RE: APPROVE CERTIFICATE OF DESIGNATION - CH2E COLORADO, LLC, AND
HUDSON TIREVILLE, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on the 20th day of September, 2017, a public hearing was held in the
Chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of
considering whether to grant a Certificate of Designation to CH2E Colorado, LLC, and Hudson
Tireville, LLC, 12311 County Road 41, Hudson, CO 80642, said site to be located on the following
described property:
Being a part of the SE1/4 of Section 32, Township 3
North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, said applicant was present, and
WHEREAS, said request for a Certificate of Designation was submitted in conjunction with
an application for 7th Amended Minor Use by Special Review Permit, #7MUSR16-89-842, for a
Tire Mono -fill and Tire Recycling Facility in the 1-3 (Industrial) Zone District, of which approval of
the Certificate of Designation is a Condition of Approval for recording the final plat, and
WHEREAS, Section 30-20-104, C.R.S., requires the Board to take into account certain
factors to approve a Certificate of Designation and, having taken into account said factors, finds
as follows:
a. The effect that the solid wastes disposal site and facility will have on the
surrounding property, taking into consideration the types of processing to be used,
surrounding property uses and values, and wind and climatic conditions. The
Conditions of Approval and Development Standards in Site Specific Development
Plan and 7th Amended Use by Special Review Permit, 7MUSR16-89-842, for a
Tire Mono -fill and Tire Recycling Facility in the 1-3 (Industrial) Zone District, will
minimize the impacts on the surrounding property and the area to the greatest
extent possible, and will also provide adequate protection of the health, safety, and
welfare of the inhabitants of the area and the County.
b. The convenience and accessibility of the solid wastes disposal site and facility to
potential users. The location of the proposed solid waste disposal site will be
convenient and accessible to the potential users.
c. The ability of the applicant to comply with the health standards and operating
procedures provided for in this part 1 and such rules and regulations as may be
prescribed by the department. The applicant has demonstrated in the submitted
application materials there is a need for the proposed solid waste disposal site and
that the use can comply with the Weld County Code. Further, the Colorado

Department of Public Health and Environment (CDPHE) has recommended that
the application be approved, with conditions, because the use can comply with
rules and regulations of the CDPHE.
d. Recommendations by local health departments. The Colorado Department of
Public Health and Environment and the Weld County Department of Public Health
and Environment have reviewed this request and find, subject to conditions, the
proposal will comply with the Standards of the Solid Waste Disposal Sites and
Facilities Act, Section 30-20-100.5, et seq., C.R.S.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a Certificate of Designation for CH2E Colorado, LLC, and Hudson Tireville,
LLC, on the hereinabove described real property be, and hereby is, granted subject to the
following conditions:
1 The Operator shall comply with Colorado Revised Statutes Title 30 Article 20 Part 1
(Solid Wastes Disposal Sites and Facilities) and 6 CCR 1007-2 Part 1 (Regulations
Pertaining to Solid Waste Sites and Facilities).
2. The Operator shall comply with all conditions required by the Colorado Department of
Public Health and Environment (CDPHE), Hazardous Materials and Waste
Management Division ("Division"), as described in its letter dated July 19, 2017.
3. The Operator shall provide to the Weld County Department of Public Health and
Environment (WCDPHE) a copy of any Compliance Order issued to the Operator by
the CDPHE within thirty (30) days of receipt. Any issuance of civil penalties or an
injunction against the Operator by the CDPHE or the 19th Judicial District Court may
be grounds for revocation of the Certificate of Designation.
4. The Operator will abide by, and be in compliance with, the Conditions of Approval and
Development Standards for the USR associated with this Certificate of Designation.

