BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
JULY 12, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, July 12, 2017, at the hour of 9:00 a.m.
le ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

El MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of July 10, 2017, as printed. Commissioner Conway seconded the motion, and
it carried unanimously.
AMENDMENTS TO AGENDA: Commissioner Conway moved to add item #10) to the end of New
Business: Consider Confirming Acceptance of Grant of Right -of -Way for CR 35.5, north of CR 8.
Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.
PRESENTATIONS:
1) RECOGNITION OF SERVICES, DEPARTMENT OF PUBLIC WORKS - STEVE BROWNLEE:
Chair Cozad read the certificate for the record recognizing Mr. Brownlee for his successful years of
service and presented him with a plaque and a pin. Jay McDonald, Director of the Department of Public
Works, thanked Mr. Brownlee for his handling of the County equipment. Mr. Brownlee thanked the County
for a good career and retirement and stated he will miss the County. Each one of the Commissioners
thanked Mr. Brownlee for his years of service and wished him well on his retirement. (Clerk's Note: the
meeting was paused for a photo opportunity.)

• 2) RECOGNITION OF SERVICES, DEPARTMENT OF PUBLIC WORKS - FRANCIE COLLINS:
Chair Cozad read the certificate for the record recognizing Ms. Collins for her years of dedicated service
to the County and presented her with a plaque and a pin. Mr. McDonald thanked Ms. Collins for her sunny
personality and positive attitude. Ms. Collins thanked the County for the employment opportunity. Each
one of the Commissioners told her to enjoy retirement and expressed their appreciation for the service
she has provided to the citizens of Weld County. (Clerk's Note: The meeting was paused for a photo
opportunity.)
• PUBLIC INPUT: Steve Teets, resident of Greeley, announced there will be a celebration for the
passage of the Americans with Disabilities Act and submitted a flyer as Exhibit "A." He expressed his
frustration with the Veteran's clinic closing in Greeley and the transportation issues that will occur. Chair
Cozad stated she and Commissioner Moreno presented concerns to Congress about the population
number in Greeley and how it will affect Greeley Veterans. The Commissioners expressed the importance
of their representation of our Weld County Veterans.
• COMMISSIONER COORDINATOR REPORTS: Commissioner Conway reported attending the
South Platte Roundtable and stated they passed funding for three (3) different grants. Chair Cozad stated
she gave an update on the Freedom Parkway Access to the Evans Economic Development Board.
BIDS:
El 1) APPROVE BID #B1700095, ADULT COMMUNITY CORRECTION SERVICES - DEPARTMENT
OF JUSTICE SERVICES: Barb Connolly, Controller, requested the continuance of this matter.
Commissioner Kirkmeyer moved to continue this matter to August 9, 2017. The motion was seconded by
Commissioner Conway, and it carried unanimously.
2) APPROVE BID #61700111, CRUSHED TYPE 1 COVER COAT AGGREGATE SUPPLY -
DEPARTMENT OF PUBLIC WORKS: Ms. Connolly stated there was only one bidder because of the
uniqueness of the material. Commissioner Freeman moved to approve said sole bid. The motion was
seconded by Commissioner Moreno, and it carried unanimously.
3) PRESENT BID #B1700114, HOUSEHOLD HAZARDOUS WASTE PICKUP SERVICES —
DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Ms. Connolly presented the two (2) bids
received and stated staff will bring back a recommendation on July 26, 2017.
4) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (NE1/4, S31, T9N,
R60W): Ms. Connolly presented the four (4) bid amounts submitted for the 160 acres and conducted an
oral auction between the two (2) highest bidders. Commissioner Conway moved to accept the high bid
from Broadwing Properties I, LLC, in the amount of $3,100.00 per acre, approve said lease and authorize
the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
5) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (LOTS 3 AND 4, E1/2
SW1/4, S31, T9N, R60W): Ms. Connolly presented the amounts of the four (4) bids received for 160 net
minerals and conducted an oral auction between the two (2) highest bidders. In response to Lemar Safi,
representative of Verdad Oil, Ms. Connolly clarified that the top two (2) bidders and anyone in the top
10% could participate in the auction. Commissioner Conway moved to accept the high bid from
Broadwing Properties I, LLC, in the amount of $3,000.00 per acre, approve said lease and authorize the
Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously.

