RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING CONCERNING AMENDED
USE BY SPECIAL REVIEW PERMIT, AMUSR-686 - MARTIN AND JOHANNA
BANGMA 1989 TRUST/MILE HIGH DAIRY, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 8th day of February, 2017, a Probable Cause Hearing was held before
the Board to consider setting a Show Cause Hearing to determine whether or not Martin and
Johanna Bangma 1989 Trust/Mile High Dairy, LLC, 1643 Harlequin Drive, Longmont, Colorado
80504, was in compliance with certain Development Standards contained in Amended Use by
Special Review Permit, AMUSR-686, for a Livestock Confinement Operation (1,940 -head dairy,
including milking cows, dry cows, heifers, and calves), and one single-family dwelling unit per lot,
other than those permitted under Section 23-3-20.A of the Weld County Code (two single-family
employee homes), in the A (Agricultural) Zone District, and
WHEREAS, the alleged violations were said to be occurring on property described as a
parcel being part of the E1/2 of Section 17, and part of Lot B of Recorded Exemption #525, also
being part of the E1/2 of Section 17; all within Township 3 North, Range 68 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, after hearing testimony from the Department of Planning Services, the Board
found that pursuant to the procedure as set forth in Chapter 2, Administration, of the Weld County
Code there is not sufficient probable cause to schedule a Show Cause Hearing to consider
whether or not said Amended Use by Special Review Permit should be revoked for failure to
comply with certain Development Standards, and
WHEREAS, the Board directed staff to review and modify the Improvements Agreement
concerning proper landscaping/buffering for future review by the Board.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Probable Cause hearing to determine whether or not Amended Use by
Special Review Permit, AMUSR-686, issued to Martin and Johanna Bangma 1989 Trust/Mile High
Dairy, LLC, should be revoked, be and hereby is, dismissed.
BE IT FURTHER RESOLVED by the board that staff is directed to review and modify the
Improvements Agreement concerning proper landscaping/buffering for future review by the
Board.

Dear Mr. McCrimmon,
Notice is hereby given that on or as soon thereafter as the agenda of the Board of County Commissioners
permits, the Board of County Commissioners of Weld County will hold a Probable Cause public hearing
pursuant to Chapter 23, Article 11(2), Division 4, Section 23-2-270 of the Weld County Code. This meeting
will take place at 9 AM on Wednesday, February 8, 2017 in the Commissioner's Hearing Room, Weld
County Administration Building, 1150 0 Street, Greeley, Colorado.
The purpose of this public hearing wi I be to review case number AMUSR-686 for comp lance with the
Development Standards as approved by the Board of County Commissioners or May 21st, 2006 to
determine if probable cause exists to hold a hearing of revocation of AMUSR-726.
The Weld County Departments of Planning Services has inspected and o bse rved that trees have net
been planted along County Road 5 as delineated on the recorded AM U SR -688 plat and that additional
calf huts, hay bales and vehicle circulation areas have been added to the north and outside of the
boundaries of AMLJSR-555 as delineated on the recorded AMLJSR-688 plat. As a result of 'these
inspections it has been determined that you are not in compliance with the following conditions of
Development Standards:
Standard 26 The applicant shall adhere to the approved landscaping and screening plan.
Standard 39 The Amended Use by Special Review area shall be limited to the plans shown
hereon and governed by the foregoing standards and all applicable Weld County
regulations. Substantial changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by the
Weld County Board of County Commissioners before such changes from the
plans a Development Standards are permitted. Any other changes shall be filed
in the office of the Department of Planning Services.
Standard 40
The property owner or operator shall be responsible for complying with all of the
foregoing development standards. Noncompliance with any of the foregoing
development standards may be reason for revocation of the permit by the Board
of County Commissioners.
If it is determined at the public hearing that there is probable cause that you are not in compliance with
AMUSR-686, the Board of County Commissioners will schedule a Show Cause public hearing to consider
revocation of the Use by Special Rev'ew permit,

