It is for structural, form changes in the government, not functional or powers changes. That is, the number of County Commissioners could be enlarged, as has been done below, but their powers to enact local laws outside the scope of current state legislation could not be granted. This public hearing is one of 13 across the county through June 6, 1975. After that, the Charter will be put into final form. The County Commissioners are to schedule an election on this Charter between July 26, 1975 and September 19, 1975. Sets professional qualifications for Sheriff. All elected offices, except Coroner and Councilman, shall be full time. ---Creates five-member, unsalaried County Council, chosen in nonpartisan elections. Council to set elected-post salaries, monitor government performance, fill Commissioner vacancies. ---Makes Commissioner-appointed post of County Attorney full time. ---Expands appointed Planning, Public Health Boards to nine members each, six from geographic districts, three at-large. Limits all appointed boards - commission members to two consecutive three year terms. ---Grants right to petition for recall, referendum, and initiative elections, and to amend or repeal Charter. ---Requires referendum elections if budget mill levy or capital construction fund ceilings are exceeded. ---Calls for creation of central County Personnel system. Sets controls on nepotism in hiring. Sets county officer, employee conflict-of-interest controls. ---Requires open, competitive bidding for county contracts. DETAILS OF THE CHARTER County Commissioners --- Enlarged to five from current three members; three elected from districts, two at-large; may serve a maximum of two 4-year terms consecutively; Commissioners and all other elected officials must be at least 21 years old and minimum one-year county residents to run. Commissioner Chairman, Chairman pro-tem chosen annually; Chairman presides, also is coordinator of Finance-Purchasing-Personnel department; other four (4) Commissioners coordinate the four (4) other major county departments. Commissioners are governing board of county; set policy; legislate; set budgets and taxes; appoint boards - commissions and department directors; adopt administrative code and personnel system; sue for county; responsible for county property; execute contracts; are final appeals board, are' to call at least three (3) conferences with 3 • Weld town officials annually; may provide services in districts or form districts with a vote of those affected; may provide contracted or joint-agreement services to other governments, such as towns, including law enforcement services. County Departments --- Five (5) major departments are provided -- Finance- Pqrchasing-Personnel; Health Services; Planning Services; Engineering Services; and Communications Services. Commissioner Chairman always is coordinator for Finance-Purchasing-Personnel Department; other Commissioner-coordinator posts with departments must be changed annually. Under this, Commissioner-appointed Planning Commission, Public Health Board and Board of (Zoning) Adjustments to be expanded from current five (5) to nine(9) members -- six (6) from districts and three (3) at-large; planning body granted final decision powers on all cases except re-zonings, but final appeal to County Commissioners retained. All appointed board and commission members, including seven (7) member Weld General Hospital Board, limited to serving two (2) three (3) year terms consecutively; all boards to be broadly representative of the county. New, central county personnel system created; exempted are Chief Deputies of all elected officials except Commissioners, County Attorney, and temporary help. County Attorney --- Remains appointed by Commissioners; to be full time employment. Represents Commissioners, other elected officials and agencies; in conflict between Commissioners and other elected officer, County Attorney represents Commissioners and District Attorney's office to represent other officer. Five years legal experience required. Elected Offices --- Retained as elected posts are Sheriff, Treasurer, Assessor, Clerk and Recorder, Coroner. County Surveyor abolished as elected, with functions placed in Engineering Services Department. All elected posts retain four (4) year terms their office to be their primary employment. Professional experience and-or law enforcement education qualifications required for Sheriff and appointed Undersheriff. No other professional qualifications for elected offices, although chief deputies in Treasurer and Assessor offices must meet professional standards. 4 • County Council --- New, five (5) member, unsalaried Council chosen in non-partisan elections; three from districts, two at-large; to serve a maximum of two (2) four (4) year terms, meeting at least monthly; barred from other county elected or appointed office. Duties --- Set salaries of all other elected officials; fill vacancies on County Board of Commissioners (Commissioners fill all other vacancies); 'may' appoint county performance auditor to monitor government; suspend elected officials under recall or who are criminally charged or indicted; monitor government and report periodically to the public. Requirement of 200 qualified- elector petition signatures for council candiates to be on ballot. Elections --- General elections continue under state law; Commissioners call special elections. Transitional election required before December 15, 1975, if Charter is adopted by voters; would elect two (2) new at-large County Commissioners to one (1) and three (3) year term; three Council members to three (3) year terms; four(4) year term elections for all thereafter. Right of recall referendum and initiative elections granted. Petitioning in sixty (60) days required to have elected officer recall election; qualified elector signatures required equal to twenty (20%) percent of total votes for that office in last election. Citizens may petition for election on initiated ordinance or resolution, or for referendum election on Commissioner-adopted ordinance or resolution; petition signatures equal to five (5%) percent of registered voters in last general election must be gathered in twenty-one (21) days for either. Petitioning for Home Rule Charter amendment election requires signatures equal to five (5%) per cent of current registered voters in county; for election on repeal of Charter or new Charter Commission, petition signatures equal to 15% of current registered voters required. Budget-Finance --- County budget and fiscal year kept at January 1, through December 31. Commissioners adopt budget after at least one public hearing; budget proposal prepared by Director of Finance-Purchasing-Personnel Department working with the Commissioners, other elected officials and other department heads; Finance Director may be required to present five (5) year projection of capital project needs and budgets. Annual independent audit required, but same audit firm may serve no more than five (5) consecutive years. County elected official salaries remain the same until council takes action; that is -- District 1 and 3 Commissioners, $10,000 a year, all others $15,000; 5 other elective offices remain as is. Finance limits imposed -- referendum vote required on annual budget if mill rate of local property tax needed is greater than five (S%) percent above previous year -- referendum vote also required if property tax for capital projects exceeds nine (9) mills over three years for hospital construction or nine (9) mills over three years for general county construction. County contract bidding to be 'open and competitive{ Weld County bidders given preference if price and quality are competitive; Commissioners to state reasons publicly when other than low bid chosen; ten (10) day study period required on all bids over $2,000. General Provisions --- County holds powers of condemnation. Commissioners, other elected officers and other officials the Commissioners may designate shall be bonded. Commissioners to state reasons publicly when rejecting the policy recommendation of an appointed advisory board of commission. Hiring of relatives (nepotism) barred by county hiring officials.
