The pipelines would exit from launchers at the Crossroads Booster Station and head south approximately 0.1 miles where it would turn east and travel 0.25 miles where they terminate at receivers along the Mewbourn 160 Pipeline. The pipelines would be constructed within a 100 -foot temporary ROW. Once the pipelines have been installed, the temporary ROW will be returned to its pre -construction contours and reclaimed. The permanent maintenance easement (right-of-way) for each pipeline will be 30 -feet; however, this land will be returned to the surrounding land use during the operational period. As the pipelines are located approximately 20 feet apart, the combined permanent maintenance easement (right-of-way) would be 50 feet. Permanent, aboveground equipment will include two launchers at the Crossroads Booster Station and two receivers along the Mewbourn 160 Pipeline. Total land impacts during construction will be approximately 4.2 acres, while the permanent easement (right-of-way) will cover approximately 2.1 acres. DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-480 of the Weld County Code as follows: USR17-0048 DCP Midstream, LP Page 2 of 9 A. Section 23-2-480.A.1 - All reasonable efforts have been made to avoid irrigated cropland or to minimize the negative impacts on agricultural uses and lands. The application indicates that the pipeline will be located on lands owned by the applicant and are in dryland agriculture. All soils removed for installation of the pipeline will be returned to their original location and will not be moved offsite. The preferred pipeline route minimizes environmental impacts such as wetland areas, water bodies and agricultural lands. B. Section 23-2-480.A.2 - The pipeline will not have an undue adverse effect on existing and future development of the surrounding area, as set forth in applicable Master Plans. The pipeline is not located within the 3 -mile referral area of a municipality or County. C. Section 23-2-480.A.3 - The design of the proposed pipeline mitigates negative impacts on the surrounding area to the greatest extent feasible. The application indicates that the pipeline will be located on lands owned by the applicant and are in dryland agriculture. D. Section 23-2-480.A.4 - The site shall be maintained in such a manner so as to control soil erosion, dust and the growth of noxious weeds. The Conditions of Approval and Development Standards will ensure that there is no fugitive dust or erosion and will ensure the control of noxious weeds. Best Management Practices (BMPs) will be required for all construction areas, including erosion control methods, dust suppression, et cetera. E. Section 23-2-480.A.5 -- The applicant has agreed to implement any reasonable measures deemed necessary by the Board of County Commissioners to ensure that the health, safety and welfare of the inhabitants of the County will be protected, and to mitigate or minimize any potential adverse impacts from the proposed pipeline. All pipelines will be compliant with the DOT requirements. Per this standard, pipelines are required to have a minimum of 30 -inches of cover or greater if required by local or state agencies. The pipeline trench will be excavated mechanically; pipe segments will then be strung along the ditch line and then welded together using welders and weld procedures qualified under the requirements of the Code of Federal Regulations; each weld will be examined utilizing industry standard non-destructive examination, or x-ray, procedures by qualified technicians; the coating on the pipeline will be inspected for damage and repaired as necessary and then the line(s) will be lowered into the trench and backfilled. The pipeline(s) will subsequently be pressure tested using water (hydrostatically tested) to industry regulations. F. Section 23-2-480.A.6 - All reasonable alternatives to the proposal have been adequately assessed, and the proposed action is consistent with the best interests of the people of the County and represents a balanced use of resources in the affected area. This route was selected as the preferred project route as it balances environmental sensitivity, operational efficiency, cost minimization, and adjacent landowner considerations. As such, DCP has proposed this alignment as the preferred route as it helps meet the operational needs of the project while minimizing impacts to the surrounding community and environment. In the early planning stages, DCP considered alternative route options through the property; however, the DCP generally decided to site the pipelines as close to the southern edge of the property as possible in order to make inspection access easier and to reduce the potential for interruption to agricultural activities in the nearby field and other resources. Section 23-2-480.A.7 - The nature and location or expansion of the pipeline will not unreasonably interfere with any significant wildlife habitat and will not unreasonably affect any endangered wildlife species, unique natural