RE: GRANTING OF BUILDING PERMIT TO JAMES C. GIGGY ON CERTAIN
PROPERTY LOCATED IN THE NORTHEAST QUARTER OF SECTION 32,
TOWNSHIP 5 NORTH, RANGE 64 WEST, 6TH P.M. , WELD COUNTY,
COLORADO.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, are vested with the authority of managing the affairs
of Weld County, Colorado, and
WHEREAS, it has come to the attention of the Board of
County Commissioners of Weld County, Colorado that certain cir-
cumstances have developed which would justify the Board of County
Commissioners of Weld County, Colorado to authorize a building
permit on the following described real estate, to-wit :
The South 320 feet of the NEQ of Section 32 ,
Township 5 North, Range 64 West of the 6th P.M. ,
Weld County, Colorado, containing 7. 4 acres more
or less , and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that James C. Giggy be, and
hereby is , granted a building permit on the above described parcel
of land subject to the approval of the access to the property by
the County Engineer of Weld County, Colorado, pursuant to Section
13 C (2) of the Weld County Subdivision Regulations, and
BE IT FURTHER RESOLVED that the building permit issued under
this Resolution is not in any way intended to relieve or absolve
the perpetrators of the violation or violations of any possible
civil or criminal laws , but is merely intended to prevent any
unjust treatment to innocent victims .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote this 29th day of
December, A.D. , 1976.

Moved by that the following resolution be intro-
duced for passage by the Weld County Planning Commission :
Be it therefore Resolved Jy t �e Weld County Planning Commission
that the following be recommended to the Board of County Commissioners:
That the request by James C. Giggy for a building permit on property
described as the south 320 feet of the NE"* of Section 32, T5N, R64W
of the 6th P.M. , Weld County, Colorado, lying north and west of the
Gilmore Canal except the south 60 feet, containing 7.4 acres more or
less be approved as set forth under Section 13C 1) of the Weld County
Subdivision Regulations.
Due to the circumstances, surrounding land use and time constraints
involved, a building permit would allow use of the property. It was
discussed that there was no contiguous land owner able to or interested
in purchase of the 7.4 acre parcel and that no water is available for
the 7.4 acre parcel. It is the position of the Planning Cuunission that
if the parcel were to remain idle and un-maintained that it would create
an unnecessary nuisance to surrounding agricultural operations.

The Chairman declared the motion passed and ordered that a certified
copy of this Resolution be forwarded with the file of this case to the
Board of County Commi >sioners for further proceedings .
The Planning Commission also recuunends that access to the property
be approved subject to the County Engineers requirewents. This pro-
vision being set forth under Section 13C. 2) of the Weld County
Subdivision Regulations.
The Planning Commission's recommendation is in no manner to be
considered as a precedent, but based on the information presented for
this specific matter. The recommendation for issuance of a building permit
is not in any way intended to relieve or absolve the perpetrators of
the violation(s) of any possible civil or criminal liability. It is
merely intended to not permit unjust treatment to innocent victims.

SUBJECT: Parcel of property in weld county
The south three hundred and twenty feet of the
northeast quarter of section thirty-two, township
five north, range sixty-four west of the sixth P.M.
lying east and north of the Gilmore Ditch, said
parcel containing seven and four-tenths acres
more or less.
This letter is in regard to a parcel of land described above
This letter is being written under the requirements of
section 13, article c, paragraph 1 .
I ask the planning Commission, and County Cpmmissioners to
approve a building permit under this provision.
COMMENTS: This land is sitting alpng a oil road south of Kersey,
and is not adjoining any major faris. Also there is no irrigation
water with this parcel of land. So as it now lays it is suitable o
only for a dwelling and acreage. There is a soft water lint running
along the property. So the water situation would be no problem for
a home. A'.so there has been building permits issued on other
parcels in this area. So it is my feeling that this request is
not out of. line .
When I bought this property I was told by the seller that
I would be able to get a building permit for a house.
