RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-665 -
EXTRACTION OIL AND GAS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 17, 1985, the Board did approve the request of
Basin Exploration, Inc., for a Site Specific Development Plan and Use by Special Review Permit,
USR-665, for oil and gas production facilities in an R-1 (Low Density Residential) Zone District,
on the following described real estate, to -wit:
Lot B of Recorded Exemption, RECX16-0043; being
part of S1/2 NW1/4 of Section 15 Township 5 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Extraction
Oil and Gas, c/o Olsson Associates, 760 Horizon Drive, Suite 102, Grand Junction, Colorado
81506, to partially vacate Use by Special Review Permit, USR-665, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, conditional
upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special Review
Permit, USR-665", conforming to Section 23-2-260.D of the Weld County
Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR-665, be, and hereby is, partially
vacated, with the abovementioned condition, with said plat to be titled and recorded as Partial
Vacation of Use by Special Review Permit, USR-665.

Subject: Partial vacation of USR-665 — Oil and Gas
Date: April 19, 2017
The Department of Planning Services received the attached letter on March 29, 2017 from Tilda
Evans from Olsson Associates c/o Extraction Oil and Gas requesting a partial vacation of USR-
665. If this partial vacation is approved the applicant will need to submit a revised USR map for
USR-665 per Section 23-2-280 of the Weld County Code.
USR16-0009 was conditionally approved by the Board of County Commissioners on June 22,
2016 and one of the conditions is to partially vacate USR-665. The Department of Planning
Services is recommending approval of this partial vacation.

Legal Description:

Lot B of Recorded Exemption RECX16-0043 being part of the S2NW4 of
Section 15, T5N, R65W of the 6th P.M., Weld County. CO
East of and adjacent to Cherry Ave and approximately 300 feet north of
E. 24th Street
USR-665 was approved by the Board of County Commissioners for
`Approval of Use by Special Review for Oil and Gas Production Facilities
in an R-1 (Low Density Residential) Zone District — Basin Exploration. Inc.
(Sandusky Wells) "
May 7, 1986 USR-665 map was recorded
USR-665 covered an 80 acre lot at the time of approval. This 80 acre lot was later divided into
6 Recorded Exemption lots and one metes and bounds lot using RE -304, RE -3655, and
RECX16-0043. Lot B of RECX16-0043 is the location of the new USR for an oil and gas facility
(USR16-0009).

Dear Diana,
Extraction Oil and Gas is requesting of partial vacation of USR-665. USR-665 includes the
south half of the northwest quarter of Section 15, Township 5 North, Range 65 West of the 6th
P.M.. County of Weld, State of Colorado.
The partial vacation will remove Lot B owned by 7N, LLC from USR-665. Before and after partial
vacation vicinity maps are included with this letter of request.
