December 22, 2016;

The Notice below concerns a proposed annexation to the Town of Milliken and it is imperative
that the Notice is published on the four dates set forth above.

NOTICE OF A PUBLIC HEARING CONCERNING THE ELIGIBILITY OF CERTAIN
PROPERTY FOR ANNEXATION KNOWN AS THE VERHEY ANNEXATION
NOTICE IS HEREBY GIVEN, pursuant to C.R.S. § 31-12-108(2), that the Board of Trustees of
the Town of Milliken will hold a public hearing on Wednesday, February 8, 2017 at 6:30PM
to consider whether the property generally known as the Verhey Annexation, and more
particularly described in Resolution No. 16-23 dated December 14, 2016 (the "Substantial
Compliance Resolution"), which property consists of approximately 1.48 acres (the "Subject
Property"), meets the applicable requirements of Section 30 of Article II of the Colorado
Constitution and C.R.S. § 31-12-104 and C.R.S. § 31-12-105, and is eligible for annexation to
the Town of Milliken. Copies of the Petition for Annexation concerning the Subject Property
and the corresponding annexation map are on file at the Town of Milliken Town Clerk's office,
1101 Broad Street, Milliken, CO 80543.
In accordance with Section 16-13-30(5) of the Municipal Code, NOTICE is further given that the
Town's Planning Commission ("Commission") will conduct a public hearing on Wednesday,
February 1, 2017 at 7:00PM regarding the proposed annexation of the Subject Property and the
establishment of initial zoning for the Subject Property, and following the conclusion of said
hearing will make a formal recommendation to the Town Board.
All interested persons will be given an opportunity to be heard. The hearings will be held in the
Town of Milliken Meeting House located at 1201 Broad Street, Milliken, CO 80543 at the above
dates and times. Further information concerning this matter may be obtained by calling the
Town of Milliken at 970-660-5049. A copy of the Substantial Compliance Resolution is
published in full below in accordance with C.R.S. § 31-12-108(2). The public is advised that
notwithstanding the language set forth in Section 5 of the Substantial Compliance Resolution
noting a Commission public hearing date of January 18, 2017, the Commission public hearing
has been rescheduled for the February 1, 2017 date as set forth above.

A RESOLUTION OF THE BOARD OF TRUSTEES OF THE TOWN OF
MILLIKEN ACCEPTING AN ANNEXATION PETITION, MAKING
CERTAIN FINDINGS OF FACT, FINDING SUBSTANTIAL
COMPLIANCE FOR SUCH PETITION, AND SETTING A PUBLIC
HEARING FOR PROPERTY KNOWN AS THE VERHEY ANNEXATION
WHEREAS, the Board of Trustees of the Town of Milliken, Colorado has received and
examined the filings and the Petition for Annexation requesting the annexation of certain real
estate more fully described in said petition and in Exhibit 1 ("Verhey Annexation"), which
exhibit is attached to this Resolution and is incorporated herein by reference (collectively, the
"Property"); and
WHEREAS, said Petition for Annexation has been filed of record with the Town Clerk of
the Town of Milliken, State of Colorado, and
WHEREAS, the Board of Trustees finds as follows:
1. That the Petition contains the following:
(a) An allegation that the requirements of C.R.S. §§ 31-12-104 and 31-12-105
exist or are met.
(b) An allegation that the signers of the petition comprise more than fifty
percent (50%) of the landowners of the area proposed to be annexed and
own more than fifty percent (50%) of the area proposed to be annexed,
exclusive of public streets and alleys and any land owned by the Town of
Milliken.
(c) A request that the Town of Milliken approve the annexation of the
Property.
(d) The signature of the landowners that executed the petition.
(e) The mailing address of the landowners that executed the petition.
(1) The legal description of the Property and a legal description of the specific
real property owned by each landowner that executed the petition.
(g) The date that each landowner executed the petition.
(h) The affidavit of the petition circulators; stating that the signature of the
landowners therein is the signature of each person whose name it purports
to be.
2. That four (4) copies of the annexation map corresponding to the Property have
been submitted to the Town with the Petition, and that the annexation map
contains the following information:
(a) A written legal description of the boundaries of the Property proposed to
be annexed.
(b) A map showing the boundary of the Property proposed to be annexed.
(c) Within the map, the boundaries and the plat numbers of plots or of lots
and blocks.
(d) Next to the boundary of the Property proposed to be annexed is drawn the
contiguous boundary of the Town of Milliken.
3. That no signature on the Petition is dated more than one hundred eighty (180)
days prior to the date of filing of the Petition for Annexation with
the Town Clerk
of the Town of Milliken, State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees stees of the Town of
Milliken, Colorado as follows:
Section 1. That the foregoing recitals and findings are incorporated herein as findings
and conclusions of the Board of Trustees.
Section Z. That the Petition for Annexation to the Town of Milliken of the Property
commonly referred to as the "Verhey Annexation", substantially complies with the requirements
of C.R.S. § 31-12-107(1).
Section 3. No election is required under C.R.S. § 31-12-107(2).
Section 4. No additional terms and conditions are to be imposed except as provided
in the Petition for Annexation and in any annexation agreements which may be entered into by
and between the Town of Milliken and each petitioner or landowner, which are not to be
considered additional terms and conditions within the meaning of §31-12-112, C.R.S.
Section 5. That the Milliken Planning Commission shall conduct a public hearing g on
January 18, 2017 at 7:00 p.m. at the Town of Milliken Meeting House located at 1201 B Street, road
treet, Milliken for the purpose of considering the proposed annexation and R-2 zoning
of the Property.

