SEPTEMBER 6, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, September 6, 2017, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of August 30, 2017, as printed. Commissioner Conway seconded the motion,
and it carried unanimously.
CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of
Hearings conducted on August 30, 2017, as follows: 1) COZ17-0005 — Lisa Beilman, do Bob Christie,
and 2) USR17-0012 — Farmers Reservoir and Irrigation Company, do Haven Sporting Club.
Commissioner Conway seconded the motion, which carried unanimously.
El AMENDMENTS TO AGENDA: There were no amendments to the agenda.
El CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed.
Commissioner Freeman seconded the motion, and it carried unanimously.
PRESENTATIONS:
1) RECOGNITION OF SERVICES, NOXIOUS WEED MANAGEMENT ADVISORY BOARD -
JOSEPH HATCH: Chair Cozad read the certificate for the record, recognizing Mr. Hatch for his
commitment of time and voluntary contributions to Weld County.
PUBLIC INPUT: Dave Kisker, resident of Johnstown, stated he is speaking on behalf of the citizens
grass roots group, called People United for Responsible Government. He commented on the resolution
to disband the County Council as a ballot initiative and read and submitted a petition, marked Exhibit A,

signed by 150 people who disagree with the ballot question. Steve Teets, resident of Greeley, stated
the Commissioners should not disband the County Council. In response to Mr. Teets, Commissioner
Moreno stated Weld Project Connect will be held on October 20, 2017, at 10:00 a.m., and they will get
Mr. Teets the information for volunteering. Mr. Teets stated he would also like to organize a clean-up for
Hurricane Harvey to go to Houston in the spring of 2018. He suggested it would be a positive
representation of the County and Colorado. Chair Cozad stated during the flood in 2013, people came
from all over the United States to help with the clean-up. Merrie Garner, Office of Emergency
Management, stated the Red Cross and Salvation Army are training and organizing people to go to Texas
to help with the hurricane clean-up.
• COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno attended the annual
breakfast with the City of Greeley. He and Commissioner Conway attended the inaugural kick-off for the
Greeley -Evans Summit with School District 6. He announced the Weld Project Connect committee is still
looking for volunteers. Lastly, he also attended Harvest Day in Windsor. Commissioner Conway
stated the annual breakfast with the City of Greeley included a productive discussion. He attended the
1-25 Funding Subcommittee, and expressed his gratitude with the committee members' feedback on the
many projects. He expressed his appreciation for the Grassroots Greeley -Evans Summit organized by
Greeley School District 6 to provide information for continuing education to high school students and their
parents. He participated in the NACO Transportation Steering Committee. He reported he also was
reappointed to the Immigration Task Force, as the Vice Chairman, and he is looking forward to a busy
year. In response to Chair Cozad, Commissioner Conway stated he has been involved in several
discussions concerning the Refugee Resettlement Program. IR Chair Cozad stated as a
representative of the Board on the Poudre Trail Board, she attended a fundraiser on their behalf. She
also attended the Greeley City Council meeting and stated they are pleased to work with Weld County.
• Commissioner Conway addressed the petition that was presented during Public Input by Mr. Kisker
and inquired if the Board wants to consider it on a future agenda or should it be discussed now.
Bruce Barker, County Attorney, stated the Board can adjust the Agenda at any point, however, it was
agreed upon that the Board continue this discussion to a time when a full Board can be present.
BIDS:
• 1) PRESENT BID #B1700124, CNG FUEL SITE REMODEL - DEPARTMENT OF PUBLIC WORKS:
Rob Turf, Purchasing Department, presented the three (3) bids received and stated staff will bring back
a recommendation on September 20, 2017.
• 2) PRESENT BID #61700125, CONCRETE REHABILITATIONS - DEPARTMENT OF PUBLIC
WORKS: Mr. Turf presented the details of the six (6) bids received and stated staff will bring back a
recommendation on September 20, 2017.
• 3) PRESENT BID #B1700126, ROOF REPLACEMENT (HHW BUILDING) - DEPARTMENT OF
BUILDINGS AND GROUNDS: Mr. Turf presented the six (6) bids received and stated staff will bring back
a recommendation on September 20, 2017.
NEW BUSINESS:
1) CONSIDER CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2003-0662 AND
2005-0339) FOR PARCEL #0961-06-4-29-025: John Lefebvre, Weld County Treasurer, explained the
details of the request for the cancellation of the Senior Tax Certificates. Commissioner Conway moved
to approve said cancellation of tax lien certificates. The motion was seconded by Commissioner Moreno,
and it carried unanimously.

