HomeMy WebLinkAbout20170573.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO FEBRUARY 22, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 22, 2017, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of February 15, 2017, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed. Commissioner Freeman seconded the motion, and it carried unanimously. Ei PUBLIC INPUT: No public input was given. • COMMISSIONER COORDINATOR REPORTS: Commissioner Kirkmeyer testified at the Capital on the Urban Renewal Authority Bill for the Town of Firestone. Chair Cozad attended the Downtown Development Authority meeting, on behalf of Commissioner Moreno, and passed on the update to him. She also distributed the City of Evans Annual Report from the meeting she attended. Lastly, she reported attending the VFW Breakfast in the Town of Frederick. BIDS: • 1) APPROVE BID #61700030, LAW ADMIN BASEMENT REMODEL (DESIGN BUILD) - DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, requested this matter be continued until March 8, 2017, so staff can further evaluate the proposals. The O3/03/O01 Minutes, February 22, 2017 Page 1 2017-0573 BC0016 motion, which was made by Commissioner Kirkmeyer, and seconded by Commissioner Conway, carried unanimously. • 2) APPROVE BID #61700035, TREE TRIMMING AND TREE REMOVAL MAINTENANCE CONTRACT - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek referenced the two (2) bids received and stated staff recommends awarding the low bid from American Arborist for 2017, with the possibility of extending the contract for two (2) additional years. Commissioner Freeman moved to approve said low bid. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. • 3) APPROVE BID #61700039, GEOTECHNICAL TESTING SERVICES - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek requested this matter be continued until February 27, 2017 to allow staff to further review the bids. Commissioner Freeman moved to continue said matter to February 27, 2017. Seconded by Commissioner Moreno, the motion carried unanimously. • 4) PRESENT BID #B1700032, BRIDGE REHABILITATIONS - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek presented the four (4) bids received and stated staff will bring back a recommendation on March 8, 2017. • 5) PRESENT BID #B1700047, SPRAYING ENFORCEMENT SERVICES - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek reviewed the four (4) bids received and stated staff will bring back a recommendation on March 8, 2017. El 6) PRESENT BID #B1700052, STEEL BID - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek presented the three (3) bids received and stated staff will bring back a recommendation on March 8, 2017. 7) PRESENT BID #61700053, CATTLE GUARDS - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek presented the two (2) bids received and stated staff will bring back a recommendation on March 8, 2017. OLD BUSINESS: • 1) ACTION OF BOARD CONCERNING APPEAL OF DECISION BY THE FAIR BOARD - BRAD AND LORI ANDERSON (CON'T FROM 01/23/2017): Janet Konkel, Fair Board, reviewed the timeline that was submitted by the Fair Board members and summarized their recommendation. In response to Commissioner Moreno, Larry Wagner, Fair Board member, discussed how the penalties were proposed. Brad Anderson, appellant, stated he proposed a donation of 25 percent (25%) from the sale of an animal to the 4H Foundation, as part of the penalty. Commissioner Cozad asked if a maximum penalty cap from a sale was ever discussed. Mr. Anderson stated the penalty is a lot, but compared to her not being able to compete at all in the Fair, it was better. In response to Commissioner Moreno, Mr. Anderson suggested Caitlyn participate in the record book training for three (3) years and be required to have an 80 percent (80%) score on her record book, instead of the usually requirement of 70 percent (70%). Mr. Anderson stated he doesn't believe she should be totally banned from the Grand Championship Drive, especially if she earns the opportunity, and he doesn't want his daughter banned from selling sheep at the Fair. a Commissioner Freeman stated he feels like the penalties are still too extreme for the mistake of turning in the wrong record book. He stated part of the role of the Fair Board is that they have a responsibility to look at things on a case -by -case basis and review penalties to see if they fit the violation and specify a certain cap for a penalty when she sells an animal. a Commissioner Conway stated he agrees with Commissioner Freeman, thanked the Fair Board and expressed he believes that Ms. Anderson has had a great learning opportunity and the penalty is unfair. He stated he is in agreement Minutes, February 22, 2017 Page 2 2017-0573 BC0016 with imposing the $100.00 fine, attending record book training for three (3) years and scoring 80 percent (80%). a Chair Cozad suggested having a $100.00 maximum on the fine coming from the proceeds. Commissioner Kirkmeyer clarified this was a wrong record book submitted, so the $100.00 late fine isn't relevant as a penalty. She asked how the decision of not being able to participate in the Championship Drive came to be part of the penalty. Mr. Wagner stated it was just part of the punishment. Commissioner Kirkmeyer stated, "rules are rules," and all 4H participants and their parents need to have an understanding of the rules. She presented her suggestions for the penalties and thanked the Fair Board for accepting the Board's challenge of looking at different consequences for this infraction. Commissioner Moreno stated there should be some type of penalty, but he is disappointed in the Fair Board's recommendation, and would also like to see a cap on the amount from the sale. Commissioner Kirkmeyer clarified her stance with regards to the penalties that should be enforced. Chair Cozad expressed her concerns with some of the penalties. Commissioner Freeman moved to impose the following penalties: up to a cap of 25 percent (25%) of $100.00 if she sells an animal and that she will be allowed to show all animals. The motion was seconded by Commissioner Conway. Upon a roll call vote, the motion passed four to one, with Commissioner Kirkmeyer opposed. NEW BUSINESS: • 1) CONSIDER VICTIM ASSISTANCE AND LAW ENFORCEMENT (VALE) GRANT APPLICATION FOR LONG TERM CARE OMBUDSMAN FRIENDLY VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of the Department of Human Services, stated the grant application is for a funding request to the Victims Assistance Law Enforcement Board on behalf of the Area Agency on Aging for the Ombudsman program. Commissioner Moreno moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. • 2) CONSIDER CONTRACT ID #1051 POSSESSION AND USE AGREEMENT AND AUTHORIZE CHAIR TO SIGN — PAMELA AND EVELYN ARD: Clay Kimmi, Department of Public Works, presented the agreement for additional right-of-way that Interstate Highway Construction (IHC) needs to accommodate their design of the County Road 49 and County Road 50 intersection. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. • 3) CONSIDER CONTRACT ID #1059 CONTRACT FOR IMPROVEMENTS TO NORTH INTERSTATE -25 (PHASE I) AND AUTHORIZE CHAIR TO SIGN: Elizabeth Relford, Department of Public Works, reviewed the details of the contract for the County's contribution to the Interstate 25 Project, which will take place approximately just north of State Highway 402 to just south of State Highway 14. Commissioner Kirkmeyer moved to approve said contract and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. • 4) CONSIDER TEMPORARY CLOSURE OF CR 47 BETWEEN CR 70 AND STATE HIGHWAY 392: Janet Lundquist, Department of Public Works, presented the closure effective February 21, 2017, through June 20, 2017, to complete work to improve the intersection on County Road 47 between Highway 392 and County Road 70. Commissioner Freeman moved to approve said closure. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. El 5) CONSIDER GRANTING COUNTY DANCE HALL LICENSE TO RNR'S LLC, C/O MCCARTY'S AT EATON COUNTRY CLUB AND AUTHORIZE CHAIR TO SIGN: Frank Haug, Assistant County Attorney, reviewed the Dance Hall License Application. He stated there are no reported incidents involving the establishment; therefore, he recommends approval of the application. Seconded by Commissioner Moreno, the motion carried unanimously. Brett Eckelcamp, representative of Congressman Ken Buck, extended an invitation to the Commissioners to attend the Telephone Town Hall meeting and directed interested participants to visit www.Buck.House.Gov. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
