Water Division 1, Water District 1 Dear Ms. Aungst: We have reviewed the above referenced proposal for a Site Specific Development Plan and Use by Special Review Permit. The submitted material does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The application seeks to operate a water trucking business, including commercial truck parking, from a 34.96 -acre parcel. There is an existing single-family residence on the parcel that is supplied by the North Weld County Water District. If required, bottled water and a portable toilet will be provided for employees. The source of water that will be used to fill the water trucks was not identified. We require additional information about the source of water supply for the water hauling business in order to give a favorable comment regarding this proposal. USR17-0025 on June 28, 2017. Mr. Helburg sent me an email yesterday indicating that the source of the hauled water for the proposed business was Great Western produced water. Pursuant to Section 37-90-137(7)(a), C.R.S., a well permit is not required for nontributary ground water removed to facilitate or permit the mining of minerals if the water will only be used by operators within the geologic basin where the ground water is removed to facilitate or permit the mining of minerals, including (but not limited to) for drilling, well stimulation, well maintenance, pressure control, pump operations, dust control, pipeline and equipment testing, equipment washing, or fire suppression purposes. So long as the water used for the water hauling business is withdrawn and used in accordance with Section 37-90-137(7)(a), C.R.S., this office has no objection to the proposal. Sarah Brucker, P.E.