Dear Mile High Dairy LLC,
Please be advised that a complaint has been received by the Department cf Planning Services' staff that
uses on your property may not be in compliance with AMUSR-686.
The fallowing is a summary of the complaint:
Dust and plastic blowing from the silage pit/truck parking area.
Additionally, upon review of the AMUSR-686 plat it has been noted that the trees indicated on the
AMU R-686 plat are not on site.
AMUSR-686 Development Standards 9, 18, 26, 27, 30, 39 and 40 state:
The applicant shall control fugitive dust on this site and operate in accordance, at all times, with the
current approved Management Plan fo►r Nuisance Control.
Waste materials, not specifically addressed by other Development Standards, shall be handled, stored
and disposed of in a manner that controls fugitive dust, blowing debris and other potential nuisance
conditions.
The applicant shall adhere to the approved landscaping and screening plan.
The property owner or operator shall be responsible for complying with the Design Standards of Section
23-2-240 of the Weld County Code.
The property owner or operator shall be responsible for complying with the Miscellaneous Regulations
Regarding Livestock Feeding Performance Standards (Section 23-4-710 of the Weld County Code),
The Amended Use by Special Review area shall be limited to the plans shown hereon and governed by
the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans
or Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.
Failure to contact the Department of Planning Services within ten (10) working days from the date listed
above will result in a probable cause hearing being scheduled before the Board of County Commissioners.

So I got a call from you know who on this and perhaps we can group on it sometime early next week. Tim indicated
that the applicant planted all the trees shortly after the TJSR was approved, but the trees died. No one from the
County came out to inspect once the trees were planted and to take pictures. I want to say the development standards
talk about a landscaping plan but I don't think an actual plan was put together and the tress are just shown on the
USR map. With that said, I think that the owner has to maintain the landscaping. Do we have anything in the code
that talks about landscape replacement or warranty periods? Is it possible for the County to go back and require
someone to replace landscaping if the landscaping dies?

Dear Kelly,
In answer to your question - I am sorry - I am not sure what happened back in 2012. This has been a bit of an
unusual situation as I was not the Planner who originally processed the case - the Planner who processed the ease
left before the plat was recorded. However, when I got the request this year I went back out to inspect - I was
prepared to release the entire amount to rectify this situation. However, there are no trees out there and the recorded
USR plat (approved by the Board of County Commissioners) has trees on it. I spoke to my supervisors and we
cannot release collateral for the trees because it is shown on the USR plat. Even if we had release collateral back in
20 (2 - if we received a call/complaint today about no trees being on site - you would be out of compliance with your
TAR permit (because trees are shown on the attached recorded USR plat).
That is why the discussion came up about either collateralizing for the trees and releasing for the fence or just
releasing the entire amount. In talking to Public Works and our County Attorneys the preferred route is to release the
entire amount in one action once the trees are planted in the Summer. We no longer do partial releases such as this.
The other option, given these circumstances, is to proceed with doing a partial release of collateral for the fence and
hold the amount for the trees. Then, upon planting the trees, you send the photos and submit a request to release the
remainder of the collateral. If you proceed with the partial release - please fill out and sign the attached exhibit with
the revised amount for the trees.
FYI: Normally, the sales tax would be required to be included in the collateral amount provided, however, staff has
agreed to waive the amount for this case.

COMMENTS:
General Project Information!Location:
This project is west of and adjacent to CR 5 and is north of CR 32. Parcel number 120717000014.
Access is from CR 5.
Roads & Access:
County Road 5 is a paved road and is designated on the Weld County Road Classification Plan as a arterial
road, which requires 140 feet of right-of-way at full buildout, Latest ADT on CR 5 was taken in June 2014
which counted 1061 vpd with 12% trucks,
Portions of CR 5 were annexed by the Town of Mead_ The section of roadway that are Green are maintained
by Weld County
The USR and AMUSR were both processed prior to the creation of the Access Permit. After reviewing
historic aerial photos it appears that the site had 5 existing access points. As shown in the 2008 Aerial
shown below:
As part of the AMUSR-686 the applicant was instructed to close the southernmost access point. From the
2014 aeriall you can see that this was accomplished and only 4 access points remain.
Service Calls .& Complaints:
Public Works received the following] service calls in this area from 2011 to the present,
-3/21/14 pothole reported (repaired 3/27/14)
- 3/25/14 pothole reported (repaired 3/27/14) and tracking from the dairy
- 5/7/14 Tracking complaint from the dairy
-5/14/15 Question regarding a road closure
-5/19/15 Complaint regarding road closure

