Home My WebLink About20170885.tiffRESOLUTION RE: APPROVE RESCINDING DOCUMENT #2015-1032, DATED APRIL 15, 2015, AND #2015-1666, DATED JUNE 8, 2015, CONCERNING SMALL TRACT OIL AND GAS LEASE AND LEGAL DESCRIPTION CORRECTION TO SAID LEASE - BAYSWATER EXPLORATION AND PRODUCTION, LLC, AND BAYSWATER BLENHEIM HOLDINGS II, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 15, 2015, by Resolution #2015-1032, the Board approved Small Tract Oil and Gas Lease with Bayswater Exploration and Production, LLC, and Blenheim Holdings, II, LLC, for the amount of one thousand nine hundred eighty and 00/100 Dollars ($1,980.00) and WHEREAS, on June 8, 2015, by Resolution #2015-1666, the Board approved Correction to Oil and Gas Lease Legal Description, and WHEREAS, it was later determined that this was a duplicate lease for 1.65 mineral acres already included and held by Land Energy, Inc., pursuant to a lease approved on February 18, 2015, located in Section 25, Township 6 North, Range 66 West of the 6th P.M., Weld County, Colorado, and recorded at Reception No. 4085078, and WHEREAS, after review, the Board deems it advisable to rescind Documents #2015-1032 and #2015-1666, and refund the bonus amount of $1,980.00. It has come to our attention that said acreage was previously leased at reception #1822180 and thus our lease at 4099879 is not a valid lease. Please reimburse Bayswater for the bonus amount of $1,980.00 and we will file a release of lease of record to clear any clouds on title.
