WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado. and WHEREAS, on October 1. 2008. the Weld County Board of Commissioners approved Use by Special Review Permit #1662, for Western Equipment and Truck, Inc., 2055 1st Avenue, Greeley, Colorado 80631. c/o Noble Energy. Inc., 1625 Broadway. Suite 2000. Denver. Colorado 80004, for a Mineral Resource Development Facility, including an Oil and Gas Support and Service (storage of pipe (tubulars) and production equipment) in the A (Agricultural) Zone District on the following described real estate, to -wit: Lot C of Amended Recorded Exemption #4066; being part of the SE1/4 /4 of Section 31, Township 4 North, Range 66 West of 6th P.M., Weld County, Colorado, and WHEREAS, on November 23. 2009. the Board of County Commissioner of Weld County. Colorado. approved an Improvements Agreement According to Policy Regarding Collateral for Improvements for Use by Special Review Permit. USR-1662, between the County of Weld. State of Colorado, by and through the Board of County Commissioners of Weld County, and Noble Energy. Inc.. with terms and conditions being as stated in said agreement. and accepted check #2009114041 from Noble Energy, Inc.. P.O. Box 909, Ardmore, Oklahoma 73402, in the amount of 34.940.00, and WHEREAS, not only have staff from the Weld County Departments of Public Works and Planning Services conducted a visual inspection and found improvements completed, but let it also be noted that the portion of County Road 38 where the facility has an access has been annexed by the Town of Platteville; therefore, staff recommends cancellation and release of said collateral. and WHEREAS, upon recommendation of staff, the Board deems it advisable to cancel and release said collateral. Weld County Public Works Department and Weld County Department of Planning performed a site inspection, at the above mentioned site, and observed the following: • All Public Works related items on Exhibit A, of the Improvements Agreement According To Policy Regarding Collateral For Improvements Document #2009-3069, have been completed and are found to be acceptable. • The facility accesses on to CR 38, which has been annexed by the town of Platteville. (Rec. #3682544) • This request for full release is due to the annexation of CR 38, and the successful completion of required off -site improvements. • There is no collateral being held for on -site improvements for the facility. Monies were received from Noble Energy Inc., 110 West Broadway, Ardmore, OK 73402. The Noble Energy facility is located adjacent to County Road 38. The Town of Platteville annexed this segment of road via the Western Equipment & Truck Annexation on March 23, 2010, Reception number 3682544. Representatives from the Department of Planning Services visited the site on Tuesday March 14, 2017 and found the property to be in compliance with the USR-1662 map associated with the permit. As there was no collateral held for the on -site improvements associated with this facility, this office supports the request for release of all monies.