Subject: Certificate of Designation (CD) for CH2E Colorado, LLC
Date: September 14, 2017
This request is for a Certificate of Designation (CD) for a Tire Mono -Fill and Tire Recycling Facility
located in the 1-3 (Industrial) Zone District. The property is in part of the SE4 of Section 32,
Township 3N, Range 65W, of the 6th P.M Weld County, CO. This CD is being requested by CH2E
Colorado, LLC and Hudson Tireville, LLC (Hudson Tireville, LLC is a subsidiary company of CH2E
Colorado, LLC). This is the site formerly owned by Tire Mountain Inc. The applicant has also
currently been approved conditionally for a Minor Use by Special Review (USR) permit for the
Tire Mono -Fill and Recycling Facility (7MUSR16-89-842) however the approval of this CD request
is a condition of approval prior to recording the final map for the USR Amendment. The applicant
is required to have a new CD because both the ownership and any lessee of the land that had
previously been approved under the last issued CD has changed. Because both the owner and
operator of the site have changed the state requires the new lessee and/or new owners of the
site to obtain a new certificate of designation. The Colorado Department of Health and
Environment, Hazardous Materials and Waste Management Division reviewed the CD application
by CH2E Colorado, LLC. In a letter addressed to the Weld County Board of County Commissioners
on July 19, 2017 the state recommended approval of this CD request by CH2E Colorado, LLC and
Hudson Tireville, LLC for the Tire Mono -Fill and Tire Recycling Facility.
Background and Timeline:
August 25, 1976: The Use by Special Review Permit USR-305 (Reception #1697158) was
approved and recorded for an auto salvage and wrecking yard and
associated facilities on three of the four parcels associated with the current
CD Request today.
January 25, 1989:
A Use by Special Review permit USR-842 and a Certificate of Designation to
use the site as a solid waste disposal site for tires and as a scrap tire
recycling facility were both approved in conjunction with one another by
the Board of County Commissioners. The CD approval was specifically for

Tire Mountain, Inc. The CD approval came with the condition that it
complied with all requirements associated with the approved USR-842
BOCC resolution, recorded map and development standards and all
requirements of the Weld County Department of Public Health and
Environment and the Colorado Department of Public Health and
Environment.
August 30, 1989:
The first Amendment to Use by Special Review permit USR-842 and an
updated Certificate of Designation were approved and granted in
conjunction with one another by the Board of County Commissioners. The
CD was granted to Tire Mountain, Inc and Wixco Services, Inc. The Approved
CD request still included a solid waste disposal site for tires and scrap tire
recycling facility. The CD approval came with the condition that it complied
with all requirements associated with the approved AMUSR-842 BOCC
resolution, recorded map and development standards and all requirements
of the Weld County Department of Public Health and Environment and the
Colorado Department of Public Health and Environment.
September 6, 1989: A new Use by Special Review map was recorded USR-842 (Reception
#2190930). USR-842 replaced USR-305 and changed the use of the site from
an auto salvage and wrecking yard facility to a tire landfill, storage and
recycling facility. This new USR map was actually the first amendment to
the original USR map, but was approved as a completely new USR number
and only included the requirements and approvals of the January 25, 1989
USR-842 and CD BOCC Resolutions. This map still only included three of the
four lots that are part of the current CD application and MUSR request
today.
January 4, 1990:
The first amendment to Use by Special Review permit (AMUSR-842) was
approved and recorded. AMUSR-842 (Reception #2201884) was done to
add a use to the site to include a biomedical waste incinerator facility to the
already approved tire landfill, storage and recycling facility. This Amended
USR was done to include the requirements and approvals of the August 30,
1989 MUSR-842 and CD BOCC Resolutions. This revised map did not change
in size and still only included the area where three of the four lots are
located, that are part of the current CD application and MUSR being
requested today.

