DCP Operating Company, LP (DCP) is proposing to construct and operate two co -located natural gas discharge pipelines named the Crossroads Discharge North and South 12" Pipelines (also referred to as the "proposed pipelines"). These pipelines would start at the Crossroads Booster Station (LJSRI 7-0023) and would terminate at the Mewbourn 160 Pipeline (USR1 2-0006) in Weld County, Colorado, The development of these pipelines will increase the pipeline transport capacity of natural gas in Weld County, reduce the burden of the vehicular transport on Weld County Roads, and support the safer transport of natural gas within the county. Page 1 of 18 2 USE BY SPECIAL REVIEW APPLICATION QUESTIONNAIRE The following sections list information required for Use by Special Review Permit Applications under Section 23-2-510 of the Weld County Code. 21 PLANNING QUESTIONS 2.1.1 Applicant's Name and Telephone Number DCP Operating Company, LP 3026 4th Avenue Greeley, Co 80631 Attn: David Jost, VP Operations North (970) 378-6345 2.1.2 Explain, in detail, the proposed use of the property. DCP proposes to construct the Crossroads Discharge North and South 12" Pipelines in Section 18 of Township (T) 4 North (N); Range (R) 64 West (W) in Weld County, Colorado. The pipelines are entirely located on one parcel (Attachment B; Parcel #105318300002), which is owned by DCP. The proposed pipelines would each be approximately 0.35 miles in total length, are co - located within one right-of-way (ROW), and would start at the Crossroads Booster Station (USRI7-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006). The pipelines would exit from launchers at the Crossroads Booster Station and head south approximately 0.1 miles where it would turn east and travel 0.25 miles where they terminate at receivers along the Mewbourn 160 Pipeline. The alignments are shown in Attachment D of this application. The pipelines would be constructed within a 100 -foot temporary ROW, once the pipelines have been installed, the temporary ROW will be returned to its pre -construction contours and reclaimed. The permanent maintenance ROW for each pipeline will be 30 -feet; however, this land will be returned to the surrounding land use during the operational period. As the pipelines are located approximately 20 feet apart, the combined permanent maintenance ROW would be 50 feet. Permanent, aboveground equipment will include two launchers at the Crossroads Booster Station and two receivers along the Mewbourn 160 Pipeline. Total land impacts during construction will be approximately 4.1 acres, while the permanent ROW will cover approximately 2.1 acres. Page 2 of 18 2.1.3 Consistency with Weld County Code and Chapter 22 of the Comprehensive Plan The property containing by the proposed pipeline project is within an agricultural zone district. Weld County Code Section 23-2-200 et seq. allows the development of oil and gas support and service facilities within agricultural zones. Additionally, Section 22-5-90 of the Weld County Code Comprehensive Plan specifies that "the most efficient and environmentally friendly way to transport crude oil is by pipeline, rather than by truck." Transportation of oil and natural gas products by pipeline has a lower impact on the local road system and lowers air quality impacts. The Weld County Code also specifies under Section 22-5-100 that !'Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated." Construction and installation of the proposed pipelines would require temporary interruption to land use activities. However, during the operational period, the overlying ROW would be reclaimed. The proposed pipeline project would meet the safety and infrastructure requirements of the Weld County Code Comprehensive Plan and the local oil and natural gas industry while maintaining the long-term productivity of the nearby agricultural operations. 2.1.4 Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The proposed pipeline project is located in unincorporated Weld County and occurs entirely within an agricultural zone district. The surrounding lands are either irrigated lands, pivot fields, or grazing areas. Some homes and estates are in the vicinity of the proposed pipelines. All impacts from the installation of the proposed pipeline project would be temporary and all disturbed areas would be returned to their pre -construction contours and reseeded. The project is consistent and compatible with the surrounding land uses as a use allowed by right under Weld County Code Section 23-3-20. 2.1.5 Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. r The proposed pipeline project is located in unincorporated Weld County and occurs entirely within an agricultural zone district. The surrounding lands are either irrigated lands, pivot fields, or Page 3 of 18 grazing areas. All impacts from the installation of the proposed pipeline project would be temporary and all disturbed areas would be returned to their pre -construction contours and reseeded. The project is consistent and compatible with the surrounding land uses as a use allowed by right under Weld County Code Section 23-3-20. 2.1.6 What are the hours and days of operation? Construction would occur within daytime hours (7:00 AM to 6:00 PM). Once constructed, the pipelines would be in operation 24 hours a day, seven days a week, 365 days a year. During routine maintenance and inspection activities, trucks would travel along the ROW route between 6:00 AM and 5:00 PM, unless they are responding to an emergency. Daily visits to the pipeline ROW are not anticipated. 2.1.7 List the number of full time and/or part time employees proposed to work at this site. The pipelines would be maintained by 10 to 15 existing DCP field personnel and would not require dedicated full time operators. 2.1.8 If shift work is proposed include the number of employees per shift. See response under Section 2.1,6 of this document. 2.1.9 List the number of people who will use this site. Include contractors, truck drivers, customers, volunteers, etc. During construction, up to 50 people could be present onsite for various activities. Construction personnel would include both DCP employees and contractors. Contractors would use existing storage yards as the base of operations. The pipelines would be maintained by 10 to 15 existing DCP personnel. 2.1.10 If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. No animals would be onsite as part of the proposed project, Page 4 of 18 2.1 .11 Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) No lots are proposed as part of the proposed pipeline project. 2.1.12 How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? N o parking lots or structures are proposed as part of the pipeline project. 2 1.13 Explain the existing and proposed landscaping for the site Following construction and installation, the site would be graded and restored to its pre - construction contours. The ROW would be reseeded and reclaimed. Areas reseeded are expected to return to pre -construction conditions within one to two growing seasons. Noxious weeds would be managed in accordance with Chapter 15, Articles I and II of the Weld County Code, during construction and until final reclamation is deemed successful. 