resource, known historic landmark or archaeological site within the affected area. Colorado Parks and Wildlife returned a referral dated September 18, 2017 indicating no conflict with their interests and History Colorado did not return a referral response. H. Section 23-2-480.A.8 - No adverse impact, from stormwater runoff, to the public rights -of -way and/ or surrounding properties as a result of the pipeline. The applicant will be required to maintain historic flow patterns and runoff amounts, per the Department of Planning Services, engineering review stated a drainage plan will be not be required for this project. Section 1.A.5 of the drainage criteria provides an exception for pipelines and transmission lines. DCP Midstream acknowledges in their application that the historical flow patterns and runoff amounts will be maintained on the site or in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23- 2-250, Weld County Code), Conditions of Approval and Development Standards can ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording the map: A. A copy of the signed and recorded (construction and post -construction) lease agreements (or other acceptable authorization from property owner) for pipeline right-of-way (easements) shall be submitted to the Department of Planning Services. (Department of Planning Services) B. An Improvements and Road Maintenance Agreement is required for offsite improvements at this location. Road maintenance including, but not limited to dust control, tracking control, damage repair, specified haul routes and future traffic triggers for improvements will be included. (Department of Public Works) C. The map shall be amended to delineate the following: 1. All sheets of the map shall be labeled USR17-0043 (Department of Planning Services) 2. The attached Development Standards. (Department of Planning Services) 3. The map shall be prepared in accordance with Section 23-2-520 of the Weld County Code. (Department of Planning Services) 4. The final location of the permanent gas pipeline easement with dimension of permanent easement, property ownership, parcel number, and any significant man-made features within one-half (0.5) mile on each side of the approved route. County Road 44 is a paved road and is designated on the Weld County Functional Classification Map as a collector road which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. (Department of Public Works) 7. County Road 49 is designated on the Weld County Classification plan as an arterial road which typically requires 140ft of right-of-way at full build out. Weld County is currently in the process of widening this corridor. The alignment of the road widening project varies along the section line for the corridor. Contact Public Works for the location of the existing and future right of way and easements and delineate these on the site plan. (Department of Public Works) 8. If required, show and label the approved access(es) (APXX-XXXXX), XX), and the appropriate turning radii (60 -feet) on the site plan. (Department of Public Works) 9. Show and label the entrance gate, if applicable. An access approach that is gated shall be designed so that the longest vehicle (including trailers) using the access can completely clear the traveled way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be less than 35 feet. (Department of Public Works) 10. Show and label all recorded easements on the map by book and page number or reception number and date on the plan. (Department of Planning Services) 2. Upon completion of Condition of Approval #1 above, the applicant shall submit one (1) paper copy or one (1) electronic copy (.pdf) of the map for preliminary approval to the Weld County Department of Planning Services. Upon approval of the map the applicant shall submit a Mylar map along with all other documentation required as Conditions of Approval. The Mylar map shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The map shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar map and additional requirements shall be submitted within one hundred twenty (120) days from the date of the Board of County Commissioners Resolution. RIGHT T4 EXTRACT MINERAL RESOURCES STATEMENT : Weld County has some of the most abundant mineral resources , including , but not limited to , sand and grauel , oil , natural ga� , and caal . Under titl � 34 of the Colorado Revised 5tatutes , minerals are vital resources because (a ) the state '� commercial mineral deposits are essential to the state' s economy; ( b ) the populous caunties of the state face a critical shortage of such depo� its ; and ( c) such deposits should be extracted according to a ratianal plan, calculated to avoid waste of such deposit� and cause the lea �t practicabl � disruption of the ecology and quality of life of the citizens of the populous c4unties af the state . Mineral resaurce locatians are widespread throughout the County and persan moving into the�e ar�as must recognize the various impacts associated with this development. Often time� , mineral resource � ites are fixed to their geographical and geaphy� ical locations . Moreover, these resource� are protected property right� and mineral owners should be afforded the opportunity to extract the mrneral re� ource . 