• 2) CONSIDER CONTRACT ID #1420 CHANGE ORDER FOR FIBER CONNECTIVITY FOR
RADIO SYSTEM CORE SWITCH AND AUTHORIZE CHAIR TO SIGN — AFFINITI, LLC: Walt Leslie,
Department of Public Safety Communications, reviewed the terms of the Change Order for the amount
of $530,000.00 for ten (10) years. Commissioner Freeman moved to approve said change order and
authorize Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously.
Each one of the Commissioners thanked the staff and Mike Wallace, Director of the Department of Public
Safety Communications, for their work on this.
ki 3) CONSIDER CONTRACT ID #1433 CONGESTION MITIGATION AND AIR QUALITY (CMAQ)
GRANT AGREEMENT FOR UPPER FRONT RANGE NATURAL GAS VEHICLE FLEETS AND
AUTHORIZE CHAIR TO SIGN: Jim Flesher, Department of Public Works, presented the 2017 grant
agreement for the amount of $502,000.00 from the Colorado Department of Transportation, with the local
match requirement of $104,353.00. Commissioner Moreno moved to approve said agreement and
authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried
unanimously.
• 4) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY
AND TEMPORARY CONSTRUCTION EASEMENT FOR COUNTY ROAD 47 CORRIDOR PROJECT
AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS — PECKHAM DEVELOPMENT
CORPORATION: Tiffane Johnson, Department of Public Works, presented the terms of the purchase
agreement for a total of $3,900.00, Commissioner Freeman moved to approve said agreement and
authorize Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously.
5) CONSIDER CONTRACT ID #1171 AGREEMENT CONCERNING PURCHASE OF
TEMPORARY CONSTRUCTION EASEMENTS FOR CR 47 CORRIDOR IMPROVEMENT PROJECT
AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS —WAKE, LLLP: Ms. Johnson reviewed
the details of the purchase agreement for the total amount of $910.00. Commissioner Freeman moved
to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Conway, the
motion carried unanimously.
• 6) CONSIDER CONTRACT ID #1370 AGREEMENT CONCERNING PURCHASE OF PUBLIC
ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR CR 47 CORRIDOR
IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS -
WAYNE AND KRIS HOWARD: Ms. Johnson presented the terms of the purchase agreement for a total
of $50,000.00. Commissioner Moreno moved to approve said agreement and authorize the Chair to sign.
The motion, which was seconded by Commissioner Freeman, carried unanimously.
• 7) CONSIDER CONTRACT ID #1425 AGREEMENT CONCERNING PURCHASE OF PUBLIC
ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR CR 47 CORRIDOR
IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS -
HUNGENBERG UH FARMS, LLLP: Ms. Johnson presented the agreement for the total of $105,000.00
Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Commissioner
Freeman seconded the motion, and it carried unanimously.
• 8) CONSIDER CONTRACT ID #1434 AGREEMENT CONCERNING PURCHASE OF
PERMANENT EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN
IMPROVEMENTS TO THE WELD COUNTY CNG FUELING STATION AND AUTHORIZE CHAIR TO
SIGN NECESSARY DOCUMENTS - JIM ELLS: Ms. Johnson presented the details of the purchase