October 3, 1990: A request for an amended Certificate of Designation was granted to
Jamison Tool, Inc and Wixco Services, Inc. for the use to include a solid
waste disposal site for tires and scrap tire recycling facility and a biomedical
waste incineration facility. The board approved this with the condition that
it met Use by Special Review Permit USR-918 BOCC resolution, recorded
map and development standards and all requirements of the Weld County
Department of Public Health and Environment and the Colorado
Department of Public Health and Environment. This USR-918 Map was
never recorded as the lot it was on had not yet been created by Recorded
Exemption Plat.
July 10, 1991:
A request for an amended Certificate of Designation was granted to
Jamison Tool, Inc/Colorado Incineration Services, Inc. for the use to include
(a solid waste disposal site for tires and scrap tire recycling facility and a
biomedical waste incineration facility). The board approved this with the
condition that it met the AMUSR-918 BOCC resolution, recorded map and
development standards and all requirements of the Weld County
Department of Public Health and Environment and the Colorado
Department of Public Health and Environment. AMUSR-918 at this point in
time had not met all conditions of approal as the 3.84 -acre parcel of land
that the AMUSR-918 was to be approved on had still not been created
through the Recorded Exemption Process.
September 12, 1991: A 2 -Lot Recorded Exemption plat map was recorded for RE -1367 (Reception
#2263003) officially splitting the roughly 40 -acre parcel that was the S2N2
SE4 Sec 32, T3N, R65W of the 6t'' P.M. Weld County, CO. The Exemption
split the property into a 36 -acre Lot B that continued the use on site as a
solid waste disposal site for tires and scrap tire recycling and a 3.84 -acre Lot
A that was used for the biomedical waste incineration site. AMUSR-918 was
approved for the biomedical waste incineration site to be located only on
Lot A and was approved and recorded in conjunction with this Recorded
Exemption RE -1367 Plat. All lots were still owned by Jarrald Jamison and
Colorado Incineration Services, Inc was the operator leasing Lot A.
November 6, 1991: A revised Amended Use by Special Review map AMUSR-842 (Reception
#2268363) was recorded showing the partial vacation of the amended USR
from all of Lot A of Recorded Exemption RE -1367. The AMUSR-842 map
included all of Lot B of Recorded Exemption RE -1367 and the 40 -acre parcel

that is the S2S2 SE4 Sec 32, T3N, R65W of the 6th P.M. Weld County, CO.
April, 27, 1993:
A Second Amended Use by Special Review map 2nd AMUSR-918 (Reception
#02330550) was approved and recorded with changes to the site design
and development standards for the biomedical waste incineration facility
that was originally approved through AMUSR-918. There were no changes
in ownership or the size or geometry of the lot.
October 22"d 2003: A Certificate of Designation was granted to the Estate of Jarrald Jamison
and Faye Jamison for (a solid waste disposal site for tires and scrap tire
recycling facility). This CD was approved in conjunction with 2nd AMUSR-842
and was approved with the condition that the property shall maintain
compliance with the 2"d AMUSR-842 BOCC resolution, recorded map and
development standards and all requirements of the Weld County
Department of Public Health and Environment and the Colorado
Department of Public Health and Environment.
December 22, 2003: Second Amended Use by Special Review 842 map (2"d AMUSR-842
Reception #3137599) was approved and recorded. This amendment to the
USR expanded the size of the USR to include all of Lot A and Lot B of
Recorded Exemption RE -1367, and the two parcels that make up the entire
S2 SE4 Sec 32, T3N, R65W of the 6th P.M. Weld County, CO. Second
Amended Use by Special Review map AMUSR-918 was completely vacated
in conjunction with this amendment. The Amended uses on the entire site
were for a solid waste disposal site and facility (Commercial Junkyard and
salvage yard including tire landfill, storage and recycling facility) and a
mobile home for housing in the 1-3 Industrial zone district. The property at
this time was all owned by the Estate of Jarrald Jamison and Faye Jamison.
November 3, 2009: Third Amended Use by Special Review 842 map 3rd (AMUSR-842 Reception
#3657314) was approved and recorded. This amendment was done by a
new owner and operator (Magnum D'Or Resources, Inc) and was done to
change the use on the site to include a solid waste disposal site and facility
(Commercial Junkyard and salvage yard including tire landfill, storage and
recycling facility) Heavy manufacturing processing facility (cryogenic
processing/crumb rubber) and a mobile home for housing in the 1-3
Industrial zone district.

