Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolu-
tion authorizes the Board of County Commissioners to grant a change
of zone upon the showing by the petitioner of certain facts, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the petitioner and the recommendations of the Weld County Plan-
ning Commission, and having been fully informed, is satisfied that

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Melvin
Reichert, for a change of zone from A-Agricultural Zone District
to R-Residential District on the abovedescribed tract of land be,
and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated October 2 , 1979 be, and hereby are, adopted as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made

The following business was transacted:
I hereby certify that pursuant to a notice dated October 22, 1979
and duly published October 25, 1979 and November 15, 1979 in the Platteville
-Herald -a public hearing was held on the request of Melvin Reichert for
a Change of Zone from A (Agricultural) to R (Residential) .
Tom Honn read the Planning Commission' s favorable recommendation and
recommended conditions.
Larry Linder was present and stated he was now the owner of record of said
property. All deeds and related documents were submitted to and approved
by the Planning Staff prior to the Planning Commission hearing. Mr. Linder
reviewed the history of this parcel and agreements with the Town of LaSalle
regarding building on said parcel. Mr. Linderfurtner elaborated on his
plans for said property.
John Lichty, legal counsel for Glenda Leggett, owner of Valley Packing
commented on the COZ request. The Valley Packing plant is located adjacent
to the subject property. At present they have no objections and see no
problems with the COZ . However, they wanted the Board to be aware of
possible future problems from homeowners if the COZ and subsequent subdivision
are granted. Mr. Lichty also requested that a sewer easement of record,
granted to his client over and across the subject property be shown on
plats relating to same.
Following discussion Commissioner Steinmark made a motion to grant the
change of zone request with the Planning Commission recommendations.
Commissioner Roe seconded the motion and it carried unanimously.

Dear Mr. Linder:
On October 18, 1979, I performed a methane investigation of the Linder
Subdivision as described in the letter dated October 8, 1979, from
Arix. The investigation consisted of taking measurements in the three
test holes from which the Arix soil report had indicated refuse present.
The investigation revealed no gas present. The results are as follows:

SUBJECT: LINDER SUBDIVISION, PROJECT NO. 79 1 MTL 0184
It has been called to my attention by Mr. Larry Linder that you interpreted
our soils report to mean that the entire area occupied by the dump is to be
removed and replaced with select backfill material .
Our intention was for the removal of the trash and debris from each excavated
building site only. We feel that there is no need for removal of the trash
from the grassed and paved areas of the subdivision. Street areas should be
checked during construction as a thin upper layer of compacted soil over
debris may prove too unstable. We do not know the final grading of the
streets; therefore, we can only caution the engineer and the developer.

I] SCOPE
=I This report presents results of our subsoil investigation located in a
part of the Southwest Quarter (SW 1./4) of Section 31, Township 5 North,
Range 65 West of the 6th P.M. , Weld County, Colorado. The purpose of this
investigation was to determine those soil conditions and characteristics
,A which would affect the utility of the soils and foundation design of the
proposed structures. Data gathered through field and laboratory work are
summarized and tabulated in Exhibit Nos. 1 through No. 3 attached.
FIELD INVESTIGATION
Test borings were made September 20, 1979 at the locations shown on Exhibit
No. 1, to obtain data concerning existing soil conditions and to obtain
1I samples for laboratory use. 10 holes were drilled with a truck mounted power
auger equipped with a four-inch bit. Penetration data were gathered using
the Standard Penetration Test, ASTM D 1586. This test is made by driving a
two-inch split spoon sampler with a 140-pound weight falling 30 inches. The
blows required to drive the sampler 12 inches are referred to in Exhibit No.
{ 2 as blows per foot. The test borings were located to best reflect represen-
tative general conditions at the site, and to obtain specific data at each
location sampled.
Test borings were taken to the approximate depths below the surface shown
on Exhibit No. 2. Disturbed samples of each soil type encountered were
obtained for laboratory analysis. As each boring progressed, a log was kept
on which was recorded such information as field classification of soils,
sample locations, depth to groundwater table, if any, and other pertinent
data. These logs are reproduced on Exhibit No. 2.

