RE: APPROVAL OF RECORDED EXEMPTION NO. 303 - JOHN A. SUTTER OF
SUTTER, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 15th day of February, 1978 , in the Chambers of
the Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of a certain parcel of land, as
shown on the plat known as Recorded Exemption No. 303 , being the
property of John A. Sutter of Sutter, Inc. , described as the
SEa of the SWa of Section 10, Township 6 North, Range 65 West
of the 6th P.M. , Weld County, Colorado, containing approximate-
ly 40 acres, more or less, and being more particularly de-
scribed as follows:
The Southeast Quarter (SEM) of the Southwest Quarter
(SWa) of Section Ten (10) , Township Six (6) North,
Range Sixty Five (65) West of the 6th P.M. , Weld
County, Colorado.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,

as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by John A. Sutter of Sutter, Inc. ,
be, and hereby is, exempt from the definition of the terms, "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 15th day of
February, A.D. , 1978.

Dear Commissioners :
The attached application, plat , and related items are in reference to a
request by John A. Sutter of Sutter , Inc . for a recorded exemption . The
property is described as SE*SWq Section 10, T6N, R65W of the 6th P.M. ,
Weld County, Colorado, containing approximately 40 acres . The location
is 1 mile north and 21 miles east of Lucerne. The request is to split
the property into parcels of 1 . 033 acres and 39 acres more or less . The
larger parcel contains an existing residence , out buildings , and cattle
feed lot area. The one acre parcel is a proposed building site for Mr .
and Mrs . John A. Sutter as indicated in a letter dated January 25 , 1978.
John Sutter and his father are the principal employees in the farming
and cattle feeding operations on the property in question .
On November 7 , 1977 , the Board of County Commissioners approved a request
by John A. Sutter of Sutter , Inc . for a lot size variance so that he
could make application for this recorded exemption . At the time they
made the decision on the request , the Department of Planning Services
Staff submitted a letter of recommendation to the Board. A copy of that
letter of recommendation is included in the attached packet . Nothing
has been received by our office which would change our recommendation
of approval for this request as outlined in the letter to the Board of
County Commissioners dated November 7 , 1977.

To Whom It May Concern:
On November ;', 1977, the Board of County Cnmais:ioners
granted me a lot size variance. At this time I wish to
apply for a recorded exemption, so that my wife and T
might get a permit to build a house.
We _plan to build this house adjacent to our feedlot.
Our operation is a family owned corporation involved
in forminr and cattle feeding. I wish to build close
to the feedlot for obvious reasons of being closer to my
work. Ey wife and I would also like to make a personal
invc.,tment of ea house and small acreage. I plan to remain
a major -eert of Sutter, Inc. , and I believe the house
will be an asset to me.
We -plan to use an existing domestic well for our water
It is an older well which to my knowledge does
not have a well number or adjudication number. A s. ,2tic
tank and leach field will be used for seware.

SUTTER, INCORPORATED.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has determined
at a public hearing held on the 7th day of November, 1977 , in
the Chambers of the Board of County Commissioners of Weld County ,
Colorado, that a certain parcel of land is owned by John A. Sutter
of Sutter, Incorporated, which land is more particularly described
as follows , to-wit:
The SE' of the SW4 of Section 10 , T6N,
R65W of the 6th P .M. , Weld County,
Colorado containing approximately 40 acres.
WHEREAS , the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that Mr.
Sutter may make application to the Board of County Commissioners
to apply for a recorded exemption, as set forth in Section 9-4 .
A. (6 ) of the Subdivision Regulations , and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado , based upon the recommendations of the Department of
Planning Services , feels that the applicant has shown good cause
for granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations .

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements, be , and hereby is , granted to John Sutter of
Sutter Incorporated for the above described parcel of land.

Dear Commissioners : -
The attached letter and related materials are in reference to a request by
John A. Sutter of Sutter, Incorporated for a lot size variance. The sub-
ject property is described as the SE* of the SW* of Section 10, T6N, R65W
of the 6th P.M. , Weld County, Colorado containing approximately 40 acres.
The location is 1 mile north and 2a miles east of Lucerne. The request is
to obtain a variance from the minimum lot size requirement (Section 9-4a(6) )
so that Mr. Sutter may make application to apply for a recorded exemption.
Section 9-4a(6) states :
"The Board shall not approve the exemption of the proposed
land division unless it finds that the original tract or
parcel of land to be divided under this section meets the
minimum lot size requirements established by the Weld County
Zoning Resolution; variance from this requirement being
allowed only upon good cause being shown to the Board of
County Commissioners or where said tract or parcel of land
lies within the Comprehensive Plan area of an existing in-
corporated town of Weld County. (Revised 4/17/76)"
If this lot size variance is granted, Mr. Sutter will proceed with his
application for a recorded exemption to divide the property into two lots.
One lot is proposed to contain approximately 38 acres with an existing
residence, out buildings, and cattle feed lot area. The second lot is
proposed to contain approximately 2 acres which is to be a new homesite
for Mr. and Mrs. John A. Sutter as indicated in a letter dated October 14,
1977. John Sutter and his father are the principal employees in the farming
and cattle feeding operations on the property in question.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services staff recommends the request be approved
for the following reasons :

1 . The proposed split conforms with the intent clause of
the Agricultural District (Section 3 . 3a of the Weld
County Zoning Resolution) and the Weld County Compre-
hensive Plan since the use would be compatible with

SPECIAL MEETING OF THE DIRECTORS
OF
SUTTER, INC.
Greeley, Colorado
September 10, 1965
A special meeting of the directors of Sutter, Inc . was
held on the above mentioned date, immediately following the
organization meeting of the incorporators. All the directors
were present and all waived notice of the meeting.
Ted P. Sutter called the meeting to order and stated
that the purpose of the meeting was to elect officers of
the company.
The following officers were nominated, the nominations
were seconded, and upon vote unanimously carried:
President Ted P. Sutter
Vice President W. H. Huneke
Secretary-Treasurer Dorothy A. Sutter
There being no further business to come before the meeting,
the meeting was duly adjourned.

To Whom It May Concern:
My wife and I are planning to build a house near our
feedlot. I wish to apply for a lot size variance so
that we might be able to get a recorded exemption.
Our operation is a family owned corporation involved
in farming and cattle feeding. My father and I are
the principle employees. At present, I live one mile
away from the feedlot and on many occasions I would
be able to work more efficiently living right next to
the feedlot. My wife and I would also like to own a
small acreage and house as a personal investment since
the farming and feeding are a family enterprise. My
father's involvement will be decreasing in future years
and I plan to be completely taking over when the time
comes.
We plan on using the two existing domestic wells located
within 150 yards of our planned homesite. A plot plan
and a copy of the deed are attached.