November 21, 2013: A Minor amendment map to the use by special review was approved and
recorded and called MUSR13-0013 (Reception #3979544). This amendment
was also done by a new owner and operator and was done to change the
use on the site to include a solid waste disposal site and facility (Commercial
Junkyard and salvage yard including tire landfill, storage, shredding and
recycling facility) Manufacturing/Processing facility (cryogenic
processing/crumb rubber and recycling process that uses a closed loop
cracker process to create products) and a mobile home for housing in the I-
3 Industrial zone district. This was the first amendment done to the site
when owned by CH2E Colorado, LLC who had purchased all four lots from
their subsidiary company Hudson Tireville, LLC by special warranty deed
recorded on March 15, 2013 (Reception #3917132). It is also worth noting
that it was at this point in time that the state issued a letter for this case
indicating the facility did not require a CD. However the State's letter was
limited to a review of the paralysis portion of the recycling facility but did
not address the need for a new CD due to change of ownership and
operator.
February 29, 2016: A Minor amendment map to the use by special review was approved and
recorded and called MUSR15-0015 (Reception #4184025) was approved
and recorded. This minor amendment was done to change the use on the
site to include a solid waste disposal site and facility (Commercial Junkyard
and salvage yard including tire landfill, storage, shredding and recycling
facility) Manufacturing/Processing facility (cryogenic processing/crumb
rubber and recycling process that uses a closed loop cracker process to
create by-products), a used oil and water concrete secondary containment
and underground vault storage area for spill prevention, onsite oil loading,
a truck loading ramp, a new shredding building, three (3) temporary tire
shred storage areas, a double walled baker tank, a crumb rubber storage
silo and Two (2) additional storage cells for whole waste tires in the 1-3
Industrial zone district
Present:
CH2E Colorado has been conditionally approved for another minor
amendment to their Use by special review permit. The most recent permit
known as 7MUSR16-89-842 has been approved by the Weld County
Planning Department with the condition that the amended USR map will be

recorded after a new Certificate of Designation is approved by the Board of
County Commissioners for the CH2E Colorado LLC and Hudson/Tireville LLC,
to use the site as a Tire Mono -Fill and Tire Recycling Facility. The current
amendment is to modify development standard 15 of MUSR15-0015
allowing for mobile tire shredding to take place in the roadways between
the tire cells. During the review period for 7MUSR16-89-842 an inspection
was conducted by the Weld County Department of Public Health and
Environment (WCDPHE) on December 5, 2016. Based on conversations
with the State and a November 8, 2016 letter from the Attorney General
outlining the CD requirements, WCDPHE issued their inspection letter. The
inspection letter went out on February 9, 2017 indicating the facility did not
have a valid CD. Based on this inspection letter CH2E started the CD process
with the County and the State. CH2E Submitted their CD application to the
Weld County Department of Planning Services on March 10, 2017. The
Department of Planning Services then submitted it to the state for review
and on July 19, 2017 the state recommended approval of this CD request
by CH2E Colorado, LLC and Hudson Tireville, LLC for the Tire Mono -Fill and
Tire Recycling Facility.

Re: 7MUSR16-89-842 CH2E CD Request
This request is for a Certificate of Designation (CD) for a Tire Mono -Fill and Tire Recycling
Facility located in the I-3 (Industrial) Zone District. The property is in part of the SE4 of Section
32, Township 3N, Range 65W, of the 6th P.M Weld County, CO. This CD is being requested by
CH2E Colorado, LLC and Hudson Tireville, LLC (Hudson Tireville, LLC is a subsidiary
company of CI -12E Colorado, LLC).
As required by Section 30-20-104, C.R.S, any request to the Board of County Commissioners for
a Certificate of Designation should include the following factors to be considered. Weld County
Department of Public Health and Environment provided a justification for each factor based on
submitted material by the applicant.
A. The effect that the solid wastes disposal site and facility will have on the surrounding property,
taking into consideration the types of processing to he used, surrounding property uses and
values, and wind and climatic conditions. The Conditions of Approval and Development
Standards for the site will minimize the impacts on the surrounding property and the area to the
greatest extent possible, and will also provide adequate protection of the health, safety, and
welfare of the inhabitants of the area and the County