LABORATORY INVESTIGATION
The laboratory phase of the investigation included the verification of
field soil classification, determination of soil grad-ations by mechanical
analysis, Atterberg Limits, natural moisture content, and consolidation-
swell characteristics of foundation material . These test results are summa-
rized on Exhibit No. 3.
SITE CONDITIONS
The site under investigation is located northwesterly of the town of LaSalle.
It is bounded on the south by a packing plant, on the west by 1st Avenue and
{ the north by an irrigation ditch. The northside of this ditch is in the
recent flood plain of the South Platte River.
A portion of the site, as delineated by the heavy dashed line, was a refuse
dump for the town of LaSalle and was abandoned 15 years ago. Our borings
indicate that the refuse was in a thin layer and all that was retrievable was
heavy metal and barbed wire. Isolated layers of ashes and sand were also
encountered along with scorched gravel particles. It is obvious that the
dump was in operation during the time that burning was permitted. Due to the
lack of organic matter and evidence of burning, methane gas buildup should be
negligible. Further analysis by Land Fill Consultants should be initiated if
there is some question.
The topography is gently sloping with surface drainage northerly. This is
approximately 15 feet of relief over the site. Adequate drainage is available,
provided that proper grading and landscaping are observed.
GROUNUWAIER
Evidence of groundwater was encountered at the time of the investigation.

1 Groundwater is near its peak elevation as we near the end of the irrigation
cycle. Due to the permeability of the soil groundwater will flucuate rapidly
1 and can not be lowered and stabilized effectively. Therefore some areas will
not be conducive to basement construction.
SUBSOILS
The majority of the site is overlain by fine gravels and sands which extended
1 to the depths investigated. The dump area is covered by 2 to 6 feet of
loosely compacted fill over the debris which is underlain by the fine gravels
and sand. The native gravels and sand display adequate bearing capacities for
1 moderately loaded structures.
+ BUILDING FOUNDATIONS
Our analysis of field conditions and test results indicates the use of conven-
tional footings located below maximum frost penetration and on natural undis-
Cturbed gravels and sands. Footings may be designed for a maximum allowable
bearing capacity of 2,000 pounds per square foot including live load.
( No foundations should be placed on the fill over the dump area, nor on the
{ debris. Areas such as these should be over excavated to natural undisturbed
material and backfilled with granular material free of litter or refuse. This
applies to the basement and garage underslabs. Backfilled material should be
placed in lifts not to exceed 12 inches and compacted to at least 95% of
maximum dry density as established in accordance with ASTM D698. Footings on
compacted backfill should be designed for a maximum allowable bearing capacity
of 2,000 pounds per square foot including live load.
FLOOR SLABS AND OTHER SLABS ON GRADE
The foundation soils show no tendency to shrink or swell . However, since

little uplift pressure or differential settlement is required to cause un-
sightly cracks in floor slabs, the following precautionary measures are deemed
necessary:
1. Compact material underneath slabs at or slightly above optimum moisture
content to at least 90% of maximum dry density.
2. Preclude the entrance of an outside water source underneath slabs.
3. Eliminate underslab plumbing where possible and where unavoidable,
thoroughly pressure test and take other precautions necessary to minimize
leaks.
4. Separate floor slabs completely from bearing walls, columns and footings.
5. Appropriate provisions should be made in large floor slabs for shrinkage
cracks.
TREATMENT OF FOUNDATION SOILS
Precautions should he taken to assure that the moisture content of the
foundation soils is maintained at a relatively constant level. Excava-
tions shall not be allowed to remain open long enough to allow appreciable
drying below natural moisture content, and the exposed foundation material
should be protected from wettingfrom any outside source.
Wetting of foundation soils should be prevented after construction. Methods
of accomplishing this include thorough compaction of all backfill around
structures, provisions for discharge of roof downspouts and other water
1 collection systems well beyond the limits of all backfill, and any other
1 procedures deemed necessary to maintain a stable moisture content. Exca-
vations should be made only large enough to provide necessary working
space in order to hold the area requiring backfilling to a minimum.

SULFATE RESISTANT CEMENT
Analysis indicates a sulfate concentration in excess of 0.10 percent water
soluble sulfate (SO4) in the soil samples. Therefore, Type II cement should
Jbe used in concrete exposed to this soil.
3 LIMITATIONS
The exploratory data presented in this report were collected to help develop
designs and cost estimates for this project, and thus may not represent
adequate information for indicating underground conditions for contractor
bidding or construction. We recommend considering exploratory work to reveal
underground conditions well enough to enable contractors to more accurately
evaluate conditions for bidding and execution of work after designs have been
prepared.
Professional judgements on design alternatives and criteria are presented
in this report. The judgements are based upon our evaluation of actual
conditions encountered at the location indicated herein, and upon our
extrapolations thereof, together with our interpretations of conditions
Igenerally characteristic of this area. We do not warrant the accuracy
of such extrapolations and interpretations beyond the limits of the tests
performed or where actual physical conditions were not observed.
Test borings drilled for this investigation were spaced to obtain a reason-
ably accurate respresentation of subsurface conditions for design purposes.
Variations from the conditions disclosed which were not indicated by the
test explorations frequently occur and quite often these variations are
sufficient to necessitate modifications in design. Therefore, if different
materials are encountered the owner or builder should be certain that the

Ifoundation conditions are adequate and within the scope of this report
1 prior to proceeding with any construction.
1 Under the above conditions, it is important that we inspect the subsurface
materials exposed in excavations to take advantage of all opportunities
lto recognize differing conditions and minimize the risk of having undetected
conditions which would affect the performance of the facility.

