RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION
AGAINST DANIEL SHEPHERD FOR VIOLATION OF THE WELD COUNTY CODE -
ZCV17-00225
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Daniel Shepherd, ZCV17-00225, is allegedly in violation of the Weld County
Code, specifically operating a trucking company that is not permitted, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 28th day of August, 2017, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Daniel Shepherd, property owner, was present at said hearing and presented
testimony, and
WHEREAS, the Board deems it advisable refer said matter to the County Attorney for
immediate legal action against the individual named above to remedy said violation, with direction
to prepare a Stipulation agreement which addresses parking, dust control, hours of operation,
fumes, lighting, backup alarms, limitation of the number of trucks, and a restriction of trucks only
during daylight hours.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Daniel Shepherd, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, to remedy the violation of the Weld County Code with direction to prepare a
Stipulation agreement which addresses parking, dust control, hours of operation, fumes, lighting,
backup alarms, limitation of the number of trucks, and a restriction of trucks coming and going
only during daylight hours.

This hearing will be conducted in the County Commissioners Hearing Room of the Weld County Administration

answer any questions the Board of County Commissioners might have about the violations .

• The first meeting with the County' s Development Review Team is a Pre-Application review meeting . Anyone
with a development idea can schedule a Pre-Application review meeting to get feedback on their idea . Pre-
Application meetings are free and are meant to assist prope�ty owners and applicants in understanding what
is required during development review.
• At the Pre-Application meeting , members of various departments will offer comments on the development
proposal . Based on the input from the meeting the applicant can then decide if they would like to move
fonnrard with a formal Land Use application .
. Pre-Application reviews are typically held Thursdays and Fridays of any given week at the pianning
department offices at the address at the bottom of this form . Submit the Pre-Aoplication review reauest form
questionnaire. and map to the planninq department. A planner will contact the applicant and set up a date and
