RE: GRANT IN PART, DENY IN PART APPEAL OF DECISION BY THE FAIR BOARD -
BRAD AND LORI ANDERSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an appeal from Brad and Lori Anderson,
concerning the decision by the Fair Board to ban their child from participating in the 2017 Weld
County Fair as a result of confusion concerning this year's 4H record book, and
WHEREAS, a hearing before the Board was held on the 23rd day of January, 2017, at
which time the Board deemed it advisable to continue said matter to February 22, 2017, to allow
Brad and Lori Anderson and the Fair Board adequate time to meet and discuss the consequences
and the language of "may" versus "shall", and
WHEREAS, on February 22, 2017, the Board heard testimony from Fair Board
representatives and Brad Anderson and, following discussion, deemed it advisable to impose the
following penalty: Caitlyn Anderson will be allowed to show all species of animals at the 2017
Weld County Fair and she must donate 25 percent (25%) of any sales, with a cap of $100.00 on
the sale of any animal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, granted in part, denied in
part.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of February, A.D., 2017.

I have been provided with the attached copy of your Appeal of the decision by the Fair Board to ban your daughter,
Caitlyp from participating in the 2017 Weld County Fair as a result of the confusion concerning this year's 4H record
book. Pursuant to Section 2-4-10 of the Weld County Code (provided below), and by copy on this message, I am also
requesting staff provide a written copy of the Fair Board's decision from their December meeting so that the entire
matter can be presented to the Board of Commissioners at a public meeting scheduled for January 23, 2016, at 9:00-
a.m., to be held at the Weld County Administration Building, 1150 0 Street, Greeley, CO (as confirmed by
telephone). Please confirm that you have received this message, acknowledge whether that date/time will work for
you, and let me know if I can be of any further assistance.
Sec. 2-4-10. - Appeals process.
The Board of County Commissioners shall act as a board of appeals to hear .camp aints_onac:ions taken_ County
boards, commissions and departments. Except for decisions made by the Board of Adjustment and Uniform Building Code
Board of Appeals, procedure for appeals shall be as set forth in this Chapter, by resolution of the Board, or as otherwise
provided by law.
A. Any person appealing an action by a County board, commission or department to the Board of County
Commissioners shall file such a complaint, in writing, with the Clerk to the Board within sixty (60) days of the
incident in question.
B. Such complaint shall include:
1. The name of the employee, board, commission or department against which the complaint is made.
2. A description of the basic facts involved in the complaint.
C. The Clerk to the Board shall schedule a hearing with the Board of County Commissioners, to be held within fifteen
(15) days of the filing of the complaint, and shall notify all parties involved in the incident.
D. The Board of County Commissioners shall hear all the available facts pertinent to the incident, may schedule a
second hearing within thirty (30) days following the initial hearing if the Board determines such a need, and shall
render a determination within thirty (30) days of the final hearing.
E. No person shall be denied the right to appeal, provided that he or she complies with the administrative procedures
established by the Board. (Weld County Codification Ordinance 2000-1)

Caitlyn Anderson has been a member of 4-H and participant at the Weld County
Fair since 2011. She has had livestock in the sale: 2011- lamb; 2012 - lamb; 2013
— goat; 2014 - goat; 2015 — beef and 2016 - lamb.
Weld County Fair Board rule review and change procedures
All areas of the Junior Livestock Show including rules for the fair are reviewed
annually by the Junior Livestock and Animal Health committee. The committee
thoroughly discusses changes, votes on the changes and makes their
recommendations to the Fair Board. The Fair Board discusses the committee
recommendations for changes to the department including rule changes. The Fair
Board then either adopts the recommended changes or chooses not to. Examples
of recommendations made to the fair board by the committee that were adopted
are: adding a Dairy Steer Show to the Market Beef Department; changing the
wording (for clarity) in the fair book under rule IV to read (changes are in red):
IV. FITTING OF ANIMAL: All Junior exhibitors in whose name the entered animal is owned, and entry accepted
and acknowledged, are responsible for the custody, care and feeding of their animal(s). Junior exhibitors are
expected to have prepared their own project animal for exhibition. While on the Weld County Fairgrounds all
livestock must be fitted by junior Weld County 4-H or FFA exhibitors. Exhibitors may receive assistance from
immediate family members only or other Weld County 4-H or FFA members.