The proposed development is located within mile of the Town of
LaSalle and has the approval of the Town of LaSalle Planning
Commission. This request will be compatible with the surrounding
land uses, will have an adequate water and sewer service to serve
the permitted uses within the proposed zone district, and will
have adequate road and highway facilities to provide access to the
property.
In addition, the property does not appear to have sand, gravel, or
other mineral resources on or under the subject property and is
not located within a Geologic Hazard Area.
This determination is based, in part, upon a review of the
information submitted by the applicant, other relevant information
regarding the request and responses of the referral entities
which have reviewed the request.
The Planning Commission recommendation for approval is subject to the
following items being accomplished:
1 . The applicant shall delineate the designated 100 -year floodplain
on the Rezoning plat prior to the public hearing before the Board
of County Commissioners . A portion of the property lies within
the B-Zone of the 100 year floodplain as designated by the Army
Corps of Engineers Report dated April, 1977, and the National
Flood Insurance Rate Maps.
2 . The applicant shall demonstrate that no soil limitations are
present on the property in accordance with Section 81 . 6 . 2. 5. 4
of the Weld County Zoning Resolution. The applicant shall
submit subsoil investigations to document that no hazard
exists . If the limitations are made known through this study,
evidence shall be given to the County of the -method of dealing
with these limitations . This report shall be given prior to
this change of zone request being scheduled for a public
hearing before the Board of County Commissioners. If the
methods of dealing with these limitations are not satisfactory
to the Planning Staff, it should come back to the Planning
Commission prior to going before the Board of County Commissioners .
COMMENTS:
To date our office has received one letter with regard to this

I have again reviewed the Melvin Reichert change of zone request, "A"
Agriculture to "R" Residential, located 1/4 mile north of LaSalle on
1st Avenue.
As the result of a more intensive site review, I discovered the area to
be comprised of fill material that has been brought onto the site after
the soil survey was completed. With the addition of these materials,
it is difficult to determine the suitability of the site for dwellings
or septic tank absorption fields. A detailed on-site soil analysis by
a qualified soil engineer should be made prior to submission of a subdi-
vision preliminary plan.
Please forward these comments to the Weld County Planning Office so they
may add these comments to those previously made.

Pursuant to Application .requirements concerning a request
for a change of zone for a parcel of property located west of
La Salle and owned by -Mr . Melvin Reichert , and also identified
as the Linder Zone Change , below please find statements
relating to sectims 81 .7.4 . 3, 81 .7.!).0. , and 81 . 7.14 .5. :
The proposed rezoning of this property froip agriculture
to residential will fit with changing conditions in the area
because the Town of La Salle has expanded north and west over
the last 10 years , moving municipal boundaries to within 200
linial feet of the subject property, while utility extensions
have made this site a desirable site for residential purposes .
Moreover , this property has never been used for agriculture
for a variety of reasons : the site slopes ; soil is poor for
crops ; site has always been a remnant created when larger and
more productive sites were created; the site is economically
unfeasiahle for use in its current zone .
The proposed rezoning will allow uses which are compatible
with the surrounding land uses because such allowed uses are
specified in the La Salle Master Plan of Land Use and are
comparable with existing land uses which surround this _site .
The Town of La Salle has indicated that it wishes to
annex this property to the Town of La Salle when, in the future,
it is able to meet the contiguity requirements for annexation.
The Town Poard has indicated that it feels such a condition
for annexation should he satisfied within a year or two.
In overview, this property and its ' neighboring properties
constitute legally non-c :nforrning land-uses under County
jurisdiction and together forms a "County Island" contiguous
to the Town of La Salle , and which in the interest of jursdiction
and current planning theory should eventually he brought under
the responsibility of the Town or La Salle, The Town currently
provides municipal services to many of the residences in this
" island" .
In keeping with the Towns , desire to address long-term
planning concerns , the development of this property as residential
is consistent and compatible with surrounding land uses .
Moreover , it is proposed that development standards reflect
those of the Town of La Salle as reflected in the zoning and
subdivision regulations of the Town of La Salle , so that when the

information for a single family homesite on 8.8 acres in the NW4NE4SW4

The entire site is comprised of the soil type Ustic Torriorthents,
moderately steep (80-5-3) . This is a deep, excessively drained soil
on terrace breaks and escarpments, formed in gravelly alluvium on
slopes of 9 to 25 percent. Due to the slope, this soil is moderately
suited for use as a homesite and for the construction of septic tank
filter fields. If the slope can be compensated for, the site should
be suitable for the proposed use.
This soil is not considered prime farmland.