2.1.14 Describe the type of fence proposed for the site (e.g. 6 -foot chain link with earth tone slats). N o new fencing is required. 2.1.15 Describe the proposed screening for all parking and outdoor storage areas. If the site is located in a floodplain outdoor storage is restricted. N o permanent onsite parking or storage areas is proposed. 2.1.16 Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Should temporary decommissioning be required on either pipeline, the pipeline pressure would be reduced to a safe level or the pipeline would be cleared using blowdown valves at the launcher or receiver site. Once these procedures are completed, maintenance activities would be conducted on the pipeline. Page 5 of 18 Once the pipelines are operating, there is no intention of removing or terminating use of the pipelines. Should either pipeline require decommissioning, the pipeline would be cleaned, isolated, and abandoned in place per all State of Colorado and local regulations and per the landowner agreement. 2.1.17 Who will provide fire protection to the site? The Platteville Valley Fire Protection District would be dispatched in the case of an emergency along the ROW. The project will not have a water source appropriate for fire suppression; therefore, water or other fire retardants would be transported to the ROW if needed. 2.1.18 List all proposed on -site and off -site improvements associated with the use (e.g. landscaping, fencing, buildings, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Aboveground equipment associated with the proposed pipelines will include two launchers at the Crossroads Booster Station and two receivers at the Mewbourn 160 Pipeline connection. Construction of the facilities would occur concurrently with the pipeline construction and installation period which is expected to commence in November of 2017. 2.2 ENGINEERING QUESTIONS 2.2.1 Describe how many roundtripslday are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and el trip out of site) During construction equipment (graders, disking, etc.), stringing trucks, welding trucks, and one - ton pickup trucks would be required along the ROW for construction, installation, and reclamation activities. These vehicles would only be needed for the brief construction period and are not expected within the ROW once the pipelines become operational. During operation of the pipelines, only occasional traffic from pickup trucks within the ROW for routine maintenance and inspection would be required. Any additional traffic resulting from construction of the pipelines will be minor and temporary. As the project will not contribute to significant alterations in traffic patterns within Weld County, DCP assumes that a traffic study will not be required for this application. Page 6of18 2.2.2 Describe the expected travel routes for site traffic. Access to the site would be from existing private roads. No planned temporary or permanent access roads or easements are planned outside of the construction ROW for the proposed pipelines. As such, no Weld County Access Permits are needed at this time. Once the pipelines are operational, additional traffic will be limited to an occasional vehicle used for regular inspection and maintenance. No long-term alteration of traffic patterns within Weld County is anticipated. 2.2.3 Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) The proposed pipelines would be generally be accessed via the existing private roads along CR 44. 2.2.4 Describe the time of day that you expect the highest traffic volumes from above. The greatest volume of traffic during construction would occur between 8:00 AM and 6:00 PM. 2.2.5 Describe where the access to the site is planned. Refer to Section 2.2.2 for the discussion on site access. 2.2.6 Drainage Design: Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23-12-30 F.1. Based on the criteria set forth in Section 23-12-30.F.1 a.5 of the Weld County code, this pipeline project does not require a detention pond. Details regarding this exception are described in the questionnaire list below: A, Does your site qualify for an exception to stormwater detention? If so, describe in a drainage narrative the following: 1. Which exception is being applied for and include supporting documentation. Page 7 of 18 i. Section 23-12-30.F.1a.5 — This section specifies that "Exceptions to the stormwater detention shall be limited to the following: , , . 5) Pipelines or transmission lines." 2. Where the water originates if it flows onto the property from an offsite source. i. The property containing the pipelines generally has higher elevations along the southern side which decrease toward the north. Stormwater and overland flow would move across the proposed ROW from nearby fields. Overland flow would generally move toward the north. No stream or wetland features occur within the ROW. 3. Where it flows to as it leaves the property. i. As the ROW would be restored to its natural contour and drainage patterns, water would flow across the ROW as it has historically. Surface flow would collect in the local ditch systems along active fields and roadways and eventually flow into the South Platte River System. As the ROW would be revegetated, the project is not anticipated to increase the sediment burden on the local watersheds. 4. The direction of flow across the property. i. The direction of flow during the operational period of the pipelines would identical to its pre -construction flow. 5. If there have been previous drainage problems with the property. i. The property has no known drainage issues. 2.3 ENVIRONMENTAL HEALTH QUESTIONS 2.3.1 What is the drinking water source on the property? No drinking water source is required. During construction, bottled water will be provided to construction personnel, 2.3.2 If utilizing a drinking water well include either the well permit or well permit application that was submitted to the State -Division of Water Resources. If utilizing a public water tap Page 8 of 18 include a letter from the Water District, a tap or meter number, or a copy of the water bill. N o drinking water well is required. No public water tap will be utilized for this project. Water used for hydrostatic testing would come from a municipal source and be disposed of in compliance with a Colorado Discharge Permit System. 2.3.3 What type of sewage disposal system is on the property? If utilizing an existing septic system provide the septic permit number, If there is no septic permit due to the age of the existing septic system, apply for a septic permit through the Department of Public Health (COPHE) and Environment prior to submitting this application. If a new septic system will be installed please state '`a new septic system is proposed." Only propose portable toilets if the use is consistent with the Department of Public Health and Environment's portable toilet policy. N o existing or proposed sewage disposal system would be used. Portable toilets would be used for construction personnel, but would be removed for the operational life of the pipelines. 