WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of the grant of the Special Use Permit for a hog operation on the above-described real estate, and WHEREAS, Section 3. 3.E. 4.d. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District on the grant of a Special Use Permit by the Board of County Com- missioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado, heard all the testimony and statements of those present, PL0580 780231 has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed and satisfied that the request for a Special Use Permit for a hog operation on the hereinabove described real estate, complies with all of the conditions as set out in Section 3. 3.E. 4 .d. of the Weld County Zoning Resolution; NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application of the petitioner for a Special Use Permit for a hog operation on the hereinabove described tract of land, be, and hereby is, granted subject to the Development Standards contained in the Special Use Permit. RESOLUTION November 15, 1977 compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with the future development in the area and will not adversely affect the health, safety, and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. The hog operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing the potential adverse impacts. B. The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural. C. The Weld County Extension Agent has indicated the facilities will provide adequate space for proposed number of animals. He did not observe any problems with the proposed operation. D. He stated that water consumed by each animal would be z to 1z gallons per hundred weight which would be approximately 19, 290 gallons per day. A 60, 000 gallon jcistern will be used as the water storage facility and flushing will be re-cycled. Twenty-seven sq. feet will be allowed for each sow, 7 sq. feet for feeders and 10 sq. feet for finishing. He is also proposing to use a sealed lagoon. Ken McWilliams then read the staff recommendation and Development Standards. Mr. Schawo said he agreed to and understood the Development Standards. 1 MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners. � Motion by Percy Hiatt, seconded by Harry Ashley. A chemical blending plant basically is a re-blender in that they buy finished products, take the materials and formulate them into a particular application, and sell that material . He then went into a great amount of detail explaining- the procedure of the plant and its operation. Frank Suckla then stated that he was concerned about the drainage into the ditch. Ken McWilliams then read the staff recommendation and Development Standards . Mr. Jones said he understood and agreed with the Development Standards. Mr . Kiefer asked what type of off-site waste disposal was proposed and was told that the off-site disposal proposed was the Lowry Bombing Range. Mr. Hiatt asked whether there were any area lighting proposed. Mr. Jones said that the insurance company requires there be adequate light around the shop and plan area. A letter of opposition was 1 read by Ken McWilliams from Clifford Haller, surrounding property i owner, regarding the dust problem. Mr. Hiatt asked what the I anticipated traffic would be on County Road 11 . The applicant responded by saying there would be three trucks in use regularly, A 11 employees, and bulk deliveries once a week. Lupton ' s proposed industrial i zoning is adjacent to the U. P . Railroad tracks. Mr. Pfeifer has met with the Ft. Lupton Planning Commission and was approved. Ken McWilliams then read the staff recommendation for tabling. he also stated that he was contacted by Mr. Simpson of the Division of Water Resources regarding the well permit and indicated the well would probably be approved, but could not verify it in writing as it was a matter of going through the proper procedures to get approval . Mr. Suckla then stated that A the area does not look very desirable at this time. Feels box cars, etc. should be removed from the property which would greatly improve the area. _ Discussion then followed regarding the water i supply and the concern for getting approval on the well before making a recommendation to the Board of County Commissioners. The Weld County Planning Commission con- vened to consider your application, however, since no one was present to represent yourself , the Planning Commission tabled the application until the November 15 meeting and requested that I contact you to indicate the questions or problems that were raised in the discussion yesterday after- noon and also, to contact you to request someone be present at the November 15 Planning Commission meeting. The meeting on November 15 will again take place in the County Commissioners ' Hearing Room, First Floor, Weld County Centennial Center , 915 - 10th Street, Greeley, Colorado. And again, the meeting is scheduled for 1 : 30 p.m. In the discussion among the Planning Commission members yesterday afternoon on your application, there were several questions raised for which there were no answers available. Briefly, the questions raised pertained to the fol- lowing items : 1. Members of the Planning Commission questioned whether or not the amount of water available through the well permits will be adequate in quantity for the proposed number of animals you are applying for in your Special Use Permit application. Specifically, they desire to know how many gallons per day of water you expected each animal to consume. 2. Are you proposing to have some sort of water storage facility on the site? 3. How much water do you estimate will be needed for the flushing of the buildings and how often, or what is the frequency of the flushing that r you propose to do within the buildings? N. Additionally, the Planning Commission desires someone to be at the meeting on November 15 to answer these and any other questions which might arise with the application. The soil where you intend to place the hog operation is known as Vona loamy sand on 5 to 9% slope. You should only encounter slight problems with this soil in building. The only problem with this soil is constructing a sewage lagoon. You would have severe seepage. This could be corrected by using material for back plating from the intermittent lake that is next to this soil. There will be no problem of pollutants leaving the area.
