WHEREAS, the Board of County Commissioners of Weld County,

missioners of Weld County, Colorado that the abovedescribed par-
cels be, and hereby are, declared to be exempt from the definitions
of "subdivision" and "subdivided land" as set forth in Section
30-28-101 (10) , CRS 1973 , as amended, and Section 2-1 of the
Weld County Subdivision Regulations.

BE IT FURTHER RESOLVED by the Board that the abovedescribed
parcels of land shall be considered to be single lots.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 22nd day of

Applicant: Vernon and Katie Powell
The owners of the following described property have requested an
exemption from Section 2-1 of the Weld County Subdivision Regu-
lations adopted August 30, 1972, which defines the term subdivi-
sion:

COMMENTS:
Mr. and Mrs. Powell purchased their property in two separate parcels
at separate times prior to August 30, 1972. In the fall of 1976, quit
claim deeds were exchanged among the various property owners in the
immediate vicinity for the purpose of establishing accurate and agreed
upon perimeter boundaries of the various tracts. There was no intention
upon the part of the Powells to combine their land into a single parcel ,
but merely an interest in establishing friendly boundary lines with
their neighbors. This subdivision exemption will clarify for the record
that the Powells do have two separate parcels.

Dear Mr. Cunliff:
I am enclosing a copy of the survey map prepared by Drexel , Barrel (
& Company which is entitled "Craig Farm - North". Katie Lee Powell
asked that I forward the map to you pursuant to discussions which
you and she have had.
I understand there is some question as to whether Mr. and Mrs. Powell
(and Mr. and Mrs. Flynn on the adjacent property) have two parcels or
one parcel . As your records indicate, Mr. and Mrs. Powell (and Mr. and
Mrs. Flynn) purchased their property in two separate parcels at separate
times. In the fall of 1976, quit claim deeds were exchanged among the
various property owners in the immediate vicinity for the purpose of
establishing accurate and agreed upon perimeter boundaries of the various
tracts. There was no intention upon the part of the Powells (or the
Flynns) to combine their land into a single parcel , but merely an interest
in establishing friendly boundary lines with their neighbors.
It is my understanding that Mr. and Mrs. Powell will be having a hearing
beforethe Weld County Commissioners requesting a subdivision exemption so
that their land can be considered two separate parcels and sold as such.
If you anticipate that there will be any problem in their obtaining that
result, I would appreciate your advising me in advance so that I could
furnish additional information from my files.
