HomeMy WebLinkAbout20172942HEARING CERTIFICATION DOCKET NO. 2017-67 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0025, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (COMMERCIAL TRUCK PARKING) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - LESTER AND KIMBERLY HELBURG A public hearing was conducted on September 6, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 14, 2017, and duly published July 19, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Lester and Kimberly Helburg, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0025, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (commercial truck parking) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated the applicant is proposing to park eleven (11) commercial vehicles and to perform minor maintenance on the site. She provided the location in relation to relevant county roads. She indicated staff sent out eleven (11) referrals and received eight (8) responses either indicating no concerns or including suggestions that have been considered by staff. Ms. Aungst clarified the applicant wishes to increase the number of trucks to eleven and the number of drivers to 17. She provided the hours of operation and clarified there are no plans for additional fencing or landscaping. She reviewed the violation, described the adjacent lands and pointed out the closest residence who provided a letter of support stating she does not want screening or fencing blocking views. Ms. Aungst stated the site is not located in the three (3) mile referral area of any mac= (. Lcoa.fmm),PecHe),F-ILCLL), a- ec-rzr) 1O [ 10 tt7 2017-2942 PL2488 HEARING CERTIFICATION - LESTER AND KIMBERLY HELBURG (USR17-0025) PAGE 2 municipality and she displayed images of site and surrounding area and entered the favorable recommendation of the Planning Commission into the record as written. • Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, AP17-00339, stipulating to utilize the existing access points. He provided the average daily traffic counts and truck percentages and stated the traffic narrative indicated 19 daily round trips and the proposed route. Mr. Pinkham stated both tracking control and an Improvements Agreement are required. • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements and stated the site meets Exception 1.A.14, therefore, no drainage report is required. She reviewed the relevant Conditions of Approval and Development Standards. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the North Weld County Water District provides water and the existing septic is sized for three (3) bedrooms; however, the applicant can use a portable toilet for the business. She reported only minor maintenance will be performed and there will be no fuel storage or washing of vehicles on -site. Ms. Light stated DS #13-21 cover items typical to Environmental Health. Lester Helburg, applicant, stated he just wants to park some trucks and make a living. In response to Commissioners Kirkmeyer and Cozad, he stated the access points are existing as part of a prior Recorded Exemption. Mr. Pinkham concurred. • No public testimony was offered concerning this matter. El In response to Commissioner Conway, Mr. Helburg stated there is no landscaping or screening. The Board agreed to delete COA #1.B.5 and correlating DS #8. • In response to Commissioner Moreno, Mr. Helburg stated he needs 17 drivers for 11 trucks to be able to rotate drivers. • In response to Chair Cozad, Mr. Helburg indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Conway moved to approve the request of Lester and Kimberly Helburg, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0025, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (commercial truck parking) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously.