Royalty Report: Madison LaBorde, Attendant, reported about royalty attending the National Western Stock
Show, Miss Rodeo Colorado clinic held at Island Grove, the Philharmonic Leather and Lace concert and
helping out the Farm Show.
Special Guest: Frank Haug, county attorney
Unfinished business:
Stitchery Class: Bridget Holcomb asked for clarification that the stitchery class would be in the open class.
Debbie Carpio made the motion to add the stitchery class to the fair. Robbie Adams seconded.
The motion passed.
Shining Star: Valerie Day made the motion that Kelsie Winslow be chosen as the Shining Star for the fair
book. Debbie Carpio seconded. The motion passed.
Dedication: Tracy Axton made the motion that Walt Sidwell be chosen for the fair book dedication. Keith Day
seconded. The motion passed. Walt served on the fair board and was strong supporter of the fair.
Friends of the Fair: Jane Miller made the motion that American Ag Credit be chosen to represent Friends of
the Fair. They have sponsored the Showmanship Class for the last 6 years. Bridget Holcomb seconded. The
motion passed.
Anderson Family Issue
Commissioner Julie Cozad spoke to the fair board about what occurred at the January 23, 2017 Board of
County Commissioners meeting. There were board and extension office members present at the meeting.
The commissioners agreed there had to be some type of consequence so the issue was remanded back to the
fair board. Commissioner Cozad excused herself while the fair board discussed the issue.
Caitlyn Anderson was given the opportunity to once again address the fair board. Several board members
addressed Caitlyn with questions.
Larry Wagner made the motion that Caitlyn Anderson show all animals and if any placed 1st or 2" they could
not be in the Championship Drive. If the animals would sell, then 10% would be given to the 4-H Foundation.
Gus Sidwell seconded. Motion failed via vote.
Keith Day made the motion that Caitlyn's would participate in the Championship Drive but could not be
champion. If chosen as Champion or Reserve the animal would go on the buy back. Valerie Day seconded the
motion. The motion failed via vote.
Gus Sidwell made the motion to allow Caitlyn Anderson to show in all species, complete a record book, she
cannot sell sheep and cannot participate in the Championship Drive. If any of her other animal species
should sell, she will donated 25% to the 4-H Foundation. Andrew Raff seconded the motion. The motion
passed by a 15-3 vote.
New Business

Coordinator's Report
New board members need to get name badges.
Farm Show booth was shared with 4-H. Tracy Axton, Keith Day, Valerie Day, Pat Day, Debbie Carpio, Kim
Tregoning, Larry Hooker, Kim Sterkel , Jenn Eastwood, Madison LaBorde, Lindsey Leafgren, and
Commissioner Julie Cozad all assisted in manning the booth.
100th anniversary committee met and are brainstorming ideas for next year's fair.
Tracy Axton reminded everyone that whatever decision(s) is made at the fair board meetings will be
addressed with the people involved. The board president will contact the people involved about the decision
that has been made.

Dear County Commissioners,
On behalf of our daughter Caitlyn Anderson we would like to appeal the decision of the Weld
County Fair board at their December meeting.
Our daughter submitted a 4H record book for the wrong species and was banned from
exhibition in the 2017 Weld County Fair. This was her first year as a senior (She was 14 years old as of
January 1, 2016) and was given the responsibility of completing her record book independently. She
shows multiple species of livestock and was overwhelmed by recording them on the same book so she
decided to complete a record book for each species. She mistakenly submitted her steer book but sold
her lamb at the county fair.
Her record book was submitted by the deadline and was scored above the 90 percentile, but as I
mentioned before, was the wrong species. By the time the mistake was discovered, it was too late to be
corrected.
Our daughter is an upstanding member of 4H. She spends more than 20 hours a week in the
barn caring for her livestock. She has invested her premium winnings over the last 5 years back into her
projects, breeding and buying her own ewes and purchasing her first show steer and breeding heifer,
building her herd to include a heifer and steer for this year. She helps other 4H members with their
projects, including showing other members showmanship techniques and volunteering at showmanship
clinics assisting the younger 4H members. She has foregone other activities and time with friends
afterschool due to her responsibilities caring for her livestock at home. She works extremely hard and
sacrifices much in her attempt to be successful in the show ring.
4H is a youth organization based on learning and engaging youth to reach their fullest potential
and whose slogan is "learn by doing". Through this oversight, our daughter learned the importance of
being detail oriented. She stood before the fair board, a group of adults she has only made the
acquaintance of a handful of times and apologized for making a mistake. A mistake she took ownership
of and offered to make amends for. She answered their questions to the best of her knowledge and
respectfully accepted their decision although it broke her heart.
The fact of the matter is it was a mistake, a child's mistake. A mistake she learned a great life
lesson from and one she is unlikely to repeat.
As a family we love the Weld County Fair. We see such a great value in it for the youth of Weld
County that we have invested in the youth livestock sale ourselves to help promote 4H and motivate
youth in the county to participate at the fair and I have proven that value to the company I work for
(Mountain States Lamb) so that they sponsor several 4H events in the county and also participate in the
livestock sale. Both my wife and I grew up showing in 4H and FFA. It is part of the foundation and
building blocks of what we have become today. We consider this a family affair and we have extended
our family with all the other families that we show and interact with at the Weld County Fair.
Please consider allowing Caitlyn to participate in the 2017 Weld County Fair. She has put in
hours of work already in preparation of the fair and is devastated by the decision of the Fair Board. 4H
is very important to our family and we would appreciate the opportunity to continue to participate as a
family.

