Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Stephanie Frederick Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Janet Lundquist Planning Services Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: I hereby certify that pursuant to a notice dated February 2, 2017, and duly published February 8, 2017, in the Greeley Tribune, a public hearing was conducted March 8, 2017, to consider the request of 4 S's Holdings, LLC, do Trent Timm, for a Change of Zone, COZ16-0005, from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District, at which time the Board of County Commissioners deemed it appropriate to continue the matter to March 15, 2017, at 10:00 a.m., to allow the applicant adequate time to complete the official boundary survey Bob Choate, Assistant County Attorney, made this a matter of record. Chair Cozad reviewed, for the public, the procedures to follow should the case result in a tie vote due to four Commissioners being present and one Commissioner excused. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated the site is located in the Town of Galeton, off of County Road 74. He described the proposed use of the building to be an RV and trailer maintenance and repair facility. He stated the applicant is requesting a Change of Zone to C-3 (Business Commercial). (Clerk's Note: Commissioner Conway arrived at 10:04 a.m.) Mr. Gathman explained the applicant has applied for a Site Plan Review, the site's water is being served by North Weld Water District, and ten (10) referrals were sent out with five (5) responses received. He addressed the issue of the nonconforming structure, and displayed photos of the site and of the surrounding area and entered the favorable recommendation of the Planning Commission into the record as written. She stated the applicant will utilize the existing access point (AP16-00595) off of Pacific Avenue, which is designated as a local roadway and adjacent to CR 74, which is designated as an arterial roadway. She explained there will not be requirements for traffic control, nor an improvements agreement. • Hayley Balzano, Planning Services Engineer representative, reported the Change of Zone on the site will not affect the drainage and grading requirements. • Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions. He stated the North Weld County Water District provides the water and the Galeton Sanitation District provides sewer. He referenced a couple notes which will be reflected on the plat that pertain to sewage disposal, water service, and the Right -to -Farm. ki Trent Timm, applicant, stated his intent is to operate a business in the existing building and he doesn't have a desire to change it. El Stewart Gebauer, resident of Eaton, explained he purchased the building so his son could start a business and he wanted to commend Mr. Gathman for providing a smooth application process. • In response to Chair Cozad, Mr. Trimm indicated he has reviewed, and agrees to abide by, the Conditions of Approval, as amended. • Mr. Gathman stated the existing building on the site has been designated as a Nonconforming Structure and suggested adding Condition of Approval #1.D.3 to read as follows: "The existing 4,800 -square foot -building on the site has been designated as a Nonconforming Structure, under case No. NCU17-0003. This building is subject to the requirements of Chapter 23, Article VII, of the Weld County Code." In response to Chair Cozad, Mr. Gathman clarified the reason for Condition #1.B is to address any questions for future Building Permit applications. He stated this will eliminate the property line which was created in the 1960's. He clarified they would need to submit a Quit Claim Deed or Warranty Deed. • Commissioner Conway moved to approve the request of 4 S's Holdings, LLC, c/o Trent Timm, for a Change of Zone, COZ16-0005, from the A (Agricultural) Zone District to the C-3 (Business Commercial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as amended and entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. 2017-0587 PL2461 HEARING CERTIFICATION - 4 S'S HOLDINGS, LLC, C/O TRENT TIMM (COZ16-0005) PAGE 3 Commissioner Conway expressed his appreciation of Mr. Trimm's contributions to the County. This Certification was approved on the 20th day of March, 2017.