2.3.4 If storage or warehousing is proposed, what type of items will be stored? N o long-term storage would be proposed onsite. 2.3.5 Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on this site. During construction, all liquid and solid waste will be stored and removed for disposal according to applicable regulations. Temporary sewage disposal units (i.e., portable toilets) will be placed in areas of active construction, and will be maintained regularly to prevent water or soil contamination. Any leaks from equipment or vehicles will be cleaned up in accordance with all applicable regulations and disposed of at appropriate disposal facilities. No wastes will be stored or stockpiled during operation of the pipelines. Page 9 of 18 2.3.6 If there will be fuel storage on site indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. No fuel storage would occur onsite. 2.3.7 If there will be washing of vehicles or equipment on site indicate how the wash water will be contained. No vehicles would be washed onsite. 2.3.8 If there will be floor drains indicate how the fluids will be contained. No floor drains would be required as part of the proposed project. 2.3.9 Indicate if there will be any air emissions. (e.g. painting, oil storage, etc.) Short-term air emission would result from the operation of project vehicles and machinery during the construction period. Water would be utilized for dust suppression as needed. As the project would result in less than 25 acres of temporary disturbance, no Air Pollution Emission Notice (ADEN) with the CDPHE would be required for fugitive dust. 2.3.10 Provide a design and operations plan if applicable. (e.g. composting, landfills, etc.). Refer to Attachment D of this permit application for vicinity maps. 2.3.11 Provide a nuisance management plan if applicable. (e.g. dairies, feedlots, etc.) Not applicable. 2.3.12 Additional information may be requested depending on type of land use requested. Additional information can be provided upon request. Page 10 of 18 2.4 BUILDING QUESTIONS 2.4.1 List the type, size (square footage), and number of existing and proposed structures. Show and label all existing and proposed structures on the USR drawing, Label the use of the building and the square footage. The proposed pipelines would connect to infrastructure at the proposed Crossroads Booster Station and the existing Mewbourn 160 Pipeline, The proposed launcher and receivers would not be located within any buildings, No other structures would be required. 2 4.2 Explain how the existing structures will be used for this LJ R? No existing structures would be utilized by the proposed pipeline. 2, 4.3 List the proposed use(s) of each structure. No existing structures would be utilized by the proposed pipeline. Page 11 of 18 3 USE BY SPECIAL REVIEW PERMIT REQUIREMENTS FOR PIPELINES SEC. 23-2-510 Chapter 23 of the Weld County code requires a Use by Special Review Permit to construct a natural gas pipeline that is greater than 12 inches in diameter and is designed to operate at a hoop stress of 20 percent, or higher, of its Specified Minimum Yield Strength. The following information is requested in Section 23-2-510 of the Weld County Code. 3.1 APPLICANT'S NAME AND TELEPHONE NUMBER DCP Operating Company, LP 3026 4' Avenue Greeley, CO 80631 Attn: David Jost, VP Operations North (970) 378-6345 3.2 SOURCE, CAPACITY, DESTINATION AND TYPE OF FACILITIES, SUPPORT STRUCTURES INVOLVED DCP is proposing to construct and operate two co -located natural gas discharge pipelines named the Crossroads Discharge North and South 12'" Pipelines (also referred to as the "proposed pipelines"). These pipelines would start at the Crossroads Booster Station (USR17-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006) in Weld County, Colorado. The development of these pipelines will increase the pipeline transport capacity of natural gas in Weld County, reduce the burden of the vehicular transport on Weld County Roads, and support the safer transport of natural gas within the county. 3.3 DETAILED REPORT 3.3.1 Description of the Pipeline DCP proposes to construct the Crossroads Discharge North and South 12" Pipelines in Section 18 of Township (T) 4 North (N); Range (R) 64 West (VV) in Weld County, Colorado. The pipelines are entirely located on one parcel (Attachment B; Parcel #105318300002), which is owned by DCP. The proposed pipelines would each be approximately 0.35 miles in total length, are co - Page 12 of 16 located within one right-of-way (ROW), and would start at the Crossroads Booster Station (USRI7-0023) and would terminate at the Mewbourn 160 Pipeline (USR12-0006). The pipelines would exit from launchers at the Crossroads Booster Station and head south approximately 0.1 miles where it would turn east and travel 0.25 miles where they terminate at receivers along the Mewbourn 160 Pipeline. The alignments are shown in Attachment D of this application. The pipelines would be constructed within a 100 -foot temporary ROW. Once the pipelines have been installed, the temporary ROW will be returned to its pre -construction contours and reclaimed. The permanent maintenance ROW for each pipeline will be 30 -feet; however, this land will be returned to the surrounding land use during the operational period. As the pipelines are located approximately 20 feet apart, the combined permanent maintenance ROW would be 50 feet, Permanent, aboveground equipment will include two launchers at the Crossroads Booster Station and two receivers along the Mewbourn 160 Pipeline. Total land impacts during construction will be approximately 4.2 acres, while the permanent ROW will cover approximately 2.1 acres. 3.3.2 Description of the Preferred Route The preferred route is described in detail in Section 3.3.1 of this permit application. This route was selected as the preferred project route as it balances environmental sensitivity, operational efficiency, cost minimization, and adjacent landowner considerations. As such, DCP has proposed this alignment as the preferred route as it helps meet the operational needs of the project while minimizing impacts to the surrounding community and environment. In the early planning stages, DCP considered alternative route options through the property; however, the DCP generally decided to site the pipelines as close to the southern edge of the property as possible in order to make inspection access easier and to reduce the potential for interruption to agricultural activities in the nearby field and other resources. 