reviewed this request and find, subject to conditions, the proposal will comply with the Standards
of the Solid Waste Disposal Sites and Facilities Act, Section 30-20-100.5, et seq., C.R.S.
As required under Section 1.3.3 and Section 10.5 of the Regulations Pertaining to the Solid
Waste Disposal Sites and Facilities Act (6CCR 1007-2), the facility is required to have a valid
Certificate of Designation due to its classification as a Waste Tire Monofill. In a letter dated
June 25, 2013, the Colorado Department of Public Health and Environment (CDPHE) indicated
that the requirement for a CD would be exempt due to recycling activities at the site. This letter
was mistakenly interpreted as the whole facility did not need a CD if the facility was conducting
recycling activities. Around this same time the facility was purchased by the current owner
CH2E. Based on conversations with the State and a November 8, 2016, letter from the Attorney
General's office outlining the requirements for a new CD if the owner and operator of a solid
waste facility changed, Weld County Department of Public Health issued a February 9, 2017
letter indicating the facility did not have a valid CD. In response, CH2E submitted their CD
application to the Weld County Department of Planning Services on March 10, 2017. After
being submitted to the CDPHE for review, the CDPHE issued a Recommendation for Approval
letter on July 19, 2017. Based on this letter and after review of the submitted material,
WCDPHE agrees with the State's recommendation for approval.

Members of the Board,
The Colorado Department of Public Health ft Environment (the "Department"), Hazardous Materials and Waste
Management Division (the "Division") received a referral correspondence packet from Weld County on April 18, 2017,
requesting the Division's review of the Certificate of Designation (CD) application, and a document titled
"Engineering Design and Operations Plan (EDOP) version 6.0 and Closure Plan and Post -Closure Plan version 5.0 CH2E
Colorado, LLC / Hudson Tireville, LLC" (the "Plan") dated October 21, 2015 and amendments dated March 10, 2017
for CH2E.
The Division conducted a Completeness Review of the Plan in accordance with procedures outlined in the Solid
Waste Act, CRS 30-20-103 et seq., and corresponding Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR
1007-2, Part 1 ("Regulations"). In a letter dated May 18, 2017, the Division notified Jamie Kostura of CH2E that the
Plan was complete.
The Division initiated a 30 -day written public comment period by publishing a public notice in the Greeley Tribune
newspaper on June 8, 2017. The Division did not receive any comments during that period, which concluded on July
9, 2017.
It is the determination of the Division that the facility can comply with technical, environmental, and public health
standards of the Solid Waste Act and Regulations if the facility is operated and activities are monitored as detailed
in the final Plan. Based on this assessment, the Division recommends that this facility may be approved by Weld
County's Board of County Commissioners with any additional local restrictions Weld County may choose to impose.
The Division's approval of the Plan has the following conditions that shall be incorporated into the CD when and if
issued by Weld County:
The Financial Assurance Plan, including independent third party or referenced cost estimate, was submitted
in February 2013 to the Division for review and approval. The financial assurance mechanism was updated
and approved by the Division, March 13, 2016. Please note that pursuant to the requirements of Section
1.8.3 of the Regulations, the post -closure cost estimate must be adjusted annually to account for inflation
or deflation by using the implicit price deflator for the gross domestic product. Additionally, CH2E must
replace the original cost estimate every five (5) years unless otherwise required by the Division. Both the
annual adjustment and the 5 -year update cost estimates must be submitted to the Division for review and
approval.
As required by 30-20-104(3)(a) and (3)(b), Weld County is obligated to notify its citizens and conduct a public
hearing regarding the proposed solid waste facility. Please forward a copy of the Weld County's Board of County
Commissioners final resolution concerning the CD issuance or denial to the Division.