NE1/4, S5, T8N, R59W): Ms. Connolly presented the amounts of the four (4) bids submitted for 40 acres
and conducted an oral auction. Commissioner Moreno moved to accept the high bid from Alpha DJ
Holdings, LLC, for $4,500 per acre, approve said lease and authorize Chair to sign. The motion was
seconded by Commissioner Conway, and it carried unanimously.
• 7) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (LOT 1, NE1/4 NE1/4,
S5, T8N, R59W): Ms. Connolly submitted the amounts for the four (4) bids for 45.43 net mineral acres
and conducted an oral auction. Commissioner Moreno moved to accept the high bid from Alpha DJ
Holdings, LLC, for $4,500.00 per acre, approve said lease and authorize Chair to sign. The motion was
seconded by Commissioner Conway, and it carried unanimously.
• 8) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (E1/2 NW1/4, S8, T8N,
R60W): Ms. Connolly presented the five (5) bids received for the 80 acres and conducted an oral auction.
Commissioner Conway moved to approve the high bid from Alpha DJ Holdings, LLC, for $4,700.00 per
acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner Freeman, the
motion carried unanimously.
• 9) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (SW1/4, S15, T8N,
R60W): Ms. Connolly presented the amounts for the five (5) bids for 160 acres and conducted an oral
auction. Commissioner Moreno moved to accept the high bid from Alpha DJ Holdings, LLC, for $4,500.00
per acre, approve said lease and authorize Chair to sign. The motion was seconded by Commissioner
Kirkmeyer, and it carried unanimously.
10) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (SE1/4, S15, T8N,
R60W): Ms. Connolly presented the amounts for the five (5) bids for 68.75 acres and conducted an oral
auction. Commissioner Conway moved to accept the high bid from Alpha DJ Holdings, LLC, for the
amount of $4,500.00 per acre, approve said lease and authorize the Chair to sign. The motion, which
was seconded by Commissioner Freeman, carried unanimously.
• 11) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (NW1/4, S20, T8N,
R60W): Ms. Connolly submitted the amounts for the five (5) bids received for 160 mineral acres and
conducted an oral auction. Commissioner Freeman moved to accept the high bid from Alpha DJ Holdings,
LLC for $4,700.00 per acre, approve said lease and authorize the Chair to sign. Seconded by
Commissioner Kirkmeyer, the motion carried unanimously.
12) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (S1/2 NE1/4, PART OF

amounts for the four (4) bids received for the 123 acres and conducted an oral auction.

Ms. Connolly presented the amounts for the five (5) bids for the 326.37 acres and conducted an oral
auction. Commissioner Moreno moved to accept the high bid from Alpha DJ Holdings, LLC, for $5,250.00
per acre, approve said lease and authorize the Chair to sign. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
• 14) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (S1/2 S1/2 NW1/4, S5,
T8N, R59W): Ms. Connolly presented the amounts of the four (4) bids for 40 acres and conducted an
oral auction. Commissioner Conway moved to accept the high bid from Alpha DJ Holdings, LLC, for
$5,250.00 per acre, approve said lease and authorize the Chair to sign. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
15) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY

R60W): Ms. Connolly submitted the amounts for five (5) bids for the 160 acres and conducted an oral
auction. Commissioner Freeman moved to accept the high bid from Broadwing Properties I, LLC, for
$5,300.00 per acre, approve said lease and authorize Chair to sign. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
16) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (NE1/4, S17, T8N,
R60W): Ms. Connolly submitted the amounts of the five (5) bids for the160 acres and conducted an oral
auction. Commissioner Conway moved to accept the high bid from Broadwing Properties I, LLC, for
$5,300.00, approve said lease and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer,
the motion carried unanimously.
• 17) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (S1/2, S27, T9N,
R60W): Ms. Connolly presented the amounts for four (4) bids for 320 acres and conducted an oral
auction. Commissioner Conway moved to accept the high bid from Broadwing Properties, I, LLC, for
$1,600.00 per acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner
Moreno, the motion carried unanimously.
• 18) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (S1/2 SE1/4, S21, T9N,
R60W): Ms. Connolly presented the amounts for the four (4) bids for 80 acres and conducted an oral
auction. Commissioner Moreno moved to accept the high bid from Context Energy Company, LLC, for
$1,100.00 per acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner
Conway, the motion carried unanimously.
19) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (SE1/4, S30, T9N,
R60W): Ms. Connolly submitted the amounts for the four (4) bids for the 80 mineral acres and conducted
an oral auction. Commissioner Conway moved to accept the high bid from Broadwing Properties, I, LLC,