3.3.3 Procedures to Mitigate Adverse Impacts The pipelines will be installed underground with the exception of the launchers and receivers. No landscaping is proposed. Upon completion of construction activities, the ROW will either be seeded with native grasses. If noxious weeds are identified on the ROW during construction or Page 13 of 18 reclamation periods, they will be managed in compliance with Chapter 15, Articles I and II of the Weld County Code. DCP will implement the following procedures to minimize adverse effects during construction and operation of the pipeline: • Best Management Practices will be installed to prevent erosion or sediment runoff; • Topsoil will be segregated from subsoil during grading activities. Once the pipelines are installed in the trench, subsoil will be backfilled into the trench. The segregated topsoil will be placed atop the subsoil, and the ROW will be graded to preconstruction contours; a DCP will apply for a CDPHE Construction Stormwater Permit. The permit requires the development of a SWMP. DCP has developed the SWMP which will provide mitigation measures to be followed during construction and operation of the pipeline; and • The ROW will be stabilized as quickly as possible following final grading. 3.3.4 Construction Schedule Typical pipeline construction methods will be implemented. These include: • Survey — The alignment and workspace limits will be identified prior to construction activities; • Clearing and Grading — The temporary construction ROW will be cleared of trees and obstructions, and graded to a relatively flat surface to accommodate construction equipment; • Trenching — The pipeline trenches will be excavated to provide a depth of cover required by the USDOT, Weld County or DCP Standards. Roads and waterbodies will bored using standards construction techniques; • Pipe Stringing and Laying — Pipe segments will be strung along the ROW parallel to the trench, and will be bent (where required), welded, and lowered -in to the trench; • Backfilling and Grading — Once the pipelines are installed in the trenches, subsoil will be replaced into the trench. Topsoil that was segregated during grading operations will be placed over the subsoil. The ROW will be re -graded to its preconstruction contour and seeded to encourage revegetation; • Hydrostatic Testing — The pipelines will undergo hydrostatic testing to ensure their integrity. Page 14 of 18 Construction on the Crossroads Discharge North and South 12" Pipelines is planned to start in November 2017 and end in February 2018. 3.3.5 Information on Public Outreach and Land Ownership No public meetings have been held regarding this project. See Attachment F for the affidavits of interested landowners. 3.3.6 Description of the Hazards Transporting oil and natural gas by pipeline is generally safer, lowers the burden on local collector roads, and lowers air quality emissions. There is some small risk the integrity of a pipeline may be compromised from accidents or geologic hazards which could result in a release of gas. In addition to DC P's monitoring and valve cutoff systems described in the section below, DCP will clearly mark the centerline of the proposed pipelines with markers placed at line of site intervals, and at road and railroad crossings. The markers will clearly indicate the presence of a gas pipelines, and will provide a telephone number and address where a company representative can be reached in an emergency or prior to any excavation in the area of the pipelines. In addition, DCP participates in the "One Call" system. "One call" systems serve as the clearinghouse for excavation activities that are planned close to pipelines and other underground utilities. DCP employs highly trained operators and contractors and maintains close working relationships with all emergency response personnel. DCP also participates in a continuing education program to enable customers, the public, government officials, and those engaged in excavation activities to recognize a gas pipeline emergency and report it to the appropriate authority. 3.3.7 Emergency Procedures DCP maintains a monitoring system that includes a gas control center that tracks pressures, flows, and deliveries on its entire system. The gas control center is staffed 24 hours a day, 7 days a week, 365 days a year. DCP also has area offices near the pipelines with personnel who can provide the appropriate response to emergency situations and direct safety operations as necessary. DCP's pipeline systems are equipped with remotely controlled valves that can be Page 15 of 18 operated from the gas control center. In the event of an emergency, the valves allow for a section of the pipeline to be isolated from the rest of the system. Data acquisition systems are also present at all of DCP's meter stations. If system pressures fall outside of a predetermined range, an alarm is activated, and notice is transmitted to the gas control center. Routine aerial and ground inspections are conducted by DCP personnel or contractors. These inspections allow DCP to identify soil erosion that may expose the pipelines; dead vegetation that may indicate a leak in a line; unauthorized encroachment on the ROW by a third party; or other conditions that may lead to a safety hazard and/or require preventative maintenance or repairs. See Attachment E for emergency contact information. 3.3.8 Procedures to Minimize Impacts on Irrigated Agricultural Land The pipeline ROW will be located in an agricultural zone district. During pipeline design and route selection, DDP made efforts to avoid actively cultivated agricultural fields to reduce impact to productive areas. The lands adjacent to the ROW are also zoned as agricultural. The ROW route is as direct as possible limiting the total acreage of land affected during construction. The effect on land that is disturbed during construction will be temporary in nature since the permanent ROW will be allowed to revert to its pre -construction state. In areas where active cultivation could not be avoided, impacts will be minimized by implementing the following: • Topsoil will be segregated and preserved during grading operations, and returned as surface layer soil once the pipelines are installed; The pipelines will be installed in an area that will avoid affecting the operation of irrigation equipment; and Following construction of the project, the ROW will be seeded and reclaimed. Upon successful completion of construction, disturbed areas will be seeded with native grasses to encourage vegetation growth and soil stabilization. Page 16 of 18 3.3.9 Conformance with the Guidelines of Chapter 22 The properties intersected by the proposed pipelines are within an agricultural zone district. Weld County Code Section 23-2-200 et seq allows the development of oil and gas support and service facilities within agricultural zones. Additionally, Section 22-5-90 of the Weld County Code Comprehensive Plan specifies that "the most efficient and environmentally friendly way to transport crude oil is by pipeline, rather than by truck." Transportation of oil and natural gas products by pipeline has a lower impact on the local road system and lowers air quality impacts. The Weld County Code also specifies under Section 22-5-100 that "Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated". Construction and installation of the proposed pipelines may require temporary interruption to agricultural activities. However, during the operational period, the overlying ROW would be reclaimed. The proposed pipelines would meet the safety and infrastructure requirements of the Weld County Code Comprehensive Plan and local oil and natural gas industry while maintaining the long-term productivity of the nearby agricultural operations. 