HomeMy WebLinkAbout20172993HEARING CERTIFICATION DOCKET NO. 2017-71 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0026, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT (SECOND DWELLING UNIT) PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A IN THE A (AGRICULTURAL) ZONE DISTRICT — K&M COMPANY, LLLP A public hearing was conducted on September 13, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Ryder Reddick Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 28, 2017, and duly published August 2, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of K&M Company, LLLP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0026, for One (1) Single -Family Dwelling Unit (second dwelling unit) per lot other than those permitted under Section 23-3-20.A in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Ryder Reddick, Department of Planning Services, presented a brief summary of the proposal to build a second single-family dwelling to house an employee who assists with the care of the actively farmed 145 -acre site. He reviewed the Code criteria met by the applicant and stated the site is located within the three (3) mile referral area of the Towns of Severance and Windsor; however, neither jurisdiction returned referral comments. He displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. Evan Pinkham, Department of Public Works, provided a brief overview of the transportation plans and requirements and stated an Access Permit, AP17-00314, has been approved and stipulates to utilize the existing access points. He provided the average traffic counts and stated no tracking control or Improvements Agreement will be required. Gam: PLC RRIMtn),PECH6), HLCLL), CTBCTJ) tOttttt1 2017-2993 PL2490 HEARING CERTIFICATION - K&M COMPANY, LLLP (USR17-0026) PAGE 2 El Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements and stated the site qualifies for Drainage Exception 1.A.3 for a second dwelling in the Agricultural Zone District. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated water service is provided by the North Weld County Water District and a new septic will need to be installed. She noted the Department of Public Works has no outstanding issues with this request and she recommended deleting Development Standards (DS) #3, 4, and 7. Thomas Moore, applicant, stated he is representing his family business and they need another house on the site for another employee to aid in the farming operations. El No public testimony was offered concerning this matter. • In response to Chair Cozad, Mr. Moore indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards and has no concerns. • Commissioner Freeman recommended deleting Condition of Approval, COA #1.6.8. Commissioner Kirkmeyer suggested deleting COA #1.A. Commissioner Freeman further recommended deleting DS #3, 4, 7, 9, and 10. Commissioner Kirkmeyer recommended deleting DS #14. The Board agreed to the changes. EI In response to Chair Cozad, Mr. Moore indicated he understands the changes and agrees to abide by the Conditions of Approval and Development Standards, as amended. • Commissioner Freeman moved to approve the request of K&M Company, LLLP, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0026, for One (1) Single -Family Dwelling Unit (second dwelling unit) per lot other than those permitted under Section 23-3-20.A in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway. Chair Cozad expressed her appreciation for the applicant providing housing for his employees. Commissioner Conway echoed those comments.
