HomeMy WebLinkAbout20170435.tiffRESOLUTION RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING AMENDED USE BY SPECIAL REVIEW PERMIT, AMUSR-686 - MARTIN AND JOHANNA BANGMA 1989 TRUST/MILE HIGH DAIRY, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 8th day of February, 2017, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Martin and Johanna Bangma 1989 Trust/Mile High Dairy, LLC, 1643 Harlequin Drive, Longmont, Colorado 80504, was in compliance with certain Development Standards contained in Amended Use by Special Review Permit, AMUSR-686, for a Livestock Confinement Operation (1,940 -head dairy, including milking cows, dry cows, heifers, and calves), and one single-family dwelling unit per lot, other than those permitted under Section 23-3-20.A of the Weld County Code (two single-family employee homes), in the A (Agricultural) Zone District, and WHEREAS, the alleged violations were said to be occurring on property described as a parcel being part of the E1/2 of Section 17, and part of Lot B of Recorded Exemption #525, also being part of the E1/2 of Section 17; all within Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after hearing testimony from the Department of Planning Services, the Board found that pursuant to the procedure as set forth in Chapter 2, Administration, of the Weld County Code there is not sufficient probable cause to schedule a Show Cause Hearing to consider whether or not said Amended Use by Special Review Permit should be revoked for failure to comply with certain Development Standards, and WHEREAS, the Board directed staff to review and modify the Improvements Agreement concerning proper landscaping/buffering for future review by the Board. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Probable Cause hearing to determine whether or not Amended Use by Special Review Permit, AMUSR-686, issued to Martin and Johanna Bangma 1989 Trust/Mile High Dairy, LLC, should be revoked, be and hereby is, dismissed. As a result of 'these inspections it has been determined that you are not in compliance with the following conditions of Development Standards: Standard 26 The applicant shall adhere to the approved landscaping and screening plan. Standard 39 The Amended Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans a Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. Standard 40 The property owner or operator shall be responsible for complying with all of the foregoing development standards. Noncompliance with any of the foregoing development standards may be reason for revocation of the permit by the Board of County Commissioners. Tim indicated that the applicant planted all the trees shortly after the TJSR was approved, but the trees died. No one from the County came out to inspect once the trees were planted and to take pictures. I want to say the development standards talk about a landscaping plan but I don't think an actual plan was put together and the tress are just shown on the USR map. With that said, I think that the owner has to maintain the landscaping. Do we have anything in the code that talks about landscape replacement or warranty periods? This has been a bit of an unusual situation as I was not the Planner who originally processed the case - the Planner who processed the ease left before the plat was recorded. However, when I got the request this year I went back out to inspect - I was prepared to release the entire amount to rectify this situation. However, there are no trees out there and the recorded USR plat (approved by the Board of County Commissioners) has trees on it. I spoke to my supervisors and we cannot release collateral for the trees because it is shown on the USR plat. Even if we had release collateral back in 20 (2 - if we received a call/complaint today about no trees being on site - you would be out of compliance with your TAR permit (because trees are shown on the attached recorded USR plat). That is why the discussion came up about either collateralizing for the trees and releasing for the fence or just releasing the entire amount. In talking to Public Works and our County Attorneys the preferred route is to release the entire amount in one action once the trees are planted in the Summer. We no longer do partial releases such as this. The other option, given these circumstances, is to proceed with doing a partial release of collateral for the fence and hold the amount for the trees. Then, upon planting the trees, you send the photos and submit a request to release the remainder of the collateral. If you proceed with the partial release - please fill out and sign the attached exhibit with the revised amount for the trees. FYI: Normally, the sales tax would be required to be included in the collateral amount provided, however, staff has agreed to waive the amount for this case. Let me know how you wish to proceed. Parcel number 120717000014. Access is from CR 5. Roads & Access: County Road 5 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road, which requires 140 feet of right-of-way at full buildout, Latest ADT on CR 5 was taken in June 2014 which counted 1061 vpd with 12% trucks, Portions of CR 5 were annexed by the Town of Mead_ The section of roadway that are Green are maintained by Weld County The USR and AMUSR were both processed prior to the creation of the Access Permit. After reviewing historic aerial photos it appears that the site had 5 existing access points. As shown in the 2008 Aerial shown below: As part of the AMUSR-686 the applicant was instructed to close the southernmost access point. From the 2014 aeriall you can see that this was accomplished and only 4 access points remain. Shilardueei (303)775-4090 regarding Mile High Dairy located at 15333 CFA 5. The complaint was about a number of things, most of which were EH related and were unfounded, He also voiced a complaint that the facility currently has more than the allowable 1,940 head onsite. Is that an issue that you would follow upon? Thank you! When they went in front of weld county to expandthe dairy by one hundred and seventy three head they showed drawing of shed on the property with trees along the road. They have the plastic: from silage pits that they bring in that blows into my ditch :arm land ,fence and trees. The dust from the truck driving over the dirt turn it into find dust and as soon as the wind blows it blows right into me so thick you can't see across the road, I have talk to Wes Bangman and he will put down some water if he knows I'm watching but by the end or the day it a dust bowl. I can't even have my windows open or enjoy my farni outside or the extra work it cause me with that comes from the dairy .Wes lives in town so he not their to see what goes on and yes I call him. But I think that Weld County has a rail in this to enforce what they approved. Why should I be the one complaining or other farms around me come and complain to me knowing that I will send note to you.. This is all 20 yard for my front porch. As being a second generation Colaradoan and have lived in weld county for over 25 years the biggest thing is to be able to ve w our mountain.