3.3.10 Decommissioning Plan Should temporary decommissioning be required, the pipeline pressure would be reduced to a safe level or the pipeline(s) would be cleared using blowdown valves at the launcher or receiver site. Once these procedures are completed, maintenance activities would be conducted on the pipeline(s). Once the pipelines are operating, there is no intention of removing or terminating use of either pipeline. Should either of the pipelines require decommissioning, it would be cleaned, isolated, and abandoned in place per all State of Colorado and local regulations and per the landowner agreement. 3.3.11 Haul Routes During Construction The movement of construction equipment and materials to the ROW may temporarily affect existing transportation networks. To minimize disruption, equipment and materials will be stored in the vicinity of the construction site. These pipelines would start at the Crossroads Booster Station (USRI7-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006) in Weld County, Colorado. The development of these pipelines will increase the pipeline transport capacity of natural gas in Weld County, reduce the burden of the vehicular transport on Weld County Roads, and support the safer transport of natural gas within the county. Pagel of18 2 USE BY SPECIAL REVIEW APPLICATION QUESTIONNAIRE The following sections list information required for Use by Special Review Permit Applications under Section 23-2-510 of the Weld County Code. 2.1 PLANNING QUESTIONS 2.1.1 Applicant's Name and Telephone Number DCP Operating Company, LP 3026 4th Avenue Greeley, CO 80631 Attn: David Jost, VP Operations North (970) 378-6345 2.1.2 Explain, in dotal , the proposed use of the property. DCP proposes to construct the Crossroads Discharge North and South 12" Pipelines in Section 18 of Township (1)4 North (N); Range (R) 64 West (W) in Weld County, Colorado. The pipelines are entirely located on one parcel (Attachment B; Parcel #105318300002), which is owned by DCP. The proposed pipelines would each be approximately 0.35 miles in total length, are co - located within one right-of-way (ROW), and would start at the Crossroads Booster Station (USRI7-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006). The pipelines would exit from launchers at the Crossroads Booster Station and head south approximately 0.1 miles where it would turn east and travel 0.25 miles where they terminate at receivers along the Mewbourn 160 Pipeline. The alignments are shown in Attachment D of this application. The pipelines would be constructed within a 100 -foot temporary ROW. Once the pipelines have been installed, the temporary ROW will be returned to its pre -construction contours and reclaimed. The permanent maintenance ROW for each pipeline will be 30 -feet; however, this land will be returned to the surrounding land use during the operational period. As the pipelines are located approximately 20 feet apart, the combinedpermanent maintenance ROW would be 50 feet. Permanent, aboveground equipment will include two launchers at the Crossroads Booster Station and two receivers along the Mewbourn 160 Pipeline. Total land impacts during construction will be approximately 4.2 acres, while the permanent ROW will cover approximately 2.1 acres. Page 2 of 18 2.1.3 Consistency with Weld County Code and Chapter 22 of the Comprehensive Plan The property containing by the proposed pipeline project is within an agricultural zone district. The proposed pipeline project is located in unincorporated Weld County and occurs entirely within an agricultural zone district. The surrounding lands are either irrigated lands, pivot fields, or grazing areas. Some homes and estates are in the vicinity of the proposed pipelines. All impacts from the installation of the proposed pipeline project would be temporary and all disturbed areas would be returned to their pre -construction contours and reseeded. The project is consistent and compatible with the surrounding land uses as a use allowed by right under Weld County Code Section 23-3-20. 2.1.5 Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. The proposed pipeline project is located in unincorporated Weld County and occurs entirely within an agricultural zone district. The surrounding lands are either irrigated lands, pivot fields, or Page 3 of 18 grazing areas. All impacts from the installation of the proposed pipeline project would be temporary and all disturbed areas would be returned to their pre -construction contours and reseeded. The project is consistent and compatible with the surrounding land uses as a use allowed by right under Weld County code Section 23-3-20. 2.1.6 What are the hours and days of operation' construction would occur within daytime hours (7:00 AM to 6:00 PM). Once constructed, the pipelines would be in operation 24 hours a day, seven days a week, 365 days a year. During routine maintenance and inspection activities, trucks would travel along the ROW route between 6:00 AM and 5:00 PM, unless they are responding to an emergency. Daily visits to the pipeline ROW are not anticipated. 2.1.7 List the number of full time and/or part time employees proposed to work at this site. The pipelines would be maintained by 10 to 15 existing DCP field personnel and would not require dedicated full time operators. 2.1.8 If shift work is proposed include the number of employees per shift. See response under Section 2.1.6 of this document. 2.1.9 List the number of people who will use this site. Include contractors, truck drivers, customers, volunteers, etc. During construction, up to 50 people could be present onsite for various activities. Construction personnel would include both DCP employees and contractors. Contractors would use existing storage yards as the base of operations. The pipelines would be maintained by 10 to 15 existing DCP personnel. 2.1.10 If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. No animals would be onsite as part of the proposed project. Page4of 18 2.1.11 Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) No lots are proposed as part of the proposed pipeline project. 2.1.12 How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? No parking lots or structures are proposed as part of the pipeline project. 2.1.13 Explain the existing and proposed landscaping for the site. Following construction and installation, the site would be graded and restored to its pre - construction contours. The ROW would be reseeded and reclaimed. Areas reseeded are expected to return to pre -construction conditions within one to two growing seasons. Noxious weeds would be managed in accordance with Chapter 15, Articles I and II of the Weld county code, during construction and until final reclamation is deemed successful. 