Dear Caitlyn,
As an exhibitor of livestock/horse at the 2016 Weld County Fair you are required to turn in a completed 4-H Livestock/Horse
record book to be eligible to exhibit livestock or horse at the 2017 Weld County Fair. As on 09/30/2016 we did not receive a
record book from you.
According to the 2016 Weld County Fair book, page 155, letter H:
All 4-H members who exhibited livestock/horse must turn in to the Extension office at least one completed livestock record
book by the published deadline to be eligible to exhibit livestock/horse at next year's fair. Your record book may be
submitted in person or you can mail it in. If you choose to mail it in the record book must be postmarked by the published
deadline or it will not be accepted.
1. If the member sold an animal in the Junior Livestock Sale, a completed record book must be submitted for the
species the exhibitor sold.
2. Completed record books must be submitted no later than the Friday after Labor Day by 5:00, to the Weld County
Extension Office, of the year shown.
3. Record books must score a minimum of 70% of the total points possible to be considered complete.
It was also stated on page 155, letter I, #4:
Late record books — after the published deadline of the Friday after Labor Day.
Any 4-H Livestock/Horse exhibitor or FFA Livestock/Horse exhibitor who does not submit a completed
Livestock/Horse 4-H record book or FFA record book form by the published deadline will be removed from any record book
awards and will activate the following process:
You can submit your late Livestock/Horse 4-H record book or FFA record book form (the Friday after Labor Day until September
30th) with $100.00 fee per exhibitor, maximum of $500.00 per family, and attend the next scheduled Fair Board meeting to give
an explanation to the Fair Board for your late Livestock/Horse 4-H record book or FFA record book form. These record books
will not be judged with the other record books or be considered for any of the record book awards. These late Livestock/Horse
4-H record books will be judged separately to make certain they received a score of at least 70%, if they did not then member
will have to attend the 4-H record book training class. The final deadline for late submission of 4-H record books or FFA record
book forms is September 30th of the current year. Absolutely no Livestock/Horse 4-H record books or FFA record book forms
will be accepted after that date. There will be no meeting with the Fair Board after that date.
The 4-H or FFA member who does not meet the requirement of a Livestock/Horse 4-H record book or FFA record book form
submitted will no longer be considered in good standing with the Weld County Fair. Said member may not exhibit
Livestock/Horse at the following year's Weld County Fair.
While you did not submit a completed 4-H Livestock/Horse record book for your beef project you did not submit a completed 4-
H Livestock/Horse record book in the species you sold (lamb), therefore you are now ineligible to exhibit livestock/horse at the
2017 Weld County Fair, Southeast Weld County Fair, and Northeast Weld County Fair. Please understand that ineligibility at
these fairs does not prevent you from being a member in 4-H and participating at the Colorado State Fair, National Western
Stock Show, AKSARBAN provided that you meet their entry requirements.
If this is your only project and you would like to be considered a member in good standing, according to 4-H rules, you will need
to turn in a completed 4-H record book to your 4-H organizational leader. At that time, they will review your book and notify
our office that you have completed the record book requirement to be considered a member in good standing. We encourage
you to continue your 4-H/FFA experience with a non -livestock project.

Board president Eli Hatch was to call Ms. Anderson on December 6, 2016 and report the boards'
decision.

Sec. 2-4-10. - Appeals process.
The Board of County Commissioners shall act as a board of appeals to hear .complaints on actions taken by County
boards, commissions and departments. Except for decisions made by the Board of Adjustment and Uniform Building Code
Board of Appeals, procedure for appeals shall be as set forth in this Chapter, by resolution of the Board, or as otherwise
provided by law.
A. Any person appealing an action by a County board, commission or department to the Board of County
Commissioners shall file such a complaint, in writing, with the Clerk to the Board within sixty (60) days of the
incident in question.
B. Such complaint shall include:
1. The name of the employee, board, commission or department against which the complaint is made.
2. A description of the basic facts involved in the complaint.
C. The Clerk to the Board shall schedule a hearing with the Board of County Commissioners, to be held within fifteen
(15) days of the filing of the complaint, and shall notify all parties involved in the incident.
D. The Board of County Commissioners shall hear all the available facts pertinent to the incident, may schedule a
second hearing within thirty (30) days following the initial hearing if the Board determines such a need, and shall
render a determination within thirty (30) days of the final hearing.
E. No person shall be denied the right to appeal, provided that he or she complies with the administrative procedures
established by the Board. (Weld County Codification Ordinance 2000-1)
