Responsibilities as a Permittee: Upon application approval and permit issuance, this application becomes a legally binding document. Therefore, there are a number of important requirements which you, as a permittee, should fully understand. These requirements are listed below. Please read and initial each requirement, in the space provided, to acknowledge that you understand your obligations. Ifyou do not understand these obligations then please contact this Office for a full explanation. 1. Your obligation to reclaim the site is not limited to the amount of the financial warranty. You assume legal liability for all reasonable expenses which the Board or the Office may incur to reclaim the affected lands associated with your mining operation in the event your permit is revoked and financial warranty is forfeited; (led 691 vet 541 2. The Board may suspend or revoke this permit, or assess a civil penalty, upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information. contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties, to you as permittee can result; 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modificationand obtain approval from the Board or Office; 5. It is your responsibility to notify the Office of anychanges in your address or phone number; 6. Upon permit issuance and prior to beginning on -site mining activity, you must post a sign at the entrance of the mine site, which shall be clearly visible from the access road, with the following information (Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. 7. The boundaries of the permit boundary area must be marked by monuments or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance, 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application, as well as with the provisions of the Act and the Construction Material Rules and Regulations in effect at the time the permit is issued. 9. Annually, on the anniversary date of permit issuance, you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date (if there are changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held.. For example, a permit with the anniversary date ofJuly 1, 1995, the annual fee is for the period ofJuly 1, 1994 through June 30, 1995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the permittee, to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. 10. For joint venture/partnership operators: the signing representative is authorized to sign this document and a power of attorney (provided by the partner(s)) authorizing the signature of the representative is attached to this application. NOTE TO COMMENTORS/OBJECTORS: : It is likely there will be additions, changes, and deletions to this document prior to final decision by the Office. Therefore, if you have any comments or concerns you must contact the applicant or the Office prior to the decision date so that you will know what changes may have been made to the application document. It will provide for reclamation of the Affected Lands appropriate to the subsequent beneficial use of such lands; and In the event of the failure of its proposed reclamation plan, it will take whatever measures may be necessary to assure the success of reclamation of the lands affected by such operations in accordance with the Act. F. A copy of the Permittee's application, as amended and supplemented, has been approved by the Board and is, by this reference, incorporated herein. G. The issuance of this permit does not relieve the Permittee from having to comply with all applicable Federal, State and County statutes, including State water law. GIANTS, CONDITIONS AND AGREEMENTS The Board, in reliance upon the representations and promises made in the permit application, as amended and supplemented, and the performance warranty, hereby issues a life of the mine permit to the Permittee, to engage in the operations described in the application on certain lands lying in theCounty of � ng � Weld, State of Colorado. These lands are described in the permit application, as amended and supplemented; and are referred to herein as the "Affected Lands". This permit is issued subject to the following conditions and agreements: I) The Pettnittee will be bound by all applicable requirements of the Act, and all applicable rules and regulations of the Board, as amended from time to time, the terms of the permit application, the terms of the performance warranty, and the terms of the financial warranty filed with the Division. 2) The Permitter will file with the Division its annual report and fees on each anniversary date of this permit. If analyses of the mining and reclamation operation and the data collected through monitoring and experimentation by the Permittee or monitoring by the Division indicate that the operation will not be able to comply with the requirements of the Act and applicable rules and regulations of the Board, the Permittee hereby agrees to exercise its best efforts, after consulting with the Division, to modify the plans to correct such deficiencies in the future. Such modifications may require technical revisions or amendments to the permit. Page 2 of 3 The Board or its authorized representative may enter upon the lands of the permitted operation at all reasonable times for the purpose of inspection to determine whether the provisions of the Act, Rules and Regulations, and permit have been complied with pursuant to C.R.S. 34-32.5-121. 5) This permit may be revoked or suspended for non-compliance with the Act or applicable rules or regulations promulgated by the Board, the permit, or by violation of a Board Order. 