2.1.14 Describe the type of fence proposed for the site (e.g. 6 -foot chain link with earth tone slats). No new fencing is required. 2.1.15 Describe the proposed screening for all parking and outdoor storage areas. If the site is located in a floodplain outdoor storage is restricted. No permanent onsite parking or storage areas is proposed. 2.1.16 Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Should temporary decommissioning be required on either pipeline, the pipeline pressure would be reduced to a safe level or the pipeline would be cleared using blowdown valves at the launcher or receiver site. Once these procedures are completed, maintenance activities would be conducted on the pipeline. Page 5 of 18 Once the pipelines are operating, there is no intention of removing or terminating use of the pipelines. Should either pipeline require decommissioning, the pipeline would be cleaned, isolated, and abandoned in place per all state of Colorado and local regulations and per the landowner agreement. 2.1.17 Who will provide fire protection to the site? The Platteville Valley Fire Protection District would be dispatched in the case of an emergency along the ROW. The project will not have a water source appropriate for fire suppression; therefore, water or other fire retardants would be transported to the ROW if needed. 2.1.18 List all proposed on -site and off -site improvements associated with the use (e.g. landscaping, fencing, buildings, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Aboveground equipment associated with the proposed pipelines will include two launchers at the Crossroads Booster Station and two receivers at the Mewbourn 160 Pipeline connection. Construction of the facilities would occur concurrently with the pipeline construction and installation period which is expected to commence in November of 2017. 2.2 ENGINEERING QUESTIONS 2.2.1 Describe how many roundtripsfday are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and 1 trip out of site) During construction equipment (graders, disking, etc.), stringing trucks, welding trucks, and one - ton pickup trucks would be required along the ROW for construction, installation, and reclamation activities. These vehicles would only be needed for the brief construction period and are not expected within the ROW once the pipelines become operational. During operation of the pipelines, only occasional traffic from pickup trucks within the ROW for routine maintenance and inspection would be required. Any additional traffic resulting from construction of the pipelines will be minor and temporary. As the project will not contribute to significant alterations in traffic patterns within Weld county►, DCP assumes that a traffic study will not be required for this application. Page 6 of 18 2.2.2 Describe the expected travel routes for site traffic. Access to the site would be from existing private roads. No planned temporary or permanent access roads or easements are planned outside of the construction ROW for the proposed pipelines. As such, no Weld County Access Permits are needed at this time. Once the pipelines are operational, additional traffic will be limited to an occasional vehicle used for regular inspection and maintenance. No long-term alteration of traffic patterns within Weld County is anticipated. 2.2.3 Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) The proposed pipelines would be generally be accessed via the existing private roads along CR 44. 2.2.4 Describe the time of day that you expect the highest traffic volumes from above. The greatest volume of traffic during construction would occur between 8:00 AM and 6:00 PM. 2.2.5 Describe where the access to the site is planned. Refer to Section 2.2.2 for the discussion on site access. 2.2.6 Drainage Design: Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23-12-30 F.1. Based on the criteria set forth in Section 23-12-30.F.1a.5 of the Weld County code, this pipeline project does not require a detention pond. Details regarding this exception are described in the questionnaire list below: A. Does your site qualify for an exception to stormwater detention? The property containing the pipelines generally has higher elevations along the southern side which decrease toward the north. Stormwater and overland flow would move across the proposed ROW from nearby fields. Overland flow would generally move toward the north. No stream or wetland features occur within the ROW. 3. Where it flows to as it leaves the property. i. As the ROW would be restored to its natural contour and drainage patterns, water would flow across the ROW as it has historically. Surface flow would collect in the local ditch systems along active fields and roadways a n d eventually flow into the South Platte River System. As the ROW would be revegetated, the project is not anticipated to increase the sediment burden on the local watersheds. 4. The direction of flow across the property. i. The direction of flow during the operational period of the pipelines would identical to its pre -construction flow. If there have been previous drainage problems with the property. i. The property has no known drainage issues. 2 ENVIRONMENTAL HEALTH QUESTIONS 2.3.1 What is the drinking water source on the property? No drinking water source is required. During construction, bottled water will be provided to construction personnel. 2.3.2 If utilizing a drinking water well include either the well permit or well permit application that was submitted to the state -Division of Water Resources. If utilizing a public water tap Page 8 of 18 include a letter from the Water District, a tap or meter number, or a copy of the water bill. N o drinking water well is required. No public water tap will be utilized for this project. Water used for hydrostatic testing would come from a municipal source and be disposed of in compliance with a Colorado Discharge Permit System. 2.3.3 What type of sewage disposal system is on the property? If utilizing an existing septic system provide the septic permit number. If there is no septic permit due to the age of the existing septic system, apply for a septic permit through the Department of Public Health (CDPHE) and Environment prior to submitting this application. If a new septic system will be installed please state "a new septic system is proposed." only propose portable toilets if the use is consistent with the Department of Public Health and Environment's portable toilet policy. N o existing or proposed sewage disposal system would be used. Portable toilets would be used for construction personnel, but would be removed for the operational life of the pipelines. 2.3.4 If storage or warehousing is proposed, what type of items will be stored? N o long-term storage would be proposed onsite. 