Your letter concerning CR 54 and the Freedom Parkway alignment was referred to me for reply. We are aware of the many issues with the CR 54 alignment as well as issues with other alignments. All of the issues and options will be taken into consideration when the final decision is made. Again, thank you for your information and input. It's very helpful. All roads within subdivisions shall comply with the construction standards established within the subdivision regulations in effect upon the date of consideration for acceptance. B. Property owners may utilize any legal means of funding the necessary improvements. C. Acceptance of roads for maintenance by the County requires approval by resolution of the Board of County Commissioners, before acceptance is effective. Our home for the past forty- five years borders old county road 54 which was abandoned by the County several generations ago. I recently spoke with Mr. Jim Flesher regarding some of the reasons a four -lane highway should never be considered to retrace the old road 54 path. I will summarize a few of these concerns. Existing federal power transmissions lines can not be moved. The REA substation at WCR 55 can be moved only at great expense. There are at least four major oil transmission lines bordering our north fence and extending for miles both east and west. On our land alone are eight recently activated directional PDC wells which would be on the highway itself. Our land has been an Audubon Conservation Area for forty-three years, an area respected by all oil companies which have crossed our land. On the path of old county road 54 are two cottonwood trees used by golden eagles as hunting perches. Some twenty years ago officials of the Southern Ute Indian Tribe sat in our living room and guaranteed their transmission lines would in no way disturb these two trees. All transmissions lines since that time have kept these trees safe. This spring Audubon spotters verified that we have a Bald Eagle nesting on our land as well. As you know Bald Eagles have federal protection. On May 14, 2010, Mr. Pat Persichino, then Director of Public Works, wrote a personal letter of thanks to my wife and me for allowing Weld Co to divert rising ground water into a pond on our place. He notes we saved the county thousands of dollars in saving Road 49. It is to be noted that the massive amount of water drained into our pond has expanded it to several acres in size. Once the water in our holding pond reaches equilibrium drainage will cease. Perhaps the county might work toward allowing farmers to again irrigate from wells closed a number of years ago. Owners of flooded basements and flooded fields would be in your debt. As you know the continued rise of ground water (due to the refusal of allowing farmers to pump for irrigation) is causing Weld County major problems. Nearly all the surface of the land on our property which would be in the path of a new highway is within a few feet of the rising water. As has been pointed out to me, and I'm sure to you, County road 50 from road 49 to road 61 is already paved, requires no major curves to avoid substations, major well heads, or Southern the Golden Eagle hunting trees. We would be pleased to meet with you and any other interested commissioners at your convenience. However we will be out of town July 19-23 and from August 19 through September 15.
