RE: ACCEPTANCE OF STREETS FROM NORTHMOOR ACRES SUBDIVISION INTO
THE COUNTY ROAD SYSTEM FOR MAINTENANCE AND RELEASE OF DEMAND
NOTE FOR SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, Northmoor Acres Subdivision, 2nd filing, being
more particularly described as follows:
Beginning at the South Quarter corner of Section
24, Township 4 North, Range 68 West of the 6th
Principal Meridian in the County of Weld, State
of Colorado; thence along the South line of said
Section South 89°33'13" West 879.80 feet; thence
North 00°32'47" West 980.00 feet; thence South
89°33'13" West 400.00 feet; thence South 00°32'47"
East 570.00 feet to the Northeast corner of Lot 12,
Block 1 of Northrroor Acres Subdivision; thence
along the North line of said Lot 12 South 89°33'13"
West 79.98 feet to the Easterly line of said Sub-
division; thence along said Easterly line the fol-
lowing courses and distances:
North 00°26'47" West 865.00 feet; thence North
27°11'50" West 837.63 feet; thence West 892.79
feet to the West line of said Section; thence
along said West line North 1964.81 feet to the
North line of the South Half of the Northwest
Quarter of said Section; thence along said North
line North 89°54'13" East 2649.66 feet to the
East line of the West Half of said Section; thence
along said East line South 00°03'08" West 3978.63
feet to the point of beginning. (176.41 Acres)
WHEREAS, deficiencies of certain streets in said Northmoor
Acres Subdivision have been corrected, and
WHEREAS, a representative of the Weld County Department of
Engineering Services has conducted an on site inspection of said
streets in Northmoor Acres Subdivision and recommends to the
Board of County Commissioners of Weld County, Colorado that the
following streets be added to the Weld County Road System for full
maintenance.
Brittlebush Court . 14 of a mile, more or less
Cholla Court . 13 of a mile, more or less
Catclaw Court . 16 of a mile, more or less
Nolina Court . 13 of a mile, more or less
Staghorn Court . 17 of a mile, more or less
Mesquite Court . 12 of a mile, more or less
Octillo Court . 13 of a mile, more or less
Sage Court . 07 of a mile, more or less
Northmoor Drive . 98 of a mile, more or less
TOTAL 2 . 03 miles, more or less

WHEREAS, said addition of streets does not include any
future extension of Catclaw Court and does not include Future
Street.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the abovementioned
streets in Northmoor Acres Subdivision, 2nd filing, be and
hereby are, accepted into the County Road System for maintenance,
said acceptance does not include any future extension of Catclaw
Court and does not include Future Street.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the demand note in the amount of
$58, 369. 50 be, and hereby is, released.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 2nd day of
August, A.D. , 1978.

order of the Board of County Commissioners Weld County, Colorado the sum of
Fifty-eight Thousand Three Hundred" Sixty-ninet.and 50/100 Dollars
( $ 58 ,369 . 5U ) with interest at ten percent (101'" per year from date of
demand until paid.

This note is given for the purpose of securing the ward of County Commissioners,
Weld County, Colorado, against a contingent lia#lil :ty by reason of said Board of
Commissioners, Weld County, Colorado, granting subdivision rights to one or more
of the undersigned within the County of Weld,10plbrado, as outlined in Subdivision
Agreement dated = March 13 ,.,1g: 72 , and guaranteeing installation
of certain improvements in said subdivision by March 13 , 19 74
Amount of note shall be conditioned by damages which the Board of County Commissioners
shall suffer by failure of undersigned to perform under said agreement. Upon final
acceptance of said improvements by the Board of County Commissioners, Weld County,
Colorado, this obligation shall be void; therwise to remain in full force and effect.
The makers, endorsers, sureties, gu` as and assignors of this note severally
waive demand, presentment for paymen NNNprotest and notice of protest and of non-
payment, and agree and consent to an extensions of time of payment, without notice,
by the holder on request of any offr{em.
It is also stipulated that sho this note be collected by an attorney after ma-
turity or in case of de us ,( e her by suit or otherwise) ten percent (10%) ,
additional on amount due s a allowed the holder as attorney fees.
If the improvements as show have not been constructed by the stated
completion time, the Board ; County Commissioners, at its option, may re-negotiate

