RE: APPROVAL OF RECORDED EXEMPTION NO. 336 - MRS. MARY GLENDENNING
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 11th day of September, 1978 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 336 , being the property
of Mrs. Mary Glendenning, described as part of the East Half of
the Southwest Quarter of the Southwest Quarter and Southeast
Quarter of the Southwest Quarter of Section 3 , Township 5 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more.
particularly described as follows :
All that part of the East Half of the Southwest
Quarter of the Southwest Quarter and the South-
east Quarter of the Southwest Quarter of Ser.-
tion 3, in Township 5 North, of Range 65 West
of the 6th P.M., lying South of the County Road
as the sane is now constructed, excluding,
however, therefran, the right-of-way for the
ditch known as the Ogilvy Ditch over and across,
said land, subject to a right-of-way running
Northerly and Southerly through the Southeast
Quarter of the Southwest Quarter of said
Section for a drain ditch and proper banks for
the sane as the sane is now constructed; also
granting to parties of the Second Part, a right-
of-way for a ditch and proper banks for sane,
on or near the West line of the Fast half of the
Northwest Quarter of the Southwest Quarter ficuu

WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mrs. Mary Glendenning, be and hereby is ,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10)
(d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 11th day of
September, A.D. , 1978.

Dear Commissioners:
The attached application, plat and related items are in reference
to a request by Mrs. Mary Glendenning for a recorded exemption.
The parcel of land in question is described as Pt . EzSW*SW; and
SE*SW* Section 3 , T5N, R65W of the 6th P.M. , Weld County, Colorado.
This property is located approximately 1 mile east of Greeley on
the south side of Colorado Highway 263 . The property contains
58 acres of Industrial Zoned property. The request is to split
the property into parcels of 0.971 acres and 57. 029 acres.
Mrs. Glendenning desires to convey the 0. 971 acre parcel to her
son so that he may operate a drapery business on the property.
Each parcel has an existing set of improvements located on it .
Based upon the information submitted and the adopted policies in
the County , the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1 . The proposed split conforms with the recorded exemption
intent clause and the Weld County Comprehensive Plan. Each
resulting parcel does have an existing set of improvements .
The use would be compatible with surrounding land uses.
2. The Greeley Planning Commission has set forth no objections
to this request .
3. The request complies with the provisions of Section 9-4 A.
of the Weld County Subdivision Regulations.

Confirming personal conversation had with you, I
am writing this letter to you on behalf of my above
mentioned client, Mary E. Glendenning, 1760 East 8th
Street, Greeley, CO 80631, seeking a recorded
exemption for a parcel of land consisting of
approximately one acre including a dwelling house,
garage and shed. Subject property designated as
Lot A is requested to be severed from a larger parcel
of land containing 58 acres, more or less.
As explained to you personally and in the presence
of Mrs. Glendenning, it is her desire to sell this
small parcel of land to her son so that he may operate
a drapery business thereon.
I trust that this request for a recorded exemption
covering the small parcel of land containing approximately
one acre will receive your favorable consideration.

On August 22 , 1978 the Greeley Planning Commission reviewed and made
the following recommendations :
1 ) Recorded Exemption (Scott)- The Commission recommended no objection.
Staff noted:
1) That access would be restricted to 59th Avenue,
2) Development of the site should be to City of Greeley Zoning
Code standards ,
3) Highway Department requested an additional dedication to
achieve 75 foot half street right of way;
2) Recorded Exemption (Glendenning)- The Commision recommended no
objection.
