) West of the Sixth Principal Meridian, being all that part of the Lessor' s right of way included between lines parallel with and distant respectively twenty- five (25) feet and fifty ( 00) feet easterly, at right angles, from the center line of the Lessor' s main track, and extending northerly from the north line of the east and west public highway located on the south line of said section of the east line of the north and south public highway located on the west line of said section; as shown outlined by yellow lines on the plat of said premises hereto attached, designated as C. E. Drawing No. 52225, dated September 1, 1931, marked "Exhibit A" , and hereby made a part hereof. / 2. As a consideration for this lease the Lessee agrees to pay in advance to the Lessor a rental of Five Dollars ($5.00) for the term hereof; to assume all taxes and assessments levied upon the leased premises during the continuance of this lease, not including taxes' or assessments levied against the leased premises as a component part of the railroad property of the Lessor in the state as a whole ; to keep the leased premises free from combustible material; ; to plant no trees or shrubbery , and to erect no structures thereon except such as may be necessary for highway purposes; to out nothing upon the leased premises which might obstruct or interfere with the view; to provide , in locations and in accordance with plans 'approved by the Lessor before the work is commenced, such ditches , culverts , bridges and other structures as may be necessary properly to care for the drainage from said premises and the adjoining right of way of the Lessor; and to hold the Lessor harmless from any and all damages to any of such structures on said leased premises arising from fire caused directly or in- directly by sparks or fire emitted from the engines or trains of the Lessor; and further to hold the Lessor harmless from any damages to the highway upon the leased premises which may result from the construction or maintenance of drainage ditches or waterways by the Lessor. The Lessee shall, in the construction, maintenance and improvements of the highway on the leased premises, take every precaution to prevent damage to, or the impairment of the stability of, the poles in any pole line of the Lessor or of its tenants; and the Lessee shall , at its ou.n expense, resent or relocate, at the under the direction of the Lessor, any pole or poles that are, or are likely to be, damaged or weakened because of the construction of said highway or the maintenance or improvement of the same , or shall reimburse the Lessor for the cost of resetting or relocating any such pole or poles if the Lesser elects to do the work itself. 3. The Lessor reserves the right to take possession of all or any lortion of the Leased premises whenever the use thereof may, become necessary of expedient , in the' judgment of the Lessor, for railroad purposes , including the location of public or private warehouses, elevators, or other structures with the design to facilitate and promote traffic , or for, or in connection with, drilling for or mining of oil, gas , coal and other minerals of whatsoever nature underlying the leased premises by the Lessor or by others with its permission; PROVIDED, however, that in the event the Lessor elects to take possession of all or any portion of the leased premises in accordance with this reservation, it shall first serve upon the Lessee ninety ( 90 days' written notice of such election. 4. The Lessor reserves the rightte cross the leased premises with such railroad tracks as may be required for its convenience or purposes in such manner as not unreasonably to interfere with their use as a public highway. In the event the Lessor shall place tracks upon the leased premises in accordance with this reservation, it shall , upon completion of such tracks , restore the -highway across the same to its former state of usefulness. 5. The Lessee shall not use the leased premises or permit them to be used except for the usual and ordinary purposes of a street or highway , and it is expressly understood and agr eed that such purposes shall not be deemed to include the use by the Lessee , or by others, of the leased premises for railroad, street or interurban railway or other rail transportation purposes or for the construction or maintenance of electric power transmission lines, gas, oil or gasoline pipe lines. 384= 6. This lease is subject to all outstanding superior rights ( including those in favor of telegraph and telephone companies , and leases to abutting property owners and others) and the right of renewals and extensions of the same; and it is understood that nothing in this lease contained shall be construed as a covenant to put the Lessee into possession or to protect the Lessee in the peaceable possession of said premises. 7. No special assessments for establishing or improving the highway located upon the leased premises are to be made against the adjacent railroad right of way of the Lessor, and the Lessee agrees to protect the Lessor against and save it harmless from such special assessments. 8. For the purpose of protecting the reversionary interests of the Lessor against the assertion of adverse rights , the Lessee agrees to prevent encroachments upon the leased • premises , and to this end will, at tits own expense, take all necessary action, including as far as practicable the building of its ditches on and the borrowing of earth from the outer margin of said leased premises. • 9. If the Lessee should breach or fail to keep any of the covenants or conditions hereof, or fail to perform such covenants or conditions, or to remedy the same for thirty ( 30) days after written notice of such failure or breach on the part of the Lessee , given by the Lessor to the Lessee, then this lease shall be null and void. 10. Non-user by the Lessee of the Leased premises for highway purposes continuing at any time during the term hereof for a period of eighteen ( 18) months shall , at the option of the Lessor, work a termination of this lease and of all rights of the Lessee hereunder, and non-user by the Lessee of a portion of said leased premises continuing for a like period shall, at the option of the Lessor, work a termination of all rights and interests of the Lessee with respect to such portion. 11. AGREEMENT This agreement made and entered into this 5th day of January, A.D. 1932, by and between the City of Greeley, Colorado , party of the first part, hereinafter described as first part , and the County of Weld of the State of Colorado , party of the second part, hereinafter described as second party, WITNESSETH that: WHEREAS second party desires to have a four-inch water main service line laid, commencing at 11th Avenue and Island Grove Park in the City of Greeley, thence in a westerly direction across Island Grove Park to the West seide of the County Hospital , a distance of approximately 2177 feet , and WHEREAS second party is desirous of having a four-inch water main laid from the main drinking fountain at the West side of the Grand Stand in Island Grove Park in the City of Greeley to the horse barns used for Fair purposes in said Island Grove Park, a distance of approximately 300 feet , and • WH aEAS second party desires to have a four-inch water main laid, commencing at 14th Avenue and Second Street in the City of Greeley, thence in a westerly direction along Second Street , a distance' of approximately 500 feet , for the purpose of fire protection to the shops of second party, and to have fire hydrants installed at the termini of all of said Ines, and WHEREAS first party is willing to lay said mains and install said hydrants NOW THEREFORE for and in consideration of the premises and of the agreements hereinafter set forth to be mutually kept and performed, IT IS AGREED as follows , to-wit: 1. First party shall lay said water mains and install said hydrants and supervise the laying of same and furnish the labor and Material therefor. 2. First party shall do , or cause to be done , all of the work and labor connected with the laying of said water mains and will keep an accurate account of the work done and the expense thereof and of all expense for material , aipe , fittings, hydrants , equipment and accessories in connection with or used in said work. 3. First party agrees that it will eomply and use in said construction, laying and installation of said lines as much common labor as is practicable and so far as is praeticable will obtain such labor through the agency of the Associated Relief and will pay such employees and laborers at such rates only as in necessary thr ugh arrangements with the Associated Relief. 4. It is mutually agreed that if it is not possible or practicable to obtain skilled labor through the Associated Relief for the purposes where skilled labor is required, first party sill obtain only such labor as is necessary therefor at the lowest possible figure. 5. Second party agrees to and will pay to first party,dneluding engineering expense , but not including supervision, one half of the total expense incurred by first party for labor, pipes, fittings , hydrants and supplies, promptly upon the submission of second party of its bill and accounts therfor. It is the intentio n of both parties hereto to furnish as much employment and relief for unemployed labor as is practicable as well as to obtain a necessary improvement at the lowest cost thereof.