subject Streets in Northmoor Acres Subdivision Second Filing
The developer requested acceptance of streets in
Northmoor Acres Subdivision Second Filing in a letter
dated November 22, 1976. A letter to the developer
dated December 7, 1976 was sent informing him that
the streets had to lay one (1) year before full
maintenance can be accepted by the County. On July
3, 1977 a follow up letter was sent to the developer
stating the deficiencies that existed in said streets
and was informed to notify this office, in writing,
as soon as said deficiencies have been corrected.
I recieved a letter dated July 17, 1978 requesting
full maintenance by the County and that the
deficiencies had been corrected. An on site inspection
has been made and I would recommend acceptance of
said streets for full maintenance and that the same be
added to the Weld County Road System and demand note
be released. This acceptance does not include any
future extension of Catclaw Court as shown on the
plat and does not include Future Street as shown on
the plat.
The streets to be accepted are as follows:

Dear Bob :
According to Section 1-3-3 of the Weld County Construction
Standards the following list of deficiencies for streets
in Northmoor Acres 2nd Filing must be corrected before
full maintenance of said streets can be accepted by Weld
County .
1 . Shoulders on all streets must be pulled up to
meet the new asphalt paving.
2. On Northmoor Drive in the vicinity of Lots 19
or 20 Block 3 there has been some settling ,
apparently caused by a Utility crossing , which
must be corrected.
Please notify this office , in writing , as soon as said
deficiencies have been corrected, at which time another
inspection will be made and if streets are satisfactory
the Board of County Commissioners will be informed that
the streets are ready for full street maintenance and
the Board of County Commissioners will take the necessary
action .

Dear Mr. Billings:
I obtained a building permit in April, 1976 for the construction of
a home near Johnstown, on the corner of County road 11 and Northmoor,
Drive, facing west toward County road 11. At that time I was given
a flag to be placed where my driveway was going to be formed, to flag
this location for the County Engineer. The flag was placed where my
driveway was expected to exit on County road 11. The flag remained
in place from April 7th 1976 until January-1977 when authority to
move in was granted by the Building Department. No one from the
Highway Department ever contacted me.
On Thursday of last week shortly after I had completed extensive
construction on the driveway I was told by a Mr. Olson of the County
Engineering Department that I could not exit onthe County road. He
admitted that it was an oversight on his part that he had not made
a previous objection. Oversight or not I consider 10 months sufficient
time for him to have notified me of any rule which would prohibit the
exit location.
If there is such a rule I am hereby requesting exemption from that
requirement on the basis of the considerable expense involved and the
fact that my landscaping plan and convenience would be greatly
disturbed. Caused by the fact that Mr. Olson was negligent in his
duties.

Your letter dated November 22 , 1976 will serve as official
notice that streets in -Northmoor Acres Second Filing have
been built to Weld County specifications .
According to Section 1-3-1-1 of the Weld County Construction
Standards streets must lay one year before full maintenance
can be accepted by the County. Inspection will be made in
about nine months and a list of any deficiencies , if any ,
will be sent to you for correction . After these have been
corrected this office will recommend to the Board of County
Commissioners acceptance of said streets for full maintenance
and they will take the necessary action.

Gentlemen,
Please accept this letter as a request for an additional
extension of time on our Subdivision Agreement for
Northmoor Acres, Second Filing, a Subdivision of Weld
County.
Water mains and fireplugs are installed in Second Filing.
Roads and streets are built, including shaping, Base
Course and Finish Course Gravel. Second filing roads
lack only the blacktop mat.
The current state of the money market and the home building
market makes it impossible for us to blacktop this fall.
