RE: APPROVE AGREEMENT AMENDMENT #1 FOR DIRECT VICTIM SERVICES AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement Amendment #1 for Direct
Victim Services between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office,
and the Colorado Division of Criminal Justice, commencing January 1, 2018, and ending
December 31, 2018, with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement Amendment #1 for Direct Victim Services between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the 19th Judicial District Attorney's Office, and the Colorado Division of
Criminal Justice be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

Brief description of the problem/issue: VOCA Grant is a two-year grant 2017-2018. Weld County Resolution
approved on 11-8-16 regarding contract 2016-3225 DA0025 (attached)
DCJ (Division of Criminal Justice) has sent an AMENDMENT CONTRACT for 2018 (year two of the two-year
grant). The 2018 federal funded amount awarded is $104,822:
Personal of $95,293 which requires a match of $23,823 (funded by Weld County Government — this is
the same amount Weld County Government is presently funding for 2017)
Indirect Costs of $9,529 (not requested in 2017) which requires a match of $2,383 (funded by VALE)
DCJ needs two original contracts signed by Julie A. Cozad on PAGE 1 by November 27, 2017 to ensure
there is not a lapse of funding. After the contracts are signed by the governor and Colorado Department of
Public Safety, one original of the fully executed contract will be submitted to the Weld County Commissioners.
An electronic signature of Julie A. Cozad, Chair is needed for two additional forms: 1-DCJ FORM 30 (004) and
1 -Lobbying. These forms have been sent to the CTB email group to be signed electronically when the two
copies of the grant are signed in blue ink.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
Request approval of 2018 contract be signed so the 2018 VOCA funding can be awarded.

CERTIFICATIONS REGARDING LOBBYING; DEBARMENT, SUSPENSION AND
OTHER RESPONSIBILITY MATTERS; AND DRUG -FREE WORKPLACE REQUIREMENTS
Applicants should refer to the regulations cited below to determine the certification to which they are required to
attest. Applicants should also review the instructions for certification included in the regulations before completing this
form. Signature of this form provides for compliance with certification requirements under 28 CFR Part 69, "New

2. DEBARMENT, SUSPENSION, AND OTHER
RESPONSIBILITY MATTERS
(DIRECT RECIPIENT)
As required by Executive Order 12549, Debarment and
Suspension, and implemented at 28 CFR Part 67, for prospec-
tive participants in primary covered transactions, as defined at
28 CFR Part 67, Section 67.510—
A. The applicant certifies that it and its principals:
(a) Are not presently debarred, suspended, proposed for debar-
ment, declared ineligible, sentenced to a denial of Federal
benefits by a State or Federal court, or voluntarily excluded
from covered transactions by any Federal department
or agency;
(b) Have not within a three-year period preceding this applica-
tion been convicted of or had a civil judgment rendered against
them for commission of fraud or a criminal offense in connec-
tion with obtaining, attempting to obtain, or performing a
public (Federal, State, or local) transaction or contract under a
public transaction; violation of Federal or State antitrust
statutes or commission of embezzlement, theft, forgery,
bribery, falsification or destruction of records, making false
statements, or receiving stolen property;

3. DRUG -FREE WORKPLACE
(GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, and
implemented at 28 CFR Part 67, Subpart F, for grantees, as
defined at 28 CFR Part 67 Sections 67.615 and 67.620—
A. The applicant certifies that it will or will continue to provide
a drug -free workplace by:
(a) Publishing a statement notifying employees that the
unlawful manufacture, distribution, dispensing, possession, or
use of a controlled substance is prohibited in the grantee's
workplace and specifying the actions that will be taken against
employees for violation of such prohibition;
(b) Establishing an on -going drug -free awareness program to
inform employees about —
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug -free workplace;
(3) Any available drug counseling, rehabilitation, and employee
assistance programs; and
(4) The penalties that may be imposed upon employees for
drug abuse violations occurring in the workplace;
(c) Making it a requirement that each employee to be engaged
in the performance of the grant be given a copy of the state-
ment required by paragraph (a);
(d) Notifying the employee in the statement required by
paragraph (a) that, as a condition of employment under the
grant, the employee will—

(1) Abide by the terms of the statement; and
(2) Notify the employer in writing of his or her conviction for a

(e) Notifying the agency, in writing, within 10 calendar days
after receiving notice under subparagraph (d)(2) from an
employee or otherwise receiving actual notice of such convic-tion.
Employers of convicted employees must provide notice, including
position title, to: Department of Justice, Office of
Justice Programs, ATTN: Control Desk, 633 Indiana Avenue,
N.W., Washington, D.C. 20531. Notice shall include the iden-
tification number(s) of each affected grant;
(f) Taking one of the following actions, within 30 calendar
days of receiving notice under subparagraph (d)(2), with
respect to any employee who is so convicted
(1) Taking appropriate personnel action against such an
employee, up to and including termination, consistent with the
requirements of the Rehabilitation Act of 1973, as amended; or
(2) Requiring such employee to participate satisfactorily in a
drug abuse assistance or rehabilitation program approved for
such purposes by a Federal, State, or local health, law enforce-
ment, or other appropriate agency;
(g) Making a good faith effort to continue to maintain a drug -
free workplace through implementation of paragraphs (a), (b),
(c), (d), (e), and (f).

