HomeMy WebLinkAbout20170878.tiffRESOLUTION RE: APPROVE CONTRACT AMENDMENT #3 FOR 2015-2018 COMMUNITY SERVICES BLOCK GRANT (CSBG) AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Contract Amendment #3 for 2015-2018 Community Services Block Grant (CSBG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Local Affairs, commencing upon March 15, 2017, and ending September 30, 2018, with further terms and conditions being as stated in said amendment, and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Contract Amendment #3 for 2015-2018 Community Services Block Grant (CSBG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and the Colorado Department of Local Affairs, be and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. The contract and all prior amendments are modified as follows: Exhibit B, Section 1, Project Description, Subsection 1.1.1 is modified by the addition of the following sentence to the end of the current subsection: "Grant Funds may also be used to pay for education materials/supplies, travel expenses and staff salary/benefits to improve the quality of child care with county -approved childcare providers." We will do this activity through an Agreement with North Range Behavioral Health. If the amendment is satisfactory as written, please print and sign the amendment (original signatures only; no photocopies, stamped or e -signatures). The second page of this letter is a Return Routing Memorandum that includes a Grantee Checklist. Please use this document to facilitate the return of your contract amendment. Using the Checklist will ensure that your amendment has been signed by the appropriate person, that you have enclosed the correct number of documents for return to the State, that you have correctly addressed your return packet, and that you have notified us that your documents are on their way back to us. If you would like your copy of the fully executed contract amendment to contain original signatures, please make sure you sign and return two (2) contract amendments to us. If a photocopy of the originally signed fully executed contract amendment is acceptable to you, then you need only sign and return one (1) contract amendment to us. The State Controller requires hard copies and original signatures for contract amendment execution. We cannot complete the execution of your contract amendment without these. The State shall not be liable to pay or reimburse Contractor for any performance hereunder including, but not limited to, costs or expenses incurred, or be bound by any provision hereof prior to the Effective Date. 3) FACTUAL RECITALS The Parties entered into the Contract to deliver services and/or provide assistance to low income families and individuals. Grantee requests that Eligible Expenses be modified to include costs related to enhancing the quality of child care. This Amendment modifies Eligible Expenses as requested. 4) CONSIDERATION - COLORADO SPECIAL PROVISIONS The Parties acknowledge that the mutual promises and covenants contained herein and other good and valuable consideration are sufficient and adequate to support this Amendment. The Parties agree to replacing the Colorado Special Provisions with the most recent version (if such have been updated since the Contract and any modification thereto were effective) as part consideration for this Amendment. 5) LIMITS OF EFFECT This Amendment is incorporated by reference into the Contract, and the Contract and all prior amendments thereto, if any, remain in full force and effect except as specifically modified herein. 6) MODIFICATIONS. The Contract and all prior amendments thereto, if any, are modified as follows: a. Exhibit B, Section 1, Project Description Subsection 1.1.1 is modified by the addition of the following sentence to the end of the current subsection: "Grant Funds may also be used to pay for education materials/supplies, travel expenses and staff salary/benefits to improve the quality of child care with county -approved childcare providers." 7) START DATE This Amendment shall take effect on the later of its Effective Date or March 15, 2017. 8) ORDER OF PRECEDENCE Except for the Special Provisions, in the event of any conflict, inconsistency, variance, or contradiction between the provisions of this Amendment and any of the provisions of the Contract, the provisions of this Amendment shall in all respects supersede, govern, and control. The most recent version of the Special Provisions incorporated into the Contract or any amendment shall always control other provisions in the Contract or any amendments. 9) AVAILABLE FUNDS Financial obligations of the state payable after the current fiscal year are contingent upon funds for that purpose being appropriated, budgeted, or otherwise made available.