Gentlemen,
Weld County School District RE-1 received the plans for the
"Linder Zone Change", Agriculture to Residential "A" to "R-1",
located at part of the SW1 of section 31, T.5N. , R. 65 W. , of the
6th P.M. , County of Weld, State of Colorado.
Reactions of the Board are as follows:
1. Weld County School District RE-1 has long maintained
the position that new housing _developments should pay
a sum of $170 per single family dwelling as impact
money, to help defer the eventual cost of land acquisi-
tion and building construction brought about by increased
student enrollment. It is therefore requested that such
fees be assessed to this development.
2. It was understood that this development would contain
middle to high income, single-family dwellings. This
should have little impact on the school district. If,
however, the zoning included low-income or multiple
family dwellings, then the school district would need
to examine more carefully the potential student impact
on the La Salle Elementary school, which is currently
near capacity.
3. Sidewalks or safe pedestrian trails need to be provided
on either side of First Avenue, to allow safe access by
children from the subdivision to the school.
4. The main entrance off First Avenue should be wide enough
to allow a bus to pull safely off the road in order to
load or unload passengers.

5. It was suggested that an entrance be provided
on the Northeast side of the subdivision. This
would reduce the traffic volume on First Avenue.
Finally, Weld County School District RE-1 has no basic objection
to the zone change. It is requested, however, that the district be
advised of project progress and of any changes in plans.

Dear Ms . Traxler:
The potential sources of flooding in this area are the
South Platte River and local drainage from less than 1 square
mile of drainage area. Our records show the NW edge of the
property lies on or near the limits of the 1973 South Platte
River flood. The 1973 flood was determined to be approximately
a 100-year flood. The floodplain and water surface elevations
are described in the April, 1977 U.S . Army Corp of Engineers
Report/Special Flood Hazard Information Report, South Platte
River, Volume I, Weld County, Colorado. " This report was
designated by the Colorado Water Conservation Board on November
15, 1977 and thus is available to local governments for
regulation purposes . High Water Mark 71 described in this
report is located at the intersection of 1st Avenue and county
road 394 and shows the 1973 flood reached elevation 4658. 4
feet above MSL.
Also, the June 8, 1979 National Flood Insurance Program
Preliminary Floodway maps show a least part of the property
to be in a "B" zone which means flooding could occur from a
100-year flood at depths of less than 1 foot or from a 500-year
flood. Thus , our recommendations are as follows :
1. Have applicant correctly outline the designated 100-
year flood plain from the corp report on the zoning
change.

2. All land in the flood plain should have applicable
flood plain management regulations applied and no
building should occur in any floodways or high hazard
areas shown on county maps .
3. All first floor elevations of structures should be
raised one foot above the 1973 high water mark (4658 . 4
+ 1. 0 = 4659. 4 feet above mean sea level) as
determined by field surveys. Some sites are probably
above this elevation now, but this can 't be determined
from the present information supplied.
4. A drainage plan for the area should be developed that
incorporates, floodproofing, site grading, drainage
to streets and drainage off streets and out of the
subdivision, without adverse effects .

Gentlemen:
The comments contained herein are in response to your
notice advising of the proposed change of zoning, dated August
17, 1979 . While the notice gives no address or legal descrip-
tion for the property to which the zone change request applies ,
we presume it pertains to the property designated "Tract A" in
the enclosed copy of a Recorded Exemption.
As is indicated in the records of Weld County, we took
title to the property designated "Tract B" in the Recorded Ex-
emption on October 10 , 1977 and have , since August, 1977, contin-
uously operated a custom-kill meat packing facility on that
property. The operation is carried on as a permitted non-con-
forming use . Additionally, at the time we took title, we were
also granted an easement for utility purposes across the prop-
erty designated "Tract A" which is shown on the recorded exemp-
tion and described in the warranty deed by which we took title.
A copy of the deed is also enclosed.
While we take no position in favor of or in opposition
to the pending request for change of zone , we consider it imper-
ative that it be clearly understood that we do not waive any
right we have by virtue of our acquisition of Tract B or under
the non-conforming use for operation of the packing plant. It
is our position that the existence of Tract B and its operation
as a meat packing plant pre-date any use of Tract A as resident-
ial property and approval of re-zoning and subsequent use of
the land in Tract A for residential purposes must be undertaken
with full knowledge of our pre-existing rights .
Further, the easement we were granted at the time of
acquisition of Tract B across Tract A for utility purposes and
the pre-existing easement in favor of the Town of LaSclie' across

Tract A for utility purposes are essential to our operation
and must be fully preserved, including rights of access
thereto.
We intend to continue operation of our meat packing
plant, without interuption, and believe the matters addressed
in this letter should be considered by the County in making