2.3.5 Describe where and how storage and/or stockpile of wastes, chemicals, and/or petroleum will occur on this site. During construction, all liquid and solid waste will be stored and removed for disposal according to applicable regulations. Temporary► sewage disposal units (i.e., portable toilets) will be placed in areas of active construction, and will be maintained regularly to prevent water or soil contamination. Any leaks from equipment or vehicles will be cleaned up in accordance with all applicable regulations and disposed of at appropriate disposal facilities. No wastes will be stored or stockpiled during operation of the pipelines. Page 9 of 18 2.3.6 If there will be fuel storage on site indicate the gallons and the secondary containment. State the number of tanks and gallons per tank. No fuel storage would occur onsite. 2.3.7 If there will be washing of vehicles or equipment on site indicate how the wash water will be contained. No floor drains would be required as part of the proposed project. 2.3.9 Indicate if there will be any air emissions. Page 11 of 18 3 USE BY SPECIAL REVIEW PERMIT REQUIREMENTS FOR PIPELINES SEC. 23-2-510 Chapter 23 of the Weld County code requires a Use by Special Review Permit to construct a natural gas pipeline that is greater than 12 inches in diameter and is designed to operate at a hoop stress of 20 percent, or higher, of its Specified Minimum Yield Strength. The following information is requested in Section 23-2-510 of the Weld County Code. 3.1 APPLICANT'S NAME AND TELEPHONE NUMBER DCP Operating Company, LP 3026 4th Avenue Greeley, CO 80631 Attn: David Jost, VP Operations North (970) 378-6345 .2 SOURCE, CAPACITY, DESTINATION AND TYPE OF FACILITIES, SUPPORT STRUCTURES INVOLVED DCP is proposing to construct and operate two co -located natural gas discharge pipelines named the Crossroads Discharge North and South 12" Pipelines (also referred to as the "proposed pipelines"). These pipelines would start at the Crossroads Booster Station U R17-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006) in Weld County, Colorado. The development of these pipelines will increase the pipeline transport capacity of natural gas in Weld County, reduce the burden of the vehicular transport on Weld County Roads, and support the safer transport of natural gas within the county. 3.3 DETAILED REPORT 3.3.1 Description of the Pipeline DCP proposes to construct the Crossroads Discharge North and South 12" Pipelines in Section 18 of Township (T) 4 North (N); Range (R) 64 West (W) in Weld County, Colorado. The pipelines are entirely located on one parcel (Attachment B; Parcel ##105318300002), which is owned by DCP. The proposed pipelines would each be approximately 0.35 miles in total length, are co - Page 12 of 18 located within one right-of-way (ROW), and would start at the Crossroads Booster Station (USRI 7-0023) and would terminate at the Mewbourn 160 Pipeline (USRI2-0006). The pipelines would exit from launchers at the Crossroads Booster Station and head south approximately 0.1 miles where it would turn east and travel 0.25 miles where they terminate at receivers along the Mewbourn 160 Pipeline. The alignments are shown in Attachment D of this application. The pipelines would be constructed within a 100 -foot temporary ROW. Once the pipelines have been installed, the temporary ROW will be returned to its pre -construction contours and reclaimed. The permanent maintenance ROW for each pipeline will be 30 -feet; however, this land will be returned to the surrounding land use during the operational period. As the pipelines are located approximately 20 feet apart, the combined permanent maintenance ROW would be 50 feet. Permanent, aboveground equipment will include two launchers at the Crossroads Booster Station and two receivers along the Mewbourn 160 Pipeline. Total land impacts during construction will be approximately 4.2 acres, while the permanent ROW will cover approximately 2.1 acres. 3.3.2 Description of the Preferred Route The preferred route is described in detail in Section 3.3.1 of this permit application. This route was selected as the preferred project route as it balances environmental sensitivity, operational efficiency, cost minimization, and adjacent landowner considerations. A►s such, DCP has proposed this alignment as the preferred route as it helps meet the operational needs of the project while minimizing impacts to the surrounding community and environment. In the early planning stages, DCP considered alternative route options through the property; however, the DCP generally decided to site the pipelines as dose to the southern edge of the property as possible in order to make inspection access easier and to reduce the potential for interruption to agricultural activities in the nearby field and other resources. 3.3.3 Procedures to Mitigate Adverse Impacts The pipelines will be installed underground with the exception of the launchers and receivers. No landscaping is proposed. Upon completion of construction activities, the ROW will either be seeded with native grasses. If noxious weeds are identified on the ROW during construction or Page 13 of 18 reclamation periods, they will be managed in compliance with Chapter 15, Articles I and II of the Weld County Code. DCP will implement the following procedures to minimize adverse effects during construction and operation of the pipeline: • Best Management Practices wilt be installed to prevent erosion or sediment runoff; • Topsoil will be segregated from subsoil during grading activities. Once the pipelines are installed in the trench, subsoil will be backfilled into the trench. The segregated topsoil will be placed atop the subsoil, and the ROW will be graded to preconstruction contours; • DCP will apply for a CDPHE Construction Stormwater Permit. The permit requires the development of a SWMP. DCP has developed the SWMP which will provide mitigation measures to be followed during construction and operation of the pipeline; and • The ROW will be stabilized as quickly as possible following final grading. 3.3.4 Construction Schedule Typical pipeline construction methods will be implemented. These include: • Survey — The alignment and workspace limits will be identified prior to construction activities; clearing and Grading — The temporary construction ROW will be cleared of trees and obstructions, and graded to a relatively flat surface to accommodate construction equipment; • Trenching — The pipeline trenches will be excavated to provide a depth of cover required by the USDOT, Weld County or DCP Standards. Roads and waterbodies will bored using standards construction techniques; • Pipe Stringing and Laying — Pipe segments will be strung along the ROW parallel to the trench, and will be bent (where required), welded, and lowered -in to the trench; • Backfilling and Grading — Once the pipelines are installed in the trenches, subsoil will be replaced into the trench. Topsoil that was segregated during grading operations will be placed over the subsoil. The ROW will be re -graded to its preconstruction contour and seeded to encourage revegetation; • Hydrostatic Testing - The pipelines will undergo hydrostatic testing to ensure their integrity. Page 14 of 18 Construction on the Crossroads Discharge North and South 12" Pipelines is planned to start in November 2017 and end in February 2018. 