We received a complaint yesterday from Jack. Shilardueei (303)775-4090 regarding Mile High Dairy
located at 15333 CFA 5. The complaint was about a number of things, most of which were EH related
and were unfounded, He also voiced a complaint that the facility currently has more than the
allowable 1,940 head onsite. Is that an issue that you would follow upon? Thank you!

screening plan.
AMUSR 686 Development Standard #39 states: The Amended Use by Special Review area shall be limited to the
plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations.
Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an
amendment t of the Permit by the Weld County Board of County Commissioners before such changes from the plans
or Deve1opme: t Standards are permitted. Any other changes shall be filed in the office of the Department of
Planning Services.
AMUSR 686 Development Standard #40 states: The property owner or operator: shall be responsible for complying
with all of the foregoing development standards. Noncompliance with any of the foregoing development
standards may be reason for revocation of the permit by the Board of County Commissioners.

would like to understand how weld county let's this dairy do what ever it wants . When they
went in front of weld county to expandthe dairy by one hundred and seventy three head they
showed drawing of shed on the property with trees along the road. They, had a good perposal
that Weld County apprcn td. Well [ will be sending you photos of what it really look like.
They have the plastic: from silage pits that they bring in that blows into my ditch :arm land
,fence and trees. The dust from the truck driving over the dirt turn it into find dust and as soon
as the wind blows it blows right into me so thick you can't see across the road, I have talk to
Wes Bangman and he will put down some water if he knows I'm watching but by the end or
the day it a dust bowl. I can't even have my windows open or enjoy my farni outside or the
extra work it cause me with that comes from the dairy .Wes lives in town so he not their to
see what goes on and yes I call him. But I think that Weld County has a rail in this to enforce
what they approved. Why should I be the one complaining or other farms around me come and
complain to me knowing that I will send note to you..
This is all 20 yard for my front porch. As being a second generation Colaradoan and have
lived in weld county for over 25 years the biggest thing is to be able to ve w our mountain.
Well have lost that with all the silage mounds he built in front of my house just 20 YARDS
from my front porch . I will send you photos but I would like to have some one to come and
take a look at this then talk to me how they can get away with this. Our at lease look at this
dairy from Google earth to see what it looks like and how it look nothing like what was
presented to th.e Weld County board for the expansion approval for Mlle l ligh Dairy.

The Planning Department does not have an office at the SW office anymore_ At one time Planning
Commission hearings were conducted there until about 2009, However, all Board of County
Commissioners hearings land use have been and are conducted in Greeley.
The probable cause hearing notice (per the Weld County Code) is sent to the property owner. I am
notifying, you as the c rnplaintent. It is however a public hearing.
I understand your concerns re: (blowing dust, plastic,. — staff was not able to verify this condition at
the time we were out at the site.
I was able to verify that the trees had not yet been planted and that calving huts and improvements
Kcalving huts, hay bales...) had been added to the north of th-e existing row of trees at the north end of
the site..
I had a conversation with our Environmental Health Department and it is my understanding that they
will be heading out to the site to take another look.

The two items are:
The lack of trees along County Road 5 (the Bangrnats are requesting ad.dk.ional time to allow
them to plant these trees in the Spring of 2017),
The apparent expansion of the dairy funkier to the north (the additional calving huts...)
At this hearing the Board will review the information and determine whether or not to schedule
them for a show cause hearing to consider revocation of their permit. If this is the case the

We had talked about this a while ago (when we were at the Heartland site), I have finally gotten the
chance i(after the Hea:rtrand ECCC and Court hearings) to follow up and get this scheduled for a
probable cause hearing for Barigma (notice has been mailed).
The two items are;
) The planting of the trees — your clients position is to plant the trees in the spring or have the
county use the collaterar to plant them). In talking with staff — that is a decision that our
Board of County Commissioners will have to make in regards to whether or not that is
acceptable.
2) We received a complaint that additional calving huts have been installed on the site. I have
been out to the site and have verified that calving huts, hay bales, roads/circulation has been
installed to the north of the trees that form the northern boundary of the USE as town on
the attached AM USR-686 plat (in other wordsoutside of the USR boundary).
