RESOLUTION RE: APPROVAL OF LOT SIZE VARIANCE NO. 52 - SAM RADULOVICH. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 23rd day of November, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land is owned by Sam Radulovich, which land is more particularly described as follows , to-wit: The North 990.00 feet of the Northwest One-Quarter Section 21, 'Ibwnship 1 North, Range 67 West of the 6th Principal Meridian, Weld County, Colorado. Contains 60 acres more or less WHEREAS, the owners of said tract of land desires to obtain a variance from the minimum lot size requirement so that Sam Radulovich may make application to the Board of County Commissioners to apply for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A.. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be and hereby is, granted to Sam Radulovich for the above described parcel of land. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the new access to Lot A must be a minimum of 200 feet from the intersection of County Road 8 and. The parcel of land is described as Pt . of the NW* of Section 21 , T1N, R67W of the 6th P.M. , Weld County, Colorado. Said property is located 2l miles south and 2 miles east of Dacono. The subject property contains 60 acres more or less of Class II and IV irrigated soils. The request is to split the property into parcels of 4 acres and 56 acres. The 56 acre parcel con- tains an existing set of residential improvements as well as several out buildings associated with the quarter horse operation carried out on the 56 acre parcel . The 4 acre parcel is proposed to be a new residential home site for Mr. Radulovich' s son, Michael , who is a partner in the quarter horse breeding and training operation located on the 56 acre parcel . Based upon the information submitted and the adopted policies in the County, the Planning Commissiorir commends the request be approved for the following reasons : 1. The Town of Dacono has indicated they have no objections to the approval of the recorded exemption. 2. The proposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regula- tions) , the intent clause of the Agricultural District (Section 3. 3a of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since theuse would be compatible with the surrounding agricultural uses. 3 .