for $2,275.00 per acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner
Kirkmeyer, the motion carried unanimously.
IE 20) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (NW1/4 NE1/4, S8,
T9N, R59W): Ms. Connolly submitted the amounts for the four (4) bids for the 40 acres and conducted
an oral auction. Commissioner Moreno moved to accept the high bid from Broadwing Properties, I, LLC,
for $2,550.00 per acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner
Conway, the motion carried unanimously.
21) CONDUCT ORAL AUCTION FOR OIL AND GAS LEASE COVERING CERTAIN PROPERTY
OWNED BY WELD COUNTY, COLORADO AND AUTHORIZE CHAIR TO SIGN (W1/2 W1/2, S26,
T11 N, R60W): Ms. Connolly presented the sole bid from Verdad Resources, LLC, for $600.00 for 160
acres. Crockett Butler, representative of Context Energy Company, LLC, stated he had submitted a bid
for this tract. Ms. Connolly stated after further research there are two (2) bidders and conducted an oral
auction. Commissioner Conway moved to accept the high bid from Context Energy Company, LLC, for
$625.00 per acre, approve said lease and authorize the Chair to sign. Seconded by Commissioner
Freeman, the motion carried unanimously.
NEW BUSINESS:
1) CONSIDER EMPLOYMENT FIRST PLAN FOR FISCAL YEAR 2018: Judy Griego, Director of
the Department of Human Services, presented the terms of the plan as required by the Colorado
Department of Human Services for the fiscal year 2018. Commissioner Conway moved to approve said
plan. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
2) CONSIDER STANDARD FORM AND RATES FOR INDIVIDUAL PROVIDER CONTRACT FOR
PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME BETWEEN THE WELD
COUNTY DEPARTMENT OF HUMAN SERVICES AND LISTED PROVIDERS AND AUTHORIZE CHAIR
TO SIGN AGREEMENTS CONSISTENT WITH SAID FORM AND RATES: Ms. Griego stated this is the
annual update for the policy and procedures and templates used to purchase foster care services.
Commissioner Kirkmeyer moved to approve said standard forms and rates and authorize the Chair to
sign agreements consistent with said form and rates. The motion, which was seconded by Commissioner
Moreno, carried unanimously.
Fi 3) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - SUNSECURED
FINANCING, LLC: Chris Woodruff, Weld County Assessor, presented the petition for abatement for the
year 2015 for a manufactured home park located in Firestone. He stated they agreed on a stipulated
value of $16,625,192.00 for 2016. Under the law the petitioner can protest 2015 and, since the
circumstances are the same, the refund amount of taxes is $18,282.69. Commissioner Kirkmeyer moved
to approve said petition for abatement or refund of taxes. Seconded by Commissioner Conway, the
motion carried unanimously.
4) CONSIDER ASSESSED VALUATION OF ALL TAXABLE PROPERTY AND MASTER
PROTEST LOG - REAL AND PERSONAL PROPERTY: Mr. Woodruff presented the total assessed
valuation of taxable real and personal property for the end of 2016. Mr. Woodruff discussed the increase
in oil and gas production and stated there is still a decline in oil production, but gas production has
continued to increase. He stated it was a normal protest and there were approximately 5,230 real property
protests during May, 2017. Commissioner Moreno moved to approve said assessed valuation of all
taxable property and the master protest log. The motion, which was seconded by Commissioner Conway,
carried unanimously.

5) CONSIDER APPLICATION FOR SPECIAL EVENTS PERMIT AND AUTHORIZE CHAIR TO
SIGN - THE WILD ANIMAL SANCTUARY, LLC: Frank Haug, Assistant County Attorney, presented the
liquor license for The Wild Animal Sanctuary to sell beer at their Tiny House Festival. He explained the
only concern was the applicant didn't have enough parking, but the applicant has increased the parking
places to 2,000. In response to Commissioner Conway, Mr. Haug explained this is a new event. The
parking requirements were discussed. Commissioner Kirkmeyer moved to approve said application and
authorize Chair to sign. The motion was seconded by Commissioner Freeman, and it carried
unanimously.
6) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY,
FOR CERTAIN IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN NECESSARY
DOCUMENTS - DOUGLAS AND LINDA RATZLAFF: Cameron Parrott, Department of Public Works,
reported the details of the purchase agreement for a total of $2,691.00 which will be paid by IHC.
Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. Seconded
by Commissioner Conway, the motion carried unanimously.
7) CONSIDER TEMPORARY CLOSURE OF CR 69 BETWEEN CRS 74 AND 80: Janet Lundquist,
Department of Public Works, reported the closure will be effective July 12, 2017, through July 21, 2017,
to install two (2) drainage pipes and complete earthwork. Commissioner Conway moved to approve said
closure. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
8) CONSIDER SETTLEMENT AGREEMENT AND RELEASE AND AUTHORIZE CHAIR TO SIGN
- SCOTT CONTRACTING, INC: Bob Choate, Assistant County Attorney, presented the final closeout
payment for the entire project of the Weld County Parkway in the amount of $214,594.00. Commissioner
Freeman moved to approve said settlement agreement and authorize Chair to sign. The motion was
seconded by Commissioner Moreno, and it carried unanimously. Commissioner Kirkmeyer thanked the
County Attorney's Office in reaching a fair settlement.
9) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE
SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO
CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Ms. Connolly presented the list of various
equipment that is ready for auction. Commissioner Freeman moved to approve said sale at auction and
delegate authority to the Controller to sign all necessary documents. Seconded by Commissioner
Moreno, the motion carried unanimously.
10) CONSIDER ACCEPTANCE OF GRANT OF RIGHT-OF-WAY FOR CR 35.5, NORTH OF CR 8:
Bruce Barker, County Attorney, presented the details of the property that was granted to Weld County
on April 29, 1974, by Quit Claim Deed from the Pilkingtons, but it was never accepted by the County
Commissioners. He stated the County was not aware they had received this property and it was brought
to Mr. Barker's attention by Anadarko who uses County Road 35.5 and County Road 8 to access the
well. In response to Commissioner Kirkmeyer, Mr. Barker stated there would be a question of ownership
and uncertain was how the turnout would be if the Commissioners did not accept the 40 -foot right-of-
way. After lengthy discussion, Chair Cozad stated her desire to continue this and have another work
session. Commissioner Kirkmeyer moved to continue said matter to August 9, 2017. Seconded by
Commissioner Moreno, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