1. PARTIES
This Amendment (the "Amendment") to the Original Grant shown on the Signature and Cover
Page for this Amendment (the "Grant") is entered into by and between the Grantee, and the State.
2. TERMINOLOGY
Except as specifically modified by this Amendment, all terms used in this Amendment that are
defined in the Grant shall be construed and interpreted in accordance with the Grant.
3. AMENDMENT EFFECTIVE DATE AND TERM
A. Amendment Effective Date
This Amendment shall not be valid or enforceable until the Amendment Effective Date
shown on the Signature and Cover Page for this Amendment. The State shall not be bound
by any provision of this Amendment before that Amendment Effective Date, and shall have
no obligation to pay Grantee for any Work performed or expense incurred under this
Amendment either before or after of the Amendment term shown in §3.B of this Amendment.
B. Amendment Term
The Parties' respective performances under this Amendment and the changes to the Grant
contained herein shall commence on the Amendment Effective Date shown on the Signature
and Cover Page for this Amendment or January 1, 2018, whichever is later, and shall
terminate on the termination of the Grant.
4. PURPOSE
Extend the Year 1 project (01/01/17-12/31/2017) for another year (Year 2 - 01/01/17-12/31/2018),
in accordance with the original solicitation. The original grant agreement contained information
specific to the Year 1 work. This amendment reflects the Year 2 work.
5. MODIFICATIONS
The Grant and all prior amendments thereto, if any, are modified as follows:
A. The Grant Maximum Amount table on the Grant's Signature and Cover Page is hereby
deleted and replaced with the Current Grant Maximum Amount table shown on the Signature
and Cover Page for this Amendment.
B. Payment to Grantee, Use of Funds- Paragraph §7.C is replaced with the following:
"Grant Funds shall be used only for eligible costs identified herein and/or in the Budget.
Grantee may adjust the amounts between each line item of the Budget without formal
modification to this Agreement as long as the Grantee provides notice to the State of the
change and the State approves the change, the change does not modify the total maximum
amount of this Agreement and the change does not modify any requirements of the Work."
C. Exhibit Al — Special Conditions. The attached Exhibit Al is incorporated herein and
appends the original grant agreement.
D. Exhibit A2 — Grant Requirements
i. §8.a.3.c is replaced with the following sentence: (c) Use the phrase -"This project was

Grant dollars are being requested for the District Attorney's Office Victim
Witness Assistance Program to partially fund three Victim Assistants who
support and assist victims of domestic violence and juvenile offenders
throughout the criminal justice system. Victim Assistants help reduce the
overwhelming feelings victims many times have by emotionally supporting
victims, educating victims about the court system, and providing the many
referrals a victim needs when faced with becoming a victim of domestic
violence. Many times the Victim Assistants at the District Attorney's Office
are the first victim assistance contact the victim has had with a law
enforcement agency. The grant funding will provide assistance to 635
victims: 481 domestic violence victims (419 misdemeanor and 62 felony) and
154 victims of juvenile offenders.

The funding requested in this grant will enable the Weld County District
Attorney's Office to continue their proactive, immediate contact with victims of
domestic violence. The MISDEMEANOR DOMESTIC VIOLENCE FAST
TRACK PROGRAM was instituted in 2005 and provides immediate victim
assistance contact (the day after the crime) giving resources and Criminal
Justice System education to those most vulnerable. Victims of FELONY
DOMESTIC VIOLENCE CASES also come to court the day after the crime, but
prior to 2008, we had no process in place to know a new felony domestic
violence case was scheduled for an initial court hearing. These victims would
sit in crowded courtrooms with no one to answer their questions unless a Victim
Assistant happened to be in the courtroom for another matter. In 2008, we
received a VOCA Grant to fund part of one Victim Assistant to be assigned to
the victims of felony domestic violence. A process was created to identify all
new felony domestic violence cases on the docket each day to provide
immediate contact, support, and VRA and criminal justice system education.
Also, grant dollars are being requested for a VW Assistant dedicated to the
juvenile caseload to provide services to all VRA victims: felony 82 and
misdemeanor 158 a year. After having to downsize the unit in 2012, the
duties once assigned to a dedicated Juvenile VW Assistant were divided
among tow District Court VW Assistants. District Court has since experienced
an increase in felony caseload, and the increasingly limited support provided
to Juvenile cases has become neither effectual nor sustainable for the victims
our office serves.

RESOLUTION
RE: APPROVE AGREEMENT FOR DIRECT VICTIM SERVICES GRANT AND AUTHORIZE
CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Direct Victim Services
Grant between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office, and the
Colorado Division of Criminal Justice, commencing upon full execution, and ending December 31,
2017, with further terms and conditions being as stated in said grant agreement, and
WHEREAS, after review, the Board deems it advisable to approve said grant agreement,
a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Direct Victim Services Grant between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on
behalf of the 19th Judicial District Attorney's Office, and the Colorado Division of Criminal Justice
be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said grant agreement.

Brief description of the problem/issue:
Contract 2016-3225 (VOCA Grant) signed by Mike Freeman on October 17, 2016 ended up being the wrong
contract per an email from DCJ (Division of Criminal Justice) VW Director Holden has reviewed the updated
contract page by page to compare it to the contract which was signed on October I7th and determined all of the
legal terminology and monetary figures are the same. The changes ONLY have to do with statistical victims
served charts. Flere is a recap:
Pages 1 — 59 arc exactly the same in both contracts
Pages 60 — 64 in the new contract arc different from the contract signed on October 17''. Pages 61 & 62 have
different statistical data than the original contract. Pages 63 & 64 are also different charts but since our grant
has no data for these pages there are no changes.
Pages 65 - 94 are exactly the same as in both contracts other than the number is off one page number (original
contract started with Page 64).
DCJ needs two original contracts signed by Mike Freeman on PAGE 25.
Frank Haug, Assistant Weld County Attorney has been contacted regarding this situation and suggests the
updated contract be put on the consent agenda for Mike Freeman to sign.
What options exist for the Board? (Include consequences, impacts, costs, etc. of options)
Request approval of updated contract be signed so the 2017 VOCA funding can be awarded.
