WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land, being the
property of Mr. Ronald D. Kruger, Windsor, Colorado, and more particularly
described as follows, to-wit:
A tract of land located in the Southwest Quarter of Section 10,
Township 6 North, Range 67 West of the 6th P. M. , of Weld
County, Colorado, being more particularly described as follows:
Considering the west line of the Southwest Quarter of said
Section 10 as bearing North 00° 34' 51" East and with all
bearings contained herein relative thereto:
Commencing at the Southwest corner of said Section 10, the
said corner being the True Point of Beginning; thence, along
the said west line, North 00° 34' 51" East, 340. 08 feet; thence
South 89°57'34" East, 1306. 67 feet to the east line of the
Southwest Quarter of the Southwest Quarter of the said Section
10; thence, along the said east line, South 00°34'54" West,
339. 20 feet to a point on south line of the said Southwest
Quarter; thence, along the said south line, North 89°59'54"
West, 1306. 67 feet to the True Point of Beginning.
The above described tract contains 10. 88 acres, more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, desires to exempt this particular division of land upon the
recommendation of the Weld County Zoning Administrator for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d), 1963, as amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Ronald D. Kruger, Windsor, Colorado, be
exempt from the definition of the terms "subdivision" and "subdivided
lands" as provided for in the new Weld County Subdivision Regulations at
Section 9-4 A (6), adopted August 30, 1972, as amended.
The above and foregoing Re solution was, on motion duly made and
seconded, adopted by the following vote on the 17th day of December, A. D. ,
1975.

Dear Sirs:
Enclosed are materials relating to the request of Ronald D. Kruger for
a Recorded Exemption on his property in part of the SWa of Section 10,
T6N, R67W of the 6th P.M. , Weld County, Colorado. The parcel in question
is 10.188 acres. Mr. Kruger proposes to divide the property into 6.293
acre and 3.895 acre parcels.
The Planning Commission staff recommends approval of this request for the
following reasons:
1 . The proposed lots are not part of a recorded exemption pre-
viously approved.
2. The lots resulting from the proposed land division shall be
accessible from an existing public road with a minimum front-
age in conformance with the Weld County Zoning Resolution.
3. The proposed lots will have access to an adequate water supply.
4. The proposed lots will have access to an adequate means for
the disposal of sewage.
5. The original parcel of land to be divided does not meet the
minimum lot size requirement established by the Weld County
Zoning Resolution. However, as allowed in Section 9-4 A (6)
of the Weld County Subdivision Regulations, the parcel lies
within the comprehensive plan area of an existing incorpor-
ated town of Weld County. The Windsor Planning Commission re-
commends that this Recorded Exemption application be granted.
6. The proposed lots are more than 1 acre in area as required by
Section 9-4 A (7) of the Subdivison Regulations.

7. The proposed land division complies with the Comprehensive Plan
in that the proposed land division is within a town's compre-
hensive plan area and the town recommends approval .