6) a) Pursuant to 34-32.5-118(5) of the Act, the Board has a right of entry to reclaim the lands affected by the operation or to respond to an emergency as defined by C.R.S. 34-32.5-121(2). The Board will enter the lands to perform reclamation only if the Board has determined that: i. Bradford Janes Varra Companies, Inc. 1431 East 16th Street Greeley, CO 80631 Dear Mr. Janes: Reference is made to► the above -mentioned site, located in Section 33, Township 3 North, Range 67 West, within Weld County, Colorado. Two isolated wetlands within the project area were determined to be non jurisdictional and will not be regulated under Section 404 of the Clean Water Act. This site has been reviewed in accordance with Section 404 of the Clean Water Act under which the U.S. Army Corps of Engineers regulates the discharge of dredged and fill material, and any excavation activity associated with a dredge and fill project in waters of the United States. Waters of the U.S. includes ephemeral, intermittent and perennial streams, their surface connected wetlands and adjacent wetlands, certain lakes, ponds, drainage ditches and irrigation ditches that have a nexus to interstate commerce. An approved jurisdictional determination (JD) has been completed for the above referenced project. The JD is attached to this letter. If you are not in agreement with the JD decision, you may request an administrative appeal under regulation 33 CFR 331, by using the attached Appeal Form. The request for appeal must be received within 60 days from the date of this letter. If you would like more information on the jurisdictional appeal process, contact this office. It is not necessary to submit a Request for Appeal if you do not object to the JD. Wetland #1 and 42 are isolated wetlands surrounded by uplands which do not provide surface water flows to a Traditionally Navigable Water (TNW) and do not have a significant nexus to interstate commerce. Therefore, these isolated wetlands are not considered waters of the US. • • • • • r • • • • • • • • • • • • • • • • • ■ • • • • • 4, • • • • • • • • • • ■ U ■ • • • • The Last Chance Ditch Lateral and the irrigation pond are preamble waters that were excavated in dry land for the purpose of containing irrigation water. In accordance with the 13 November 1986 Federal Register (Page 41217), the Corps of Engineers generally does not consider these irrigation ditches or artificial ponds created by excavating and diking dry land to collect and retain water for agricultural irrigation and stock watering as waters of the U.S. As such, the waters listed above are considered non -jurisdictional and are not waters of the U.S. This JD is valid for a period of five years from the date of this letter, unless new information warrants revisions of the JDs before the expiration date, or unless the Corps has identified, after a possible public notice and comment, that specific geographic areas with rapidly changing environmental conditions merit re -verification on a more frequent basis. Factors to consider include, for example: • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to carry pollutants or flood waters to TNWs, or to reduce the amount of pollutants or flood waters reaching a TNW? • Does the tributary, in combination with its adjacent wetlands (if any), provide habitat and lifecycle support functions for fish and other species, such as feeding, nesting, spawning, or rearing young for species that arc present in the TNW? • Does the tributary, in combination with its adjacent wetlands (if any), have the capacity to transfer nutrients and organic carbon that support downstream foodwebs? • Does the tributary, in combination with its adjacent wetlands (if any), have other relationships to the physical, chemical, or biological integrity of the TN W? The Last Chance Ditch is the nearest RPW, located approximately 1,500 feet west of Wetland l and 2 and flows into St. Vrain Creek, a TNW, approximately 5,200 feet northwest of the Study Area. The Last Chance Ditch Lateral is diverted off of Last Chance Ditch approximately 7,200 feet south and west of the Study Area and flows across the Study Area, ultimately terminating in an agricultural field. The Last Chance Ditch Lateral is constructed entirely in uplands, terminates in uplands and does not convey flows to a water of the U.S. In accordance with the 13 November 1986 Federal Register (Page 41217), the Corps of Engineers generally does not consider non -tidal drainage and an irrigation ditches excavated on dry land to be waters of the U.S., except on a case -by -case basis. In this case, there is no water flowing via the irrigation ditches to a water of the U.S. The Irrigation Pond located within the Study Area was excavated in dry land for the purpose of containing irrigation water. In accordance with the 13 November 1986 Federal Register (Page 41217), the Corps of Engineers generally does not consider artificial lakes or ponds created by excavating andlor diking dry land to collect and retain water and which are used exclusively for such purposes as stock watering, irrigation, settling basins, or rice growing to be waters of the U.S., except on a case -by -case basis. In this case, the Irrigation Pond is not considered a water of the U.S. Water diverted off the Last Chance Ditch Lateral comingles with relatively high groundwater levels in the area. Piezometers located throughout the subject property indicate that groundwater levels range from 4 to 24 feet below ground level throughout the year. The discharge of agricultural irrigation water, in combination with fluctuating groundwater levels, provides hydrology for Wetlands l and 2. However, Wetlands 1 and 2 are isolated from any other jurisdictional waters by over 2O00 feet. Both Wetlands 1 and 2 are located in a large depression which causes water to flow towards the wetland areas from the surrounding agricultural fields. No water leaves Wetlands 1 or 2 through a surface connection to an RPW. In addition, there is no information available to show that this wetland 1) is or could be used by interstate or foreign travelers for recreational or other purposes; 2) produces fish or shellfish which are or could be taken and sold in interstate or foreign commerce; or 3) is or could be used for industrial purposes by industries in interstate commerce.
