WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter , is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 13th day of June, 1977 , in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of June H. Lehr, for a recorded exemption. The parcel of land in question is described as Pt. of the SW$ of Section 15, T2N, R68W of the 6th p.m. , Weld County, Colorado. The subject property contains 161.48 acres of predominantly Class I , II , and III irrigated soils. The request is to split the property into parcels of 160.48 acres and 1. 00 acre. Mrs. Lehr' s stated intent is to convey the 1. 00 acre parcel to her son Kenneth Bitters to be utilized as a residential site. Mr. Bitters has been living on this 1.00 acre parcel for seven years in a mobile home while he has been helping on the farm. Mr. Bitters now desires to replace the mobile home with a new residence. Utility services already exist to the 1. 00 acre parcel. Based upon the information submitted and the adopted policies in the county, the Planning Commission staff recommends the request be approved for the following reasons: 1. The proposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural District (Section 3. 3(A) of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since the use would be compatible with the surrounding agricultural uses. 2.
