HomeMy WebLinkAbout770981.tiff RESOLUTION RE : AMENDMENT TO PRELIMINARY PLAN - GEISERT INDUSTRIAL SUB- DIVISION REGARDING UTILITIES. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, are vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution, the Board of County Commissioners of Weld County, Colorado on the 22nd day of September, 1976 , did approve the Preliminary Subdivision Plan for Geisert Industrial Subdivision, and WHEREAS, the existing regulations now require underground electrical utilities to be constructed in industrial subdivisions , and WHEREAS, the Board of County Commissioners of Weld County, Colorado find that to require underground electrical utilities would cause an undue hardship on the developer and that Section 8-16 of the Weld County Subdivision Regulations allows the County Commissioners of Weld County, Colorado to approve over- head electrical utilities to be constructed in connection with the Geisert Industrial Subdivision. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Preliminary Subdivision Plan for Geisert Industrial Subdivision, be and hereby is amended to allow overhead electrical utilities rather than underground electrical utilities all in conformance with Section 8-16 of the Weld County Subdivision Regulations. The above and foregoing Resolution was , on motion duly made and seconded, adopted on the 16th day of March, A.D. , 1977, by the following vote. The above and foregoing Resolution was read into the record and signed on the 21Qr day of March, A.D. , 1977. County A orney A .BEFORE THE WELD COUNTY PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMI ` SIONERS Moved by Ben Nix that the following resolution be intro- duced for passage by the Weld County Planning Commission : Be it therefore Resolved iy the Weld County Planning Commission that the following be adopted by the Board of County Commissioners : The Geisert Industrial Park, Richard Geisert, P. O. Box 2165, Greeley, Colorado on a parcel of land described as Pt. of SE4 of NEI of Section 5, T5N, R65W of the 6th P.M. , Weld County, Colorado To be recommended favorably to the Board of County Commissioners for the following .reasons : 1 ) It was felt that the existing regulations which now require underground utilities need to be studied with a view to pos- sible amendments to the requirement of underground utilities in Industrial Subdivisions. 2) It was felt by the Planning Commission that energy saving could be xealized by utilizing overhead as opposed to underground electricu service. 3) It was determined by the Planning Commission that the applicant Motion seconded by Marge Yost Vote : For Passage Abstain Against Ben Nix Bette Kountz Irma White Chuck Carlson Marge Yost Percy Hiatt Ili', Chairman declared the motion passed and ordered that- a certified copy of this Resolution be forwarded with the file of this case to the Board of County Commi sioners for further proceedings . Geisert Industrial Park Resolution March 15, 1977 Page 2 had demonstrated that an extreme difficulty existed as defined by Section 8-16 of the Weld County Subdivision Regulations. It was further determined that the enforcement of the above referenced requirement would be impracticable in the area in question because of the difficulty of installing and maintaining underground electrical lines in areas where a high water table exists. This meeting shall be in regards to the Geisert Industrial Subdivision, more specifically, in regards to overhead electricity. We feel that overhead electricity is compatible with the surrounding area and should be most appropriate. The Home Light and Power Company has said that they feel that the cost of putting in underground in the capacity to serve any industrial user could very well be prohibitive.