agreement for the total of $1,237.00. Commissioner Conway moved to approve said agreement and
authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously.
• 9) CONSIDER CONTRACT ID #1435 AGREEMENT CONCERNING PURCHASE OF PUBLIC
ROAD RIGHT-OF-WAY FOR CR 47 CORRIDOR IMPROVEMENT PROJECT AND AUTHORIZE CHAIR
TO SIGN NECESSARY DOCUMENTS - HOSHIKO LAND, LLC: Ms. Johnson reviewed the terms for the
purchase agreement for the amount of $62,685.00, and added as part of the project, the County will be
purchasing existing irrigation facilities for $2,400.00, and 100 -feet of concrete ditches and will replace
earth and concrete structures for $44,075.00. She stated the total compensation is $128,166.00.
Commissioner Freeman moved to approve said agreement and authorize Chair to sign. The motion was
seconded by Commissioner Conway, and it carried unanimously. Each one of the Commissioners
expressed their appreciation to the staff and Ms. Johnson, specifically for doing a good job working with
landowners.
• 10) CONSIDER CONTRACT ID #1436 AGREEMENT FOR CR 47 CORRIDOR IMPROVEMENT
PROJECT FOR CONSTRUCTION SERVICES AND AUTHORIZE CHAIR TO SIGN - HOSHIKO LAND,
LLC: Ms. Johnson presented the purchase agreement and stated there is no cost to the County.
Commissioner Moreno moved to approve said agreement and authorize the Chair to sign. Seconded by
Commissioner Conway, the motion carried unanimously.
• 11) CONSIDER CONTRACT ID #1438 AGREEMENT CONCERNING PURCHASE OF
TEMPORARY CONSTRUCTION EASEMENTS FOR CR 87/40A BRIDGE PROJECT AND AUTHORIZE
CHAIR TO SIGN NECESSARY DOCUMENTS - LARRY HART AND BRENDA LANGFORD:
Ms. Johnson presented the details of the purchase agreement for the 87/40A Bridge project in the total
amount of $400.00 for the execution of the temporary construction easement. Commissioner Freeman
moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Conway,
the motion carried unanimously.
El 12) CONSIDER CONTRACT ID #1437 AGREEMENT CONCERNING PURCHASE OF PUBLIC
ROAD RIGHT-OF-WAY FOR CR 91/40A BRIDGE PROJECT AND AUTHORIZE CHAIR TO SIGN
NECESSARY DOCUMENTS — EMPIRE DAIRY, LLC: Ms. Johnson presented the details of the purchase
agreement for the total of $1,521.00. Commissioner Moreno moved to approve said agreement and
authorize the Chair to sign. Commissioner Freeman seconded the motion, and it carried unanimously.
• 13) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY
FOR CR 47 IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN NECESSARY
DOCUMENTS - DCP MIDSTREAM, LP: Ms. Johnson presented the purchase agreement for the amount
of $3,900.00. Commissioner Conway moved to approve said agreement and authorize the Chair to sign.
The motion, which was seconded by Commissioner Moreno, carried unanimously.
• 14) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR CLOSURE OF UNION PACIFIC
RAILROAD CROSSING ON CR 72, EAST OF U.S. HIGHWAY 85, INCLUDING ROADWAY
IMPROVEMENTS AND AUTHORIZE CHAIR TO SIGN — TOWN OF EATON: Mr. Barker presented the
agreement with the Town of Eaton for the closure of the railroad crossing and roadway improvement.
Commissioner Conway stated he had a discussion with Mayor Ross about this matter. Commissioner
Conway moved to approve said intergovernmental agreement and authorize Chair to sign. The motion
was seconded by Commissioner Freeman, and it carried unanimously.

IR 15) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE
SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO
CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Barb Connolly, Controller, presented the
list of the equipment that will go to auction. In response to Commissioner Conway, Ms. Connolly stated
she depends on the municipalities to contact here if they have a need for certain equipment.
Commissioner Conway moved to declare said equipment as surplus, approve sale of same at auction
and authorize the Controller to sign any necessary documents. Seconded by Commissioner Moreno, the
motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:58 a.m.

We understand that the Weld County Board of Commissioners has been
asked to put a charter change proposal on the November ballot which would
eliminate the County Council . While we recognize that the performance
of the Council has been spotty at times , the importance of having this
oversight group is clearly demonstrated by the two audits that they have
commissioned for the County Clerk and Recorder as well as the Board
itself. Whatever the outcome of the audits , good government requires that
oversight such as this must be possible .
Therefore , we ask that you immediately and completely reject this proposal ,
and instead express your support of the Council through an appropriate
resolution .
