Cozad, Chair - EXCUSED Commissioner Steve Moreno, Pro -Tern - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer, Acting Chair Pro -Tern Also present: Acting Clerk to the Board, Stephanie Frederick Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Planning Services Engineer representative, Hayley Balzano Public Works representative, Evan Pinkham Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated April 28, 2017, and duly published May 3, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Hill Industries, LLC, requesting a Change of Zone, COZ17-0004, from the 1-3 (Industrial) Zone District to the C-3 (Business Commercial) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Acting Chair Pro -Tern Kirkmeyer reviewed the procedures to follow should the case result in a tie vote due to three Commissioners being present and Commissioners Cozad and Moreno being excused. Chris Gathman, Department of Planning Services, presented a summary of the proposal and explained the property is adjacent to a filing station owned by the applicant, Hill Petroleum, and used as a retail and wholesale sales of fuel to the public and to the agricultural community. He reported this site is adjacent to property that Hill Petroleum also owns and is zoned as C-3 (Business Commercial). The applicants are requesting the Change of Zone to provide consistent zoning on the entire parcel. Mr. Gathman stated the site is located within the Urban Growth Boundary of the City of Greeley, he displayed slides of the property and entered the favorable recommendation of the Planning Commission into the record as written. El Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements. He stated the property accesses onto State Highway 263, also known as 8th Street. He stated this access is in the jurisdiction of the Colorado Department cc PLCcc,/ mm), PEcHB),(-ILcuu), C. Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. The City of Greeley provides water and sewer to the site. • Bryant Gimlin, applicant, reported that both the City of Greeley and North Weld County Water District provide water and sewer to the site, because it was requested by the Fire Department, due to the natural of the fuel storage business. He explained they would like to make a cohesive parcel, since the property shares a common ingress and egress. Mark Taylor, representative of the applicant, stated he has a concern with having the City of Greeley supply water and sewer to the parcel because it could trigger a forced annexation. No public testimony was offered concerning this matter. In response to Commissioner Conway, Mr. Gimlin stated it would address his concerns if North Weld County Water District and the City of Greeley was reinserted. Commissioner Conway stated that Condition of Approval (COA) #1.C.4 should be modified to insert "or North Weld County Water District." Commissioner Kirkmeyer stated that COA #1.C.5 should state, "is obtained from the City of Greeley." In response to Acting Chair Pro -Tern Kirkmeyer, Mr. Gimlin and Mr. Taylor indicated they reviewed, and agree to abide by, the Conditions of Approval, as amended. • Commissioner Freeman moved to approve the request of Hill Industries, LLC, for Change of Zone, COZ17-0004, from the 1-3 (Industrial) Zone District to the C-3 (Business Commercial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as entered the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
