HomeMy WebLinkAbout20173915HEARING CERTIFICATION DOCKET NO. 2017-100 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0049, FOR A GREATER THAN 12 -INCH HIGH PRESSURE NATURAL GAS PIPELINE APPROXIMATELY 1.3 MILES LONG (16 -INCH NATURAL GAS PIPELINE ORIGINATING AT THE MEWBOURN GAS PLANT [MJUSR17-83-0542] AND TERMINATING AT THE COLORADO INTERSTATE GAS INTERCONNECT) IN THE A (AGRICULTURAL) ZONE DISTRICT — DCP OPERATING COMPANY, LP A public hearing was conducted on December 13, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated November 3, 2017, and duly published November 8, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of DCP Operating Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0049, for a greater than 12 -inch high pressure natural gas pipeline approximately 1.3 miles long (16 -inch natural gas pipeline originating at the Mewbourn Gas Plant [5MJUSR17-83-0542] and terminating at the Colorado Interstate Gas interconnect) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the construction easement and the permanent easements. He stated the total land impact is eleven (11) miles and the site is located in the three (3) mile referral area of the Town of Gilcrest, which responded with no concerns. He further reported the Colorado Parks and Wildlife Division responded with no concerns and History Colorado did not respond. Mr. Ogle explained the applicant will have an Emergency Action and Safety Plan and the pipelines will be designed and constructed in compliance with the U.S. Department of Transportation Pipeline and Hazardous Safety Administration part 192. He stated 14 referrals were sent with four (4) responses offering comments that have been considered in the staff recommendation. Mr. Ogle displayed the site map and entered the favorable recommendation of the Planning Commission into the record as written. GC.: PLC KO( MM),P£CHB). £HC(.L),C_TBCTT) cl.%/ QCo!18' 2017-3915 PL2507 HEARING CERTIFICATION - DCP OPERATING COMPANY, LP (USR17-0049) PAGE 2 • Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements, stating an Improvements Agreement is required and the applicant will need to submit evidence of a Right -of -Way Permit for any work that will occur in the right-of-way. Mr. Pinkham requested Conditions of Approval (COA) #1.E.8, 9 and 10 be deleted. • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements, stating pipelines are excepted from the requirements for a drainage report and detention pond design. She reviewed the Development Standards relevant to Engineering. Commissioner Freeman suggested, in regard to COA #5.A, to remove "such as structures, parking lots, laydown yards, et cetera". Ms. Balzano agreed with the recommendation, as did the Board. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stating portable toilets are acceptable along the construction route. She stated Development Standards (DS) #10-15 address Environmental Health items. Ms. Light recommended adding the words "during construction" to Development Standards #10 and 11. Commissioner Kirkmeyer suggested including DS #12. Ms. Light and the Board agreed to the changes. IR Patrick Groom, Attorney, represented the applicant and stated this is a discharge line that is proposed to be constructed from the new Mewbourn gas plant to connect to the Colorado Interstate Gas pipeline and it is approximately 1.3 miles in length and crosses two (2) parcels in addition to the parcel owned by DCP. He explained that DCP chose this route to avoid property owners on the west border of the Mewbourn property. He described the route in detail and stated all the rights -of -way have been obtained and he reviewed the construction schedule to commence after Christmas and be completed by May of 2018. Mr. Groom stated he had a conversation with Mr. Pinkham regarding the requirement for an Improvements Agreement and clarified DCP is willing to comply, but he requested the Board take into consideration the existing Improvements Agreement for the Mewbourn plant which may already meet that requirement; and if so, he is in favor of eliminating it from this Resolution. • No public testimony was offered concerning this matter. • In response to Chair Cozad, Mr. Pinkham stated Public Works supports the Board's decision to delete COA #1.D requiring an Improvements Agreement. In further response to Chair Cozad, Mr. Groom requested the Board consider deleting COA #1.B due to the redundancy in COA #1.E.12 which implies the requirement for a crossing agreement. The Board agreed to delete COA #1.B. la Commissioner Kirkmeyer suggested deleting COA #1.C. The Board agreed. • Chair Cozad reviewed the changes for the applicant. In response to Chair Cozad, Mr. Groom, on behalf of DCP Operating Company, LP, indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. 2017-3915 PL2507 HEARING CERTIFICATION - DCP OPERATING COMPANY, LP (USR17-0049) PAGE 3 Commissioner Freeman moved to approve the request of DCP Operating Company, LP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0049, for a greater than 12 -inch high pressure natural gas pipeline approximately 1.3 miles long (16 -inch natural gas pipeline originating at the Mewbourn Gas Plant [5MJUSR17-83-0542] and terminating at the Colorado Interstate Gas interconnect) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 11:55 a.m. This Certification was approved on the 18th day of December, 2017.
