HomeMy WebLinkAbout770056 RESOLUTION RE: PAYMENTS FOR FOSTER CARE TO EDWARD AND LYDIA DUNBAR ON BEHALF OF A FOSTER CHILD LIVING IN THE DUNBAR HOME AND DETERMINATION OF "CONFLICT OF INTEREST" QUESTION. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, are vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Edward and Lydia Dunbar have had custody of a minor foster child since January 11, 1968, and have continuously provided foster care for said child since that date, and WHEREAS, Edward Dunbar was elected as County Commissioner of Weld County from District No. 1 at the general election in November, 1976 , and took office as County Commissioner repre- senting District No. 1 of Weld County, Colorado on the 3rd day of January, 1977, and WHEREAS, the Colorado State Department of Social Services Regulations (Volume VII , A-7218. 9) dictates that reimbursement is not available to Weld County for foster care on a child living with a County Commissioner or an employee of the County Department of Social Services who is serving as a foster parent, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has been advised by the Department of Social Services of Weld County, Colorado, that the foster child in question is approximately one and one-half years from emancipation and, in the assessment of the Department, the removal of said foster child from the Dunbar home at this time could be detrimental to the social and educational development of said child, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has determined through investigation that Edward and Lydia Dunbar have provided said foster child with a home that has given said foster child the highest possible standards of moral, social and educational guidance, and WHEREAS, the Board of County Commissioners , through investi- gation, does find that all moneys received from the Department of Social Services by Lydia Dunbar have been expended for the care pSco :OO-1 &G: �.q, �''fiae,+_r, 4 t r/ Li-C.�r lc (.°r r .+. _ /0,2.s 770056 ."1‘ / F' of said foster child, and as such, Edward and Lydia Dunbar have realized no personal gain as a result of keeping said foster child in their home, and WHEREAS, the Board of County Commissioners does find that Edward Dunbar, as County Commissioner of Weld County, Colorado, has no policy-making power concerning the amount of payments re- ceived as a result of keeping said foster child in the Dunbar home, and consequently, no conflict of interest exists as a result of the continued care, custody and control of said foster child by Edward and Lydia Dunbar in the future. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, pursuant to the policy- making power of said Board of County Commissioners as vested in said Board by the statutes of the State of Colorado and the Weld County Home Rule Charter, that payments to Lydia Dunbar in the sum of One Hundred and Ninety Three Dollars ($193. 00) per month, be, and the same are hereby directed to be paid from the General Assistance Fund effective January 3, 1977, for the one child now living with Edward and Lydia Dunbar. BE IT FURTHER RESOLVED that the amount of payments to be paid on behalf of said foster child shall be determined by the Department of Social Services according to the guidelines and standards used in determining the amount of payments in similar circumstances involving foster care and any increase or decrease in said payments as determined by the Department of Social Services of Weld County and the State of Colorado, shall determine the amount of payments to be received on behalf of said foster child by Edward and Lydia Dunbar in the future . The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 2nd day of March, A.D. , 1977.