RE: ANNEXATION OF LAND COMMONLY KNOWN AS THE VERHEY
PROPERTY
THE UNDERSIGNED PETITIONER, in accordance with Title 31, Article 12, Part
Colorado 1, of the
Revised Statutes, as amended (commonly known as the Municipal Annexation Act

)� petitions the Town of Milliken, a municipal corporation of the State of Colorado,

for annexation of the unincorporated areas more particularly described in this Petition. . In support
of this Petition, the undersigned Petitioner alleges and states the following:

1. That it is desirable and necessary that the property more particularly described in Exhibit
A, bit
attached hereto and incorporated herein by reference, be annexed to the Town of
Milliken.
2. That the area sought to be annexed to the Town of Milliken meets all the requirements eq ements of
Sections 31-12-104 and 31-12-105, CRISP, as amended, of the Muni ciP al Annexation Act
of 1965, in that:
(a) Not less than one -sixth (1/6th) of the perimeter of the area proposed to be annexed
is contiguous with the Town of Milliken.
(b) A community of interest exists between the area proposed to be annexed and the
Town of Milliken.
(c) The area proposed to be annexed is urban or will be urbanized in the near future.
(d) The area proposed to be annexed is integrated with, or is capable of being
integrated with the Town of Milliken.
(e) No land within the area proposed to be annexed and which is held in identical
ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, meets either of the following:

(1) Such separate tract or parcel is being divided by the requested annexation
without the writtcn consent of the landowner or landowners thereof, unless
such tracts or parcels are separated by a dedicated street, road or other public
way, and to the extent a tract or parcel is so divided, this petition is intended
to evidence such consent; or

(2) If such a separate tract or parcel comprises twenty (20) acres or more and
which, together with the buildings and improvements situated thereon, such
tract or parcel has an assessed value in excess of Two Hundred Thousand
Dollars ($200,000.00) for ad valorem tax purposes for the year next
preceding the annexation, is included within the area proposed to be annexed
without the written consent of the landowner or landowners thereof.
The annexation of the area proposed to be annexed will not result in the
detachment of area from any school district and the attachment of such area to
another school district.
No annexation proceedings have been commenced for the annexation to another
municipality of any part or all of the area proposed to be annexed to the Town
hereunder nor is any part of said area presently a part of any incorporated city,
town or city and county.
The requirements of Sections 31-12-104 and 31-12-105, C.R.S., as amended, exist
or have been met.
The annexation of the area proposed to be annexed will not have the effect of
extending the boundary of the Town of Milliken more than three miles in any
direction from any point of the Town's boundary in any one year.
(j) In establishing the boundaries of the area proposed to be annexed, where a portion
of a platted street or alley is annexed, the entire width of said street or alley is
included with the area annexed.

Reasonable access shall not be denied to landowners, owners of easements, or the
owners of franchises adjoining a platted street or alley to be annexed by the Town
but is not bounded on both sides by the Town.
(1) The area proposed to be annexed comprises less than ten (10) acres and,
therefore, the Town's preparation of an Impact Report as provided for in Section
31-12-108.5, C.R.S., as amended, is not required.
3. That accompanying this Petition are four (4) copies of an annexation map containing the
following information:
(a) a written legal description of the boundaries of the area proposed to be annexed;
(b) a map showing the boundary of the area proposed to be annexed;
(c) with the annexation boundary map there is shown the location of each ownership
tract in unplatted land, and if part or all of the area is platted, then the boundaries
and the plat numbers of plots or of lots and blocks are shown; and
(d) next to the boundary of the area proposed to be annexed is drawn the contiguous

boundary of the Town, and the contiguous boundary of any other municipality
abutting the area proposed to be annexed and the dimensions thereof.
4. That the Petitioner signed this Petition for Annexation not more than one hundred and
eighty (180) days prior to the date of the filing of this Petition for Annexation with the
Town Clerk.
5. That the undersigned Petitioner comprises One Hundred Percent (100%) of the
landowners in the area and owns One Hundred Percent (100%) of the territory included
in the area proposed to be annexed, exclusive of streets and alleys, and of any land owned
by the Town of Milliken.
6. That the undersigned Petitioner owns the real property described in Exhibit A attached
hereto and incorporated herein by this reference
7. That upon the Annexation Ordinance becoming effective, all lands within the area sought
to be annexed shall become subject to all ordinances, resolutions, rules and regulations of
the Town of Milliken, except for general property taxes of the Town of Milliken which
shall become effective on January 1 of the next succeeding year following passage of the
Annexation Ordinance.
8. That this Petition for Annexation includes the signature of the Petitioner proposing the
annexation, the mailing address of the Petitioner, the legal description of the land owned
by Petitioner, the date on which the Petitioner executed this Petition, and the circulator's
affidavit required by Section 31-12-107(1)(c), C.R.S. The legal description of land owned
by the Petitioner is specifically identified in Exhibit A, which is attached hereto and
incorporated herein by reference.
9. The proposed annexation of the Property complies with Section 30(1)(b) of Article II of
the Colorado Constitution.
THEREFORE, THE PETITIONER, as the owner of 100% of the property described in Exhibit
A, respectfully requests that the Town Board of Trustees of the Town of Milliken, Colorado,
approve the annexation of the property described in Exhibit A. To that end, the Petitioner does
hereby consent to the annexation of said area into the Town of Milliken.
