Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Ben Frissell The following business was transacted: El I hereby certify that pursuant to a notice dated January 20, 2017, and duly published January 25, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Cannon Land Company, c/o Crestone Peak Resources, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0044, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (office trailer for field personnel) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Chair Cozad reviewed, for the public, the procedures to follow should this case result in a tie vote due to four Commissioners being present and one Commissioner excused. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and reviewed the site location in reference to relevant County Roads. She stated 15 referrals were sent out with 12 agencies either not responding or responding with no concerns. Ms. Aungst stated the site is located within the three (3) mile referral area of the City of Fort Lupton and the C.C.: PLCOCA.,!(WY)) HI.0O3, CT& ZT(s�J 2017-0369 PL2456 3/I1 HEARING CERTIFICATION - CANNON LAND COMPANY C/O CRESTONE PEAK RESOURCES (USR16-0044) PAGE 2 Fort Lupton Intergovernmental Agreement Area and she reviewed the City of Fort Lupton's referral response comments. She described the hours of operation, number of employees, lighting, adjacent land uses, closest residence and USRs within one (1) mile and she stated no additional landscaping is proposed. Ms. Aungst displayed images of the site and surrounding property and entered the favorable recommendation of the Planning Commission into the record as written. • Evan Pinkham, Public Works Department representative, provided a brief overview of the transportation plans and requirements, stating an Access Permit was approved, AP#16-00270, stipulating to utilize the existing accesses. He reviewed the average daily traffic counts and stated the traffic narrative indicated four (4) daily round trips; consequently, there is not a requirement for either tracking control or an Improvements Agreement. • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements, explained an exception, and reviewed the relevant Conditions of Approval and Development Standards. El Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions, stating bottled water and portable toilets are acceptable and Development Standards (DS) #11-17 address typical Environmental Health items. In response to Commissioner Cozad, Mr. Frissell confirmed there is no septic on -site and that, per the Weld County Code, portable toilets are acceptable for this application. • Chris McRickard, applicant, reviewed the proposal for a manufactured structure as an office trailer for field personnel to stop over and do paperwork. He described the site choice due to the proximity to three (3) pumper routes and that there would be no employees on -site for long periods of time. Mr. McRickard described the office as a skid mounted trailer and said it would be stocked with bottled water and have a portable toilet outside. He conveyed the site will be fenced and it will allow the employees to be more efficient. In response to Commissioner Conway, Mr. McRickard explained the surrounding vegetation as open range and not really considered landscaping. • No public testimony was offered concerning this matter. • In response to Chair Cozad, Mr. McRickard indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, and stated no concerns. el In response to Commissioner Conway, Ms. Aungst explained Condition of Approval, (COA) #1.A.5, regarding landscaping, as it is a 320 -acre parcel and as a part of USR maps, the applicant must show existing landscaping or trees. Commissioner Freeman asked whether landscaping was pertinent because the site is leased. Chair Cozad confirmed it is the general policy with USR maps to show landscaping and the USR covers the entire parcel. Commissioner Conway asked for clarification on COA #1.A.7 regarding signage. After further discussion, the Board opted to delete COA #1.A.5 and amend COA #1.A.7 to add, "if applicable." 2017-0369 PL2456 HEARING CERTIFICATION - CANNON LAND COMPANY C/O CRESTONE PEAK RESOURCES (USR16-0044) PAGE 3 El Commissioner Conway requested clarification regarding the hours of operation. Commissioner Freeman suggested deleting Development Standard (DS) #4 and the Board agreed. Commissioner Conway asked the applicant if they would prefer the flexibility to have a few more employees. After discussion with staff and the applicant, the Board agreed to amend DS #3 to reflect ten (10) employees. In response to Chair Cozad, Mr. McRickard indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Cannon Land Company c/o Crestone Peak Resources, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0044, for a Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (office trailer for field personnel) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 27th day of February, 2017.