33.5 Information on Public Sutreach and Land Iwners'hip No public meetings have been held regarding this project. See Attachment F for the affidavits of interested landowners. 3.3.6 Description of the Hazards Transporting oil and natural gas by pipeline is generally safer, lowers the burden on local collector roads, and lowers air quality emissions. There is some small risk the integrity of a pipeline may be compromised from accidents or geologic hazards which could result in a release of gas. In addition to DCP's monitoring and valve cutoff systems described in the section below, DCP will dearly mark the centerline of the proposed pipelines with markers placed at line of site intervals, and at road and railroad crossings. The markers will clearly indicate the presence of a gas pipelines, and will provide a telephone number and address where a company representative can be reached in an emergency or prior to any excavation in the area of the pipelines. In addition, DCP participates in the "One Call" system. "One call" systems serve as the clearinghouse for excavation activities that are planned close to pipelines and other underground utilities. DCP employs highly trained operators and contractors and maintains close working relationships with all emergency response personnel. DCP also participates in a continuing education program to enable customers, the public, government officials, and those engaged in excavation activities to recognize a gas pipeline emergency and report it to the appropriate authority. 3.3.7 Emergency Procedures DCP maintains a monitoring system that includes a gas control center that tracks pressures, flows, and deliveries on its entire system. The gas control center is staffed 24 hours a day, 7 days a week, 365 days a year. DCP also has area offices near the pipelines with personnel who can provide the appropriate response to emergency situations and direct safety operations as necessary. DCP's pipeline systems are equipped with remotely controlled valves that can be Page 15 of 18 operated from the gas control center. In the event of an emergency, the valves allow for a section of the pipeline to be isolated from the rest of the system. Data acquisition systems are also present at all of OOP's meter stations. If system pressures fall outside of a predetermined range, an alarm is activated, and notice is transmitted to the gas control center. Routine aerial and ground inspections are conducted by DCP personnel or contractors. These inspections allow DCP to identify soil erosion that may expose the pipelines; dead vegetation that may indicate a leak in a line; unauthorized encroachment on the ROW by a third party; or other conditions that may lead to a safety hazard and/or require preventative maintenance or repairs. See Attachment E for emergency contact information. 3.3.8 Procedures to Minimize Impacts on Irrigated Agricultural Land The pipeline ROW will be located in an agricultural zone district. During pipeline design and route selection, DCP made efforts to avoid actively cultivated agricultural fields to reduce impact to productive areas. The lands adjacent to the ROW are also zoned as agricultural. The ROW route is as direct as possible limiting the total acreage of land affected during construction. The effect on land that is disturbed during construction will be temporary in nature since the permanent ROW will be allowed to revert to its pre construction state. In areas where active cultivation could not be avoided, impacts will be minimized by implementing the following: • Topsoil will be segregated and preserved during grading operations, and returned as surface layer soil once the pipelines are installed; • The pipelines will be installed in an area that will avoid affecting the operation of irrigation equipment; and • Following construction of the project, the ROW will be seeded and reclaimed. Upon successful completion of construction, disturbed areas will be seeded with native grasses to encourage vegetation growth and soil stabilization. Page 16 of 18 3.3.9 Conformance with the Guidelines of Chapter 22 The properties intersected by the proposed pipelines are within an agricultural zone district. Weld County Code Section 23-2-200 et seq. allows the development of oil and gas support and service facilities within agricultural zones. Additionally, Section 22-5-90 of the Weld County Code Comprehensive Plan specifies that "the most efficient and environmentally friendly way to transport crude oil is by pipeline, rather than by truck." Transportation of oil and natural gas products by pipeline has a lower impact on the local road system and lowers air quality impacts. The Weld County Code also specifies under Section 22-5-100 that "Oil and gas activities should be planned to accommodate current and future subdivision activities to the extent such development can reasonably be anticipated". Construction and installation of the proposed pipelines may require temporary interruption to agricultural activities. However, during the operational period, the overlying ROW would be reclaimed. The proposed pipelines would meet the safety and infrastructure requirements of the Weld County Code Comprehensive Plan and local oil and natural gas industry while maintaining the long-term productivity of the nearby agricultural operations. 3.3.10 Decommissioning Plan Should temporary decommissioning be required, the pipeline pressure would be reduced to a safe level or the pipeline(s) would be cleared using blowdown valves at the launcher or receiver site. Once these procedures are completed, maintenance activities would be conducted on the pipeline(s). Once the pipelines are operating, there is no intention of removing or terminating use of either pipeline. Should either of the pipelines require decommissioning, it would be cleaned, isolated, and abandoned in place per all state of Colorado and local regulations and per the landowner agreement. 3.3.11 Haul Routes During Construction The movement of construction equipment and materials to the ROW may temporarily affect existing transportation networks. To minimize disruption, equipment and materials will be stored in the vicinity of the construction site. Where access to roadways may impede traffic flow, Page 17 of 18 appropriate traffic control measures will be used. DCP will work with Weld County Department of Public Works to obtain all necessary road crossing permits. 3.3.12 Other Pertinent Information Additional information can be provided upon request. Questions pertaining to access permits or access design shall be directed to the Public Works Department. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Entrance gates (if applicable) must be set back a minimum of 100 ft from edge of existing shoulder of roadway to allow a truck and trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped for gate create a safety issue for roadway users. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT (IRMR): No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking.