21 . WELD CDUNTY' 5 RIGHT TQ FARM : Weld Caunty is one of the most productive a�ricultural countie� in the United States , typically ranking in the top ten caunties in the country in tatal market value af agricultural products sald . The rural areas of Weld County may be open and spacious , but they are intensively used for agriculture . Persons maving inta a rural area must reeognize and aceept there are drawbacks , including canflicts with long -standing agricultural practices and a lower level of services than in tawn . Along with the drawbaeks come the incentives which attract urban dwellers to relocate to rural areas : open views , spaciousness , wildlife , lack af city noise and congestian , and the rural atmasphere and way of life . Withaut neighboring farms , those features which attract urban dwellers ta rural 'Weld County would quickly be gane farever . Agricultural users af the land shauld nat be expected to change their long-established agricultural practiees ta accommodate the intrusions af urban users into a rural area . Well - run agricultural actiuities will generate off-site impacts , including noise from tractors and equipment; slow-moving farm vehieles an rural roads ; dust from animal pens , field work , harvest and gravel roads ; adar fram animal confinement, silage and manure; smake fram ditch burning ; flies and masquitoes ; hunting and U S R17-0048 DCP Midstream , LP Page 8 of 9 trapping activitie� ; shooting sports , legal hazing of nuisance wildlife, and the use of pesticides and fertilizers in the fields , including the use of aerial spraying . It is common practice for agricultural produeers to utilize an accumulation af agricultural machinery and supplies to assist in their agrieultural aperations . A concentration af miscellaneaus agricultural materials often produces a visual disparity between rural and urban areas of the County . Sectian 35- 3 . 5 - 102 , C . R. 5. , pravides that an agricultural operation shall not be faund to be s publie or private nuisance if the agricultural operation alleged ta be a nuisance employs methads or practiees that are commonly ar reasonably assaciated with agricultural production . Water has been , and cantinues to be , the lifeline for the agricultural community . It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" af residential develapment . When moving to the Caunty, praperty awners and residents must realize they cannot take water fram irrigatian ditches , lakes , ar other structures , unless they have an adjudicated right to the water . Weld Co�unty cavers a land area af approximately four thausand (4 , D00 ) square miles in size (twice the size af the State af Delaware ) with more than three thousand seven hundred (3 , 700 ) miles af state and county roads outside of municipalities . The sheer magnitude af the area to be served stretches available resources . Law enfarcement is based on respanses to camplaints mare than on patrols af the County , and the distances which must be traveled may delay all emergency responses , including lauu enfarcement, am � ulance , and fire . Fire protection is usually provided by volunteers who mu �t leave their jobs and families to respond to emergencies . County gravel roads , no matter how often they are bladed , will not provrde the same kind of surface expected from a paued raad . Snow removal prioritie � mean that roads from � ubdivisions to arkerials may not be cleared for several days after a major snowstarm . 5ervice� in rural areas , in many cases , will not be equivalent ta municipal services . Rural dwellers must, by necessity, be more �elf-sufficient than urban dwellers . People are expased to different hazard � in the County than in an urban or � uburban setting . Farm equipment and ail field equipment , ponds and irrigation ditche� , electrical power for pumps and center pivat aperations , high sp �ed traffic , sandburs „ puncture vines , territorial farm dog� and livestock , and open burning present r�al threats . Dear Applicants: I ha�e scheduled a meeting with the Weld County Planning Commission on November 21, 2017, at 12:30 p.m. A subsequent hearing with the Board of County Commissioners will be held on December 6, 2017 at 10:00 a.m. Both hearings will be held in the Hearing Room, Weld County Administration Building, 1150 O Street, Greeley, Colorado. Colorado Revised Statute, C.R.S.24-65.5-103 (adopted as part of H.B.01-1088) requires notification of all mineral estate owners 30 days prior to any public hearing. The applicant needs to provide the Weld County Planning Department with written certification indicating the above requirement has been met. A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